AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE ZONING
CODE, BY ELIMINATING THE R-2A ZONING CLASSIFICATION; AND BY AMENDING
THE BUILDING SITE AREA REGULATIONS AND OFF-STREET PARKING REGULATIONS IN
' THE R-2, R-3, C-1, C-lA AND C-2 ZONING DISTRICTS.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. Section 45-16 of the Village of North Palm Beach
Code is hereby amended to read as follows:
"Sec. 45-16. DIVISION OF VILLAGE INTO DISTRICTS;
DISTRICTS ENUMERATED---In order to classify, regulate
and restrict the uses of land and buildings, the
height and bulk of buildings, the amount of open
spaces about buildings, intensity of land use, the

into eight districts, as follows:

R-1 - Single Family Dwelling District
R-2 - Multiple Family Dwelling District
' R-3 = Apartment Dwelling District
C-A Commercial District
C-lA - Limited Commercial District
C-1 - Neighborhood Commercial District
C-2 - General Commercial District
P - Public District
In the creation of this Chapter of the respective
districts, the village council has given due and
careful consideration to the peculiar suitability
of each district for the particular uses and
regulations applied thereto and to the densities
of population, all in accordance with the compre-
hensive development plan of the village."
Section 2. Section 45-29 of the Village of North Palm Beach
Code is hereby repealed.
' Section 3. Section 45-28(C)(3) of the Village of North Palm
Beach Code is hereby amended to read as follows:
"Sec. 45-28(C)(3). For dwelling structures having
in excess of two (2) dwelling units not less than
four thousand (4,000) square feet of lot area shall
be added to the site for each dwelling unit in
excess of two (2). No main building, however, shall
occupy more than thirty-five (35) per cent of the
site area."
Section 4. Section 45-28(F)(2) of the Village of North Palm
Beach Code is hereby amended to read as follows:
"Sec. 45-28(F)(2). For each multiple-family dwelling
unit, there shall be provided two or more parking
spaces of 200 square feet each, in accordance with
the following forrrnxla:
' Two such spaces shall be provided for each
dwelling unit containing not more than two bedrooms,
and. two and one-half of such spaces shall be
provided for each dwelling unit containing three
or more bedrooms, with the provision that for an
uneven number of units, the fractional space result
produced by the application of such formula shall
count as a full space. (For examples: four dwell-
ing units containing three or more bedrooms shall
require 10 off-street parking spaces; three dwell-
ing units containing three or more bedrooms shall
require eight off-street parking spaces.)"
Section 5. Section 45-30 (C) of the Village of North Palm
Beach Code is hereby amended to read as follows:
"Sec. 45-30 (C) BUILDING SITE AREA REGULATIONS.
(1) For two family dwelling structures the minimum
lot or building site area shall be eight thousand
(8,000) square feet, and have a minimum width of
not less than seventy-five (75) feet.
(2) For dwelling structures having in excess of
two dwelling units, not less than two thousand,
(2,000) square feet of lot area shall be added to
the site for each dwelling unit in excess of two (2).
(3) No structures shall occupy more than thirty-
five (35) per cent of the site area."
Section 6. Section 45-30(E)(1) of the Village of North Palm
Beach Code is hereby amended to read as Follows:
"Sec. 45-30(E)(1). For each multiple-family dwell-
ing structure, there shall be provided two or more
parking spaces of 200 square feet each, in accor-
dance with the following formula:
Two such spaces shall be provided for each dwell-
ing unit containing not more than two bedrooms, and
two and one-half of such spaces shall be provided
for each dwelling unit containing three or more bed-
rooms, with the provision that for an uneven num-
ber of units, the fractional space result produced
by the application of such formula shall count as a
full space; provided., however, that in multiple-
family dwellings containing more than thirty dwell-
, ing units, for each dwelling unit in excess of thirty
units and up to sixty units one such space shall be
provided for each dwelling unit containing not more
than two bedrooms, and for each dwelling unit in
excess of sixty dwelling units one and one-half such
spaces shall be provided for each dwelling unit con-
taining not more than two bedrooms, and two and

one-half of such spaces shall be provided for each
dwelling unit containing three or more bedrooms,
with the provision that for an uneven number of
units, the fractional space result produced by the
application of such formula shall count as a full
space. (For examples: #h}rty dwel.l.ing units con-
taining two bedrooms each shall require sixty off-
street parking spaces; sixty dwelling units con-
' taining two bedrooms each shall require ninety off-
street parking spaces; and ninety dwelling units
containing two bedrooms each shall require one
hundred thirty-five off-street parking spaces."
Section 7. Section 45-32 (C) of the Village of North Palm Beach
Code is hereby amended to read as follows:
"Sec. 45-32(C). BUILDING SITE AREA REGULATIONS.
(1) For single and multiple family dwelling struc-
tures, the same as required in the R-1 and R-3 dis-
tricts, respectively."
Section 8. Section 45-33 (B) of the Village of North Palm Beach
Code is hereby amended. to read as follows:
For buildings in excess of two stories or thirty (30)
feet in height, five (5) feet shall be added to the re-
quired front-yard setback for each story in excess
of two (2) or in excess of thirty (30) feet in height.
No structures, however, shall occupy more than
thirty-five (35) per cent of the site area so required."
Section 9. Section 45-33 (C) of the Village of North Palm Beach
Code is hereby amended to read as follows:
"Sec. 45-33(C). BUILDING AREA REGULATIONS.
(1) For single and multiple family dwelling struc-
tures, the same as for the R-1 and R-3 districts,
respectively."
