Ordinance 1976-017 Amendment Noise OrdinanceORDINANCE N0. 17-76 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, 1 AMENDING CHAPTER 22 OF THE VILLAGE OF NORTH PALM BEACH CODE BY CHANGING THE NOISE CONTROL MEASUREMENT STANDARDS OTHER THAN MOTOR VEHICLE NOISE STANDARDS AND BY AMENDING STANDARDS CONCERNING CONSTRUCTION ACTIVITIES. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Section 20 of Chapter 22 of the Village of North Palm Beach Code is hereby amended to read as follows: "Sec. 22-20. NOISE CONTROL MEASUREMENT STANDARDS OTHER THAN MOTOR VEHICLE NOISE STANDARDS 1 The noise from any activity or from any permissible use of property within the meaning of the applicable zoning district classifications of the Village of North Palm Beach, Florida, shall be deemed to be excessive, unnecessary, offensive and unusually loud if the total noise level as measured on the A-scale due to both ambient noise level and the alleged source of the unnecessary, offensive or excessive noise exceeds the noise levels which are herein prescribed, the measurement of which is based upon decibels, iie. 0.0002 microbar, and day conditions referring to the time between 7:00 A.M. and 10:00 P.M. and night conditions referring to the time between 10:00 P.M. and 7:00 A.M. All such measurements as well as the method employed shall be consistent with the regulations of the American National Standards Institute or its successor bodies and shall represent the A-weighted sound pressure level which is exceeded 50 percent of the time (L 50) during the observation period as described in Section 22-2 (1) of this chapter. (1) At no point on the boundary of or within a residential area zoned R-1, R-2 or R-3, according to the zoning code of the Village of North Palm Beach and official zoning map of the Village and as a result of any noise source outside of the property in question may the follow- ing sound pressure levels be exceeded: Day: 55 dBA Night: 50 dBA (2) At no point on the boundary of or within the area zoned C-1, C-2, C-A or C-lA, according to the zoning code of the Village and official zoning map of the Village may the following sound pressure levels be exceeded as a result of any noise outside the property in question: Day: 60 dBA Night: 60 dBA (3) For any source of sound which emits a discrete tone, the sound level limits set in Sections 22-20(1) through (3) shall be reduced by 5 dB. (4) For any source o£ sound measured at the source, the maximum sound levels shall not exceed the sound level limits in Sections 22-20(1) through (3) by: i. 10 dBA from 7:00 A,M. to 10:00 P,M. in a residential area. ii. 5 dBA from 10:00 P,M. to 7:00 A.M, in ' a residential area. iii, 10 dBA at all times in commercial, manu- facturing, industrial or agricultural land use work." Section Z, The second to the last sentence of Section 13 (1) of Chapter 22 of the Village of North Palm Beach Code which reads as follows is hereby deleted, to wit: "During such periods of emergency activities and during the normal construction hours of 8:00 A.M, to 8:00 P,M., the noise levels generated by con- struction activities shall not exceed 75 dBA for more than 10% of the time when measured at a distance of 50 feet from the construction site," Section 3.
