Ordinance 208 Zoning MapORDINANCE N0. 208-70 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ORDINANCE N0. 20, AS HERETOFORE AMENDED, THE SAME BEING T}[E COMPREHENSIVE ZONING ORDINANCE OF SAID VILLAGE, BY ADOPTING A NEW OFFICIAL ZONING MAP, BY PROVIDING FOR THE METHOD OF AMENDING THE ZONING MAP AND FOR IDENTIFYING THE OFFICIAL ZONING MAP OF THE VILLAGE, AND BY CLARIFYING OR RECLASSLFYING CERTAIN PROPERTY AS R-1, SINGLE FAMILY RESIDENTIAL DISTRICT, INCLUDING ALL PROPERTY LYING EAST OF THE WATERS OF LAKE WORTH WITHIN THE VILLAGE OF NORTH PALM BEAC}{ AND CERTAIN PROPERTY LYING NORTH OF TEAL WAY WEST OF THE NORTH PALM BEACH WATERWAY IN THE VILLAGE OF NORTH PALM BEACH; BY PRO- VIDING FOR T}{E REPEAL OF ORDINANCES IN CONFLICT HEREWITH AND FOR OTHER PURPOSES. W}{F,REAS, the Village Council, pursuant to authority vested in it under Section 14 of Ordinance No. 20, the same being the comprehensive zoning ordinance of said Village, has ' deemed it advisable and necessary to amend said zoning ordinance in certain respects, and W}{F,REAS, a public hearing relating to said proposed amendments was duly held pursuant to publication of the date and purpose of said hearing as prescribed by law, and WHEREAS, certain confusion exists concerning amendments to the Official Zoning Map of the Village of North Palm Beach and purported rezoning of certain property in the Village of North Palm Beach, and WHEREAS, the Village Council has determined that it will be to the best interests of the public welfare, safety and morals to amend Ordinance No. 20 in the manner discussed and proposed at said hearing, ' NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORT}{ PALM BEACH, FLORIDA, as follows: ~i Section 1. That Ordinance No. 20, as amended, it being the Comprehensive Zoning Ordinance of said Village, be and the same is hereby further amended in the following respects, to-wit: A. Section 3 of Ordinance No. 20 is amended to read as follows: "Section 3. Districts: In order to classify, regulate and restrict the uses of land and build- ' ings, the height and bulk of buildings, the amount of open spaces about buildings, intensity of land use, the Village of North Palm Beach, Florida, is divided into nine (9) districts, as follows: R-1 - Single Family Dwelling District R-2 - Multiple Family Dwelling District R-2A - Limited Multiple Family Dwelling District R-3 - Apartment Dwelling District C-A - Commercial District C-lA - Limited Commercial District C-1 - Neighborhood Commercial District C-2 - General Commercial District P - Public District The aforesaid districts and the boundaries ' thereof are as shown upon the "Official Zoning Map" which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this Ordinance as if the information set forth on the Map was all fully described and set out herein. The Official Zoning Map shall be identified by the signature of the Mayor attested by the Village Clerk, and bearing the seal of the Village under the following words; "This is to certify that this is the Official Zoning Map referred to in Section 3 of Ordinance No. 20 of the Village of North Palm Beach, Florida, as amended", together with the date of the adoption of this ordinance. If, in accordance with the provisions of this ordinance changes are made in district boundaries or other matter portrayed on the Official Zoning Map, such changes shall be entered on the Official Zoning Map promptly after the amendment has been approved by the Village Council, with an entry on the Official Zoning Map as follows: "On (date), by official action of the Village Council, the following change(s) ' were made in the Official Zoning Map: (brief description of nature of change)", which entry shall be signed by the Mayor and attested by the Village Clerk, and the official changes shall be made upon the Official Zoning Map by hatching - 2 - or other appropriate means, including redraft by an engineer so as to reflect the original map and the changes thereto with all official notations thereon. No changes of any nature shall be made in the Official Zoning Map or matter shown thereon except in conformity with the procedures set ' forth in this ordinance. Any unauthorized change of whatever kind or any failure to make a change when directed by Ordinance by any person or persons shall be considered a violation of this ordinance and punishable as provided under Section 16 of Ordinance No. 20. Regardless of the existence of purported copies of the Official Zoning Map which may from time to time be made or published, the Official Zoning Map which shall be located in the office of the Village Clerk shall be the final authority as to the current zoning status of land and water areas, buildings, and other structures in the Village. In the event that the Official Zoning Map becomes damaged, destroyed, lost or difficult to interpret because of the nature or number of changes and additions, the Village Council may by resolution adopt a new Official Zoning Map which shall supersede the prior Official Zoning Map. The new Official Zoning Map may correct drafting or other errors or omissions in the ' prior Official Zoning Map, but no such corrections shall have the effect of amending the original Official Zoning Map or any subsequent amendment thereto. The new Official Zoning Map shall be identified by the signature of the Mayor attested by the Village Clerk and bearing the seal of the Village under the following words: "This is to certify that this Official Zoning Map supersedes and replaces the Official Zoning Map adopted (date of adoption of map being replaced) as part of Ordinance No. 20 of the Village of North Palm Beach, Florida." Unless the prior. Official Zoning Map has been lost, or has been totally destroyed, the prior map or any significant parts thereof remaining shall be preserved, together with all available records pertaining to its adoption or amendment, Each replacement Official Zoning Map shall be numbered in consecutive order as adopted. In the creation of this ordinance of the respective districts, the Village Council has given due and careful consideration to the peculiar suitability of each district for the particular uses and regulations applied thereto and to the densities ' of population, all in accordance with the comprehensive development plan of the Village." Section 2. Some doubt exists concerning the existing or proper zoning for all lands within the corporate limits of the - 3 - Village of North Palm Beach lying East of the western boundaries of the waters of Lake Worth, except land known as Little Munyon Island, which is currently zoned C-lA, and all lands within the corporate limits of the Village of North Palm Beach lying East of the western boundaries of the waters of Lake Worth shall henceforth be classified R-1, SINGLE FAMILY DWELLING DISTRICT, as shown on the Official Zoning Map accompanying this ordinance, except Little Munyon Island which shall remain in Zoning District C-lA, as shown on the Official Zoning Map accompanying this ordinance. Section 3. Some doubt exists concerning the existing or proper zoning for the land within the corporate limits of the Village of North Palm Beach lying North of Teal Way on Plat No. 6 of the Village of North Palm Beach, and said land shall henceforth be classified R-1, R-2, C-1 and C-2, all as shown on the Official Zoning Map accompanying this Ordinance. Section 4. All ordinances or parts of ordinances in conflict herewith be, and the same are hereby, repealed. Section 5. Should any section, clause or provision of this Ordinance be declared by the court to be invalid, the same shall not affect the validity of and should any portion of ordinance be declared by a affect the validity of the Map as a whole or any part invalid. the ordinance as a whole or any part thereof, .he Official Zoning Map adopted by this court to be invalid, the same shall not remaining portions of the Official Zoning thereof other than the part so declared to be PLACED ON FIRST READING THIS 12TH DAY OF FEBRUARY, 1970.
