Ordinance 1975-004 Creating Country Club Advisory BoardORDINANCE N0. 4-75 AN ORDINANCE OF THE VILLAGE. OF NORTH PALM BEACH, FLORIDA, REPEALING THE BOARD OF GOVERNORS OF THE NORTH PALM BEACH COUNTRY CLUB AND CREATING A COUNTRY CLUB ADVISORY BOARD, SETTING FORTH THE DUTIES ' AND RESPONSIBILITIES OF THE MEMBERS OF THE ADVISORY BOARD, THE COMPOSITION, TERM OF OFFICE, MEETINGS AND FUNCTIONS. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA Section 1. Section 10.5-11 through 10.5-20 of the Village of North Palm Beach Code are hereby repealed. Section 2. Chapter 10.5 of the Village of North Palm Beach Code is hereby amended by adding thereto Section 10.5-1 through 10.5-5 to read as follows: "Sec. 10.5-1. NORTH PALM BEACH COUNTRY CLUB ADVISORY BOARD ---CREATION--- There is hereby created and established the ' North Palm Beach Country Club Advisory Board, to be known hereafter as the Country Club Advisory Board. "Sec. 10.5-2. COMPOSITION---(1) Said board shall be com- posed of seven members who shall be residents of the Village of North Palm Beach. (2) Members shall hold office for a term of two years commencing May 1st of each year, with three members' term expiring in even-numbered years and four members' term expiring in odd-numbered years; provided that any member may be removed from office by a majority vote of the members of the Village Council at any time without cause, and further provided that in the event of vacancies the Village Council shall appoint a member to the vacant office to serve for the remainder of the term vacated. (3) The Director of Country Club Activities shall attend all meetings of the Advisory Board. "Sec. 10.5-3. ORGANIZATION---At the first meeting after the new Board members take office each year, the Board shall select from among its members a Chairman, Vice Chairman and Secretary. ' "Sec. 10.5-4. MEETINGS---Meetings of the Board shall be held at the call of the Chairman, or at such other times as a majority of the Board may determine, but in no event shall the Board meet less often than once a month. Meetings of the Board shall be open to the public and the time and place of the meetings shall be announced sufficiently in advance to notify the public of same. The Board shall keep minutes of its proceedings, showing the vote of each member upon each question and shall promptly file all minutes with the office of the Village Clerk. These shall be a public record. The Board may establish rules and regulations and order of business which are deemed necessary for the conduct of its meetings. "Sec. 10,5-5. POWERS AND DUTIES---(1) The Country Club Advisory Board shall be advisory to the Village Council and shall have only those responsibilities specifically described in this Chapter, In all events and transactions they shall be deemed to be responsible to the Village Council, which shall have the power to alter, modify or change any recommendation, action or ruling of said Board. (2) The Board shall advise and recommend to the Village Council policy decisions concerning the supervision, control and management of the North Palm Beach Country Club, in- cluding golf course, pro shop, swimming facilities, dining room and bar facilities, parking lot, driving range and such additional matters as they deem appropriate to the use of the North Palm Beach Country Club. (3) The Board shall advise the Village Council concerning reasonable rules and regulations for the use of Country Club facilities by the members and the general public. No rules and regulations, however, shall be effective until approved by resolution of the Village Council. (4) The Board shall advise the Village Council concerning fees and dues to be charged for use of various Country Club facilities. Fees shall not be effective until passed by proper legislation of the Village Council. ' (5) In considering its advice to the Village Council on all matters concerned with the North Palm Beach Country Club, the Board shall continually examine its philosophy concerning use of facilities by Club members and residents of the Village of North Palm Beach who are non-members of the Country Club and it shall further consider and advise the Village Council on use of facilities located on or adjacent to the Country Club proper as a part of the Country Club operation or separate and distinct from the Country Club operation, it being the direction of the Village Council to the Advisory Board to make the facilities at the North Palm Beach Country Club available to the use and enjoyment of as many residents of the Village of North Palm Beach as possible, consistent with sound fiscal management of the Club and financial responsibility to the taxpayers of North Palm Beach. (6) Any matter referred by the Village Council to the Board shall be acted on by the Board within thirty days of the day of reference, unless otherwise specifically stated. The Board`s recommendation to the Council shall be in writing and shall state the basis or reasons for its recommendations. (7) The Board shall have the power to call upon any official or employee of the Village government for information and advice which in the opinion of the Board will insure the efficiency and reliability of its work. The Board may of its ' own volition report to the Village Council with recommendations on any matter which in its opinion affects Country Club use or planning. - 2 - (8) The Roard shall submit to the Village Council an annual report on or before April 15th of each year, summarizing the activities of the Board for that year and the action of the Council during that year on any and all recommendations made by the Board, as well as its annual recommendations for the North Palm Beach Country Club in sufficient detail that they can be considered by the Village Council in preparing its budget for the forthcoming fiscal year."
