A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, OPPOSING THE DESIGNATION OF
VILLAGE WATERWAYS AS NON-PREFERRED AS SET FORTH IN THE
PROPOSED MANATEE PROTECTION PLAN; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, as required by state law, Palm Beach County has prepared a Manatee Protection
Plan ("Plan") to be incorporated into the County Comprehensive Plan; and
WHEREAS, the County submitted its Plan to the State Fish and Wildlife Conservation
Commission ("FWCC") last June; and
WHEREAS, FWCC has not yet approved the Plan and has proposed modifications to the Plan
presented by the County; and
WHEREAS, the Plan includes a Boat Facility Siting component, whereby certain areas along the
waterways within the County are designated as preferred, conditional, non-preferred or
exclusionary, depending on the projected impacts to manatees; and
• WHEREAS, the Boat Facility Sitin com onent establishes certain max'
g p unum densities for each
of the different categories, ranging from unlimited slip densities in preferred areas to 1 slip for
100 feet of shoreline in non-preferred areas; and
WHEREAS, both the County Plan and the FWCC revisions drafted in response to the County
Plan designate certain areas along Village waterways asnon-preferred, with the FWCC proposal
making more restrictive designations; and
WHEREAS, the Village Waterways Board recommended opposing the designation of such areas
within the Village as set forth in the FWCC proposal; and
WHEREAS, the Village Council wishes to express its opposition to such designations.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA, as follows:
Section 1. The foregoing recitals are ratified as true and incorporated herein.
Section 2. The Village Council hereby declares its opposition to any designation of areas
along Village waterways asnon-preferred as set forth in the Boat Facility Siting component of
the County Manatee Protection Plan initiated by the Florida Fish and Wildlife Conservation
Commission.
Section 3. The Village Council directs that a copy of this Resolution be forwarded to Palm
• Beach County and the State of Florida Fish and Wildlife Conservation Commission.
Section 4. This Resolution shall take effect immediately upon adoption.
