01-13-2005 VC REG-MMINUTES OF THE REGULAR SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JANUARY 13, 2005 Present: Donald G. Noel, Mayor Dr. Edwazd M. Eissey, Vice Mayor Chazles R. O'Meilia, President Pro Tem David B. Norris, Councilman Robert F. Rennebaum, Councilman Mazk Bates, Village Manager George W. Baldwin, Village Attorney Melissa Teal, CMC, Village Clerk ROLL CALL Mayor Noel called the meeting to order at 7:30 p.m. All members of Council were present. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Noel gave the invocation, and Councilman Rennebaum led the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES The following minutes were approved: Minutes of Public Hearing (Bill 1159 -Ordinance 33-2004) held 12/9/04 Minutes of Public Hearing (Bill 1160) held 12/9/04 Minutes of Public Hearing (Bill 1161) held 12/9/04 Minutes of Regular Session held 12/9/04 CONSENT AGENDA Vice Mayor Eissey moved to approve the Consent Agenda. Councilman Norris seconded the motion, which passed unanimously. The following minutes were received for file: Minutes of the Police & Fire Pension Boazd meeting held 8/3/04 Minutes of General Employees Pension Board meeting held 9/14/04 Minutes of Police & Fire Pension Boazd meeting held 9/22/04 Minutes of Planning Commission meeting held 11/9/04 Minutes of Library Advisory Board meeting held 11/30/04 Minutes of General Employees Pension Boazd meeting held 12/1/04 Minutes of Planning Commission meeting held 12/7/04 Minutes of Country Club Advisory Board meeting held 12/13/04 • VILLAGE MANAGER'S MATTERS Chief Knight gave a status report on replacement of the trailer at the North Substation, and an update concerning defibrillators. MINUTES OF REGULAR SESSION HELD JANUARY 13, 2005 Discussion took place concerning attendance at Palm Beach County Days in Tallahassee. It was • confirmed that Mayor Noel and Councilman Rennebaum will attend. Mr. Bates advised that maintenance of landscaping in the U.S. Highway 1 thoroughfare area and landscaping adjacent to the clubhouse will be performed by the Golf Course Superintendent's staff, resulting in savings of approximately $20,000 annually. Mr. Bates reported on the upcoming purchase of aPoint-of--Sale system for the Country Club. Mr. Bates announced that the Department of Environmental Protection is holding a land management workshop for MacArthur Beach State Park on Tuesday, February 1st at 7:00 p.m., in the Nature Center at the Park. The purpose is to obtain public input on changes to the park's land use plan. As the Council representative on the John D. MacArthur Park Conservation Corporation Board of Directors, Vice Mayor Eissey offered to bring forward on behalf of the Council and citizens, any issues they would wish to have discussed at the workshop. Mr. Bates advised that the County is conducting a meeting on Wednesday, January 19th at 3:00 p.m. at the Riviera Beach Marina to discuss its plans to place a mooring field at the north end of the Blue Heron Bridge area. President Pro Tem O'Meiiia stated that the Village will be receiving a questionnaire from Palm Beach County Department of Environmental Resources Management, pursuant to the Manatee Protection Zone Program required by state law. President Pro Tem O'Meilia advised that Palm Beach County will be required to pass a countywide ordinance regarding this issue, but the Village will have the option to opt out. President Pro Tem O'Meilia suggested that we inform the County about our manatee protection fund. Mr. Bates discussed the new half-cent sales tax imposed in Palm Beach County, and its impact on Village fees and Country Club rates. Mr. Bates reported that the Country Club Advisory Board would like the Council to consider adjusting the published rates to a rate that shows a fee inclusive of tax. Discussion took place concerning whether tax is charged on top of the stated fee or included in the fee, and the impact on budgeted revenues. This issue will be brought back for further consideration at the next meeting on January 27, 2005. BILL 1162 -AUDIT COMMITTEE AMENDMENT -PLACED ON FIRST READING Councilman Rennebaum moved that Bill 1162 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2, COMPOSITION; TERMS; VACANCIES OF ORDINANCE 06-2004, WHICH CREATED AN AUDIT COMMITTEE, FOR THE PURPOSE OF CHANGING THE COMPOSITION AND TERMS OF THE AUDIT COMMITTEE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE • be placed on first reading and read by title alone. President Pro Tem O'Meilia seconded the motion. A correction was noted in Section 1 of the ordinance; under (b), the third line should reference four (4) resident members. Thereafter, the motion passed unanimously. 2 MINUTES OF REGULAR SESSION HELD JANUARY 13, 2005 BILL 1163 -CODE AMENDMENT -EARLY VOTING -PLACED ON FIRST READING President Pro Tem O'Meilia moved that Bill 1163 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ARTICLE I OF CHAPTER 10, ELECTIONS, OF THE CODE OF ORDINANCES OF THE VII,LAGE, BY ADDING A SECTION 10-13 THERETO ENTITLED "EARLY VOTING" TO PROVIDE THAT THE VILLAGE IS EXEMPTED FROM EARLY VOTING AS SET FORTH IN FLORIDA STATUTE 101.657; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AUTHORIZING AND DIRECTING THE VILLAGE CLERK TO FURNISH A CERTIFIED COPY OF THIS ORDINANCE TO PALM BEACH COUNTY SUPERVISOR OF ELECTIONS; AND, PROVIDING FOR AN EFFECTIVE DATE be placed on first reading and read by title alone. Councilman Rennebaum seconded the motion, and all present voted aye. RESOLUTION 01-2005 ADOPTED -PUBLIC SAFETY DIRECTOR SALARY President Pro Tem O'Meilia moved that Resolution 01-2005 entitled: be adopted. A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, RATIFYING, APPROVING AND AUTHORIZING THE PAYMENT OF A YEARLY BASE SALARY TO JAMES W. KNIGHT, JR., PUBLIC SAFETY DIRECTOR, IN AMOUNT OF $110,900.00; AND, PROVIDING FOR AN EFFECTIVE DATE be adopted. Councilman Rennebaum seconded the motion. During discussion, it was clarified that the Public Safety Director will not be issued a Village vehicle. The Village Manager was directed to check on insurance coverage related to use of the Chief's personal vehicle. Thereafter, the motion passed unanimously. RESOLUTION 02-2005 ADOPTED -NEW-HIRE RATE AMENDMENT TO PERSONNEL RULES AND REGULATIONS Councilman Rennebaum moved that Resolution 02-2005 entitled: be adopted. A RESOLUTION OF THE VILLAGE COUNCII. OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 4.02, NEW-HIRE, OF THE PERSONNEL RULES AND REGULATIONS OF THE VILLAGE OF NORTH PALM BEACH WHICH PROVIDES A PROCEDURE WHEREBY THE VILLAGE MANAGER APPROVES APPOINTMENTS AND SALARIES OF NEWLY HIRED EMPLOYEES; AND, PROVIDING FOR AN EFFECTIVE DATE be adopted. Vice Mayor Eissey seconded the motion. The motion passed 3 - 2, with • Councilman Rennebaum, Vice Mayor Eissey, and Mayor Noel voting aye, and Councilman Norris and President Pro Tem O'Meilia opposed. 3 MINUTES OF REGULAR SESSION HELD JANUARY 13, 2005 RESOLUTION 03-2005 ADOPTED -ACCEPTING EQUIPMENT FINANCING PROPOSAL • President Pro Tem O'Meilia moved that Resolution 03-2005 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE EQUIPMENT FINANCING PROPOSAL FROM SUNTRUST LEASING CORPORATION ATTACHED AS EXHIBIT "A", FOR VARIOUS EQUIPMENT PURCHASES IN THE AMOUNT OF UP TO $223,500 AND AUTHORIZING THE VILLAGE MANAGER AND VILLAGE CLERK TO ENTER INTO AN AGREEMENT, AND PROVIDING FOR AN EFFECTIVE DATE be adopted. Vice Mayor Eissey seconded the motion, which passed unanimously. COUNCIL MEETING DATE SCHEDULE CHANGE WITHDRAWN Discussion took place concerning the request of Vice Mayor Eissey to amend the regularly scheduled Village of North Palm Beach Council meeting dates by changing the Council meeting on Thursday, March 10, 2005 to March 3, 2005, and changing the Council meeting on Thursday, June 9, 2005 to Wednesday, June 8, 2005. Vice Mayor Eissey withdrew his request. TRAFFIC ENFORCEMENT WITHIN GATED COMMUNITIES Councilman Norris moved to authorize and direct the Village Administration and Village Attorney to develop and create an acceptable "Jurisdiction Agreement" that may be considered and approved by various Village Homeowner Associations requesting traffic enforcement assistance from the Village of North Palm Beach. Vice Mayor Eissey seconded the motion, and all present voted aye.
