Ordinance 1972-023 Setback from Dune Line or Highwater MarkORDINANCE N0. 23-72
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
REQUIRING BUILDINGS TO BE SET BACK A MINIMUM OF FIFTY FEET FROM THE
DUNE LINE OR A MINIMUM OF ONE HUNDRED FEET FROM THE HIGHWATER MARK,
' WHICHEVER DISTANCE IS GREATER, FOR ALL PROPERTY BORDERING ON THE
ATLANTIC OCEAN.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA
Section 1. Chapter 45 of the Village of North Palm Beach Code is
hereby amended by adding thereto Section 45-22, which said section shall
read as follows:
"Sec. 45-22. OCEANFRONT LAND---OCEAN SETBACK---
There shall be a building setback line of not less than
fifty feet from the dune line, or one hundred feet from
the highwater line, whichever distance is greater, for
all property bordering on the Atlantic Ocean. The
measurement of the setback from the dune line and the
highwater line shall be to the closest edge of any
building to be constructed on the Atlantic oceanfront."
