Ordinance 1974-020 Rezoning - Bench Mark PropertyORDINANCE N0. 20-74 AN ORDINANCE OF THE VILLAGE OF NORTH PAIM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY ZONING CERTAIN LAND LYING EAST OF U. S. HIGHWAY N0. 1 AND SOUTH OF PART OF YACHT CLUB ADDITION TO THE VILLAGE OF NORTH PALM BEACH, WHICH LAND LIES DIRF,CTLY EAST OF THE BENCH MARK BUILDING ON U. S. HIGHWAY N0. 1 IN THE VILLAGE OF NORTH PALM BEACH, TO ZONING DISTRICT C-A, AND PLACING A PARCEL OF LAND ADJACENT THERETO AND DUE EAST OF THE FIRST PARCEL IN ZONING III STRICT R-1. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. That certain parcel of land in Section 16, Town- ship 42 South, Range 43 East, in the Village of North Palm Beach, Palm Beach County, Florida, as described. by metes and bounds on Survey 74552 by William D. Wallace, Inc. Engineers, copy of which is attached to this Ordinance, be and the same is hereby placed in Zoning District C-A. ' Section 2. That parcel of land in Section 16, Township 42 South, Range 43 East, in the Village of North Palm Beach, Palm Beach County, Florida, as described by metes and bounds on Survey 74557 by William D. Wallace, Inc. Engineers, copy of which is attached. to this Ordinance, be and. the same is hereby placed in Zoning District R-1. Section 3. The "Official Zoning Map" of the Village of North Palm Beach, as adopted by Section 45-17 of the Village of North Palm Beach Code, shall be amended in accordance with this Ordinance and with said. Section, and the Mayor and. the Village Clerk are hereby authorized and directed to reflect the changes upon the "Official Zoning Map" by hatching or other appropriate means so as to reflect the original zoning map and the change thereto occasioned by this Ordinance. Section 4. This Ordinance shall take effect upon compliance with the terms of that certain letter August 13, 1974 from L. M. Taylor to Herbert L. Gildan, Esquire, a copy of which letter is attached hereto and. by reference made a part hereof, or if not completed within six months from the date of this Ordinance, it shall become null and void. 4 PLACED ON FIRST READING THIS 14 DAY OF NOVEMBER, 1974. Federal Highway, North Palm Beach, Florida Dear Herb: I would like to confirm my telephone conversation with you as of Tuesday, August 13, 1974 when I informed you that if the Village of North Palm Beach went forward and rezoned the property directly behind the Bench Mark Building to the same depth as that property north of the Earman River on the east side of U.S. Highway #1, I would then as a gift to the Village of North Palm Beach cause the most westerly end of the canal behind the Bench Mark Building to be dredged out to approximately 5 or 6 feet. In addition, I would then bulkhead the most southerly side of the canal along with the most westward end thereby completing the bulkheading directly behind the Bench Mark Building.
