Ordinance 1977-008 Amending Alcoholic Beverages SalesORDINANCE N0. 8-77 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 3 OF THE VILLAGE OF NORTH PALM BEACH CODE BY PERMITTING T}iE SALE OF BEER, ALE AND/OR WINE WITHIN 1000 FEET OF ' ANOTHER LICENSED RF,TAIL SELLER OF ALCOHOLIC BEVERAGES BY ANY BONA FIDF. RESTAURANT, AS DEFINED AND LICENSED UNDER FLORIDA STATUTES AS A RESTAURANT WITH FULL KITCHEN FACILITIES, REGARDLESS OF SIZE OR SF,ATING CAPACITY, WHERE BEER, ALE AND/OR WINE IS SERVED SOLELY AS AN ACCESSORY USE TO THE RESTAURANT AT TABLES ONLY, WITH NO BAR AND ONLY WHEN SUCH RESTAURANT IS OPEN FOR THE SALE AND SERVICE OP FOOD, RE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM REAC}{ FLORIDA: Section 1. That Section 3-22 of the Village of North Palm Reac}~ Code is hereby amended by adding thereto Subsection (4), which said subsection shall read as follows: ' "(4) That portion of Section 3-22 which states that no license shall be issued under this Chapter where the proposed place of business is within 1,000 feet of a place of business of another licensed retail seller of alcoholic beverages shall not apply to any bona fide restaurant as defined and licensed under Florida Statutes as a restaurant with full kitchen facilities, regardless of size or seating capacity, where beer, ale and/or wine is served solely as an accessory use to the restaurant at tables only, with no bar and only when such restaurant is open for the sale and service of food."
