AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
DECLARING THE ELECTION OF THE VILLAGE OF NORTH PALM BEACH TO
PROCEED UNDER THE PROVISIONS OF CHAPTER 163, PART II, FLORIDA
' STATUTES, REGARDING PLANNING, ZONING, BOARD OF ADJUSTMENT,
BUILDING CODES, SUBDIVISIONS, ETC,; SETTING FORTH THE NUMBER OF
MF.MBF,RS AND TERMS OF THE BOARD OF ADJUSTMENT, FEES FOR VARIANCES
SOUGHT BEFORE THE BOARD OF ADJUSTMENT, COMPOSITION OF MEMBERS

OF 1'IIE MASTER PLAN OF THE VILLAGE THE PRESENTLY EXISTING COMMUNITY
APPEARANCE PLAN; AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITI{,
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEAC}{,
FLORIDA:
Section 1. The Village. of North Palm Beach, desiring to utilize
t}~e provisions of Chapter 163, ,Part II, Florida Statutes, it being Sections
163.160 through 163.315, both inclusive, hereby declares its election to
proceed under the provisions of Chapter 163, Part II, Florida Statutes.
Section 2. The Planning Commission, as described in Section
163.180, shall consist of five members who shall serve for two-year terms
and two alternates who shall serve for one-year terms. At the first
appointment of members to the Planning Commission, three regular members
shall be appointed for a term of two years, two regular members shall be
appointed for a term of one year, and thereafter each appointment shall
be for two-year terms. All terms shall take effect on the 1st day of
May of each year. Alternate members of the Commission shall be appointed
on the same day that regular members are appointed. The Planning
Commission shall consist of one land use planner or architect, one architect,
one civil engineer, one person engaged in business within the corporate
' limits of the Village of North Palm Beach, and a fifth member wtio need
not be engaged in any particular business or profession. All vacancies
a~ the Planning Commission shall be filled within thirty (30) days so
as to maintain the composition of the Commission as set forth above.
Alternate members of the Planning Commission shall be appointed as
First Alternate and Second Alternate and shall serve in that order
w}ien necessary.
The Planning Commission shall meet at least once each mont}i
on a date to be determined by the Planning Commission.
Section 3. The Board of Adjustment, as described in Section
163.220, Florida Statutes, shall consist of five persons who shall serve
for three-year terms and two alternates who shall serve for one-year terms.
At the first appointment of members to the Board of Adjustment, two
regular members shall be appointed for a term of three years, two regular
members shall be appointed for a term of two years, and one regular
member shall be appointed for a term of one year. Thereafter, each
appointment shall be i'or a three-year term. All terms shall take effect
on the 1st day of May of each year. Alternate members of the Board of
Adjustment shall be appointed on the same day that regular members are
appointed. Alternate members of the Board of Adjustment shall be
appointed as First Alternate and Second Alternate and shall serve in that
' order when necessary.
Section 4. Section 45-50 of the Village of North Palm Beach
Code is hereby amended by changing the filing fee from the sum of
$25.00 to the sum of $100.00.
Section 5. Sections 6-21 through 6-40 of the Village of Nort}i
Palm Beach Code, described as the Appearance Code, are hereby adopted as
part of the Comprehensive Plan of the Village of North Palm Beach, as
set forth in Section 163.190, Florida Statutes; provided, however, that
Sections 6-23 through 6-27, both inclusive, and Sections 6-29 through
6-32, both inclusive, of the Village of North Palm Beach Code are hereby
repealed; and provided further that all references to Appearance Board
contained in the remaining provisions of said Chapter 6 of the Village
of North Palm Beach Code shall henceforth pertain to and be intended
' to mean the Planning Commission, as created by this Ordinance.
Section 6. Chapter 45 of the Village of North Palm Beach Code
is hereby included as part of the Comprehensive Plan of the Village of
North Palm Beach, provided, however, that Sections 45-40 through 45-48
be, and the same are hereby, repealed.

Section 7. This Ordinance shall take effect irrrnediately
upon passage.
