AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
AMENDING SECTION 45-36 (K) OF THE VILLAGE OF NORTH PALM BEACH CODE, IT BEING
T}{E 7,ONING CODE, BY PERMITTING A CARNIVAL, FAIR, OR CIRCUS TO BE CARRIED
ON BY A NON-PROFIT ORGANIZATION AT THE PREMISES WHERE THE ORGANIZATION IS
' LOCATED WITHIN THE VILLAGE OF NORTH PALM BEACH FOR A PERIOD OF TIME NOT TO
EXCEED THREE DAYS, AND SETTING FORTH OTHER RESTRICTIONS THEREON.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. Section 45-36 (K) of the Village of North Palm Beach
Code is hereby amended to read as follows:
Sec. 45-36. GENERAL PROVISIONS---The provisions of
this Article shall be subject to the following provisions and
exceptions:

K. No carnival, fair, amusement park or circus shall be
carried on in any residential or commercial zoning district
in the Village of North Palm Beach, including Zoning
Districts R-1, R-2A, R-3, C-A, C-lA, C-1 and C-2;
provided, however, that a carnival, fair or circus may be
carried by a non-profit organization to collect funds to
further the purposes of such organization at the premises
where the organization is located within the Village of
North Palm Beach. No such carnival, fair or circus shall
extend for more than three consecutive days, and no such
carnival, fair or circus may be open to the public between the
hours of 10 p.m, and 10 a.m. during any day. A permit for
such permitted carnival fair or circus must be obtained
from the office of the Village Manager. There will be no
charge or fee for such permit."
Section 2. This ordinance shall take effect immediately upon
passage.
