09-29-2005 VC SP-MMINUTES OF THE SPECIAL SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA SEPTEMBER 29, 2005 Present: David B. Norris, Vice Mayor Robert F. Rennebaum, President Pro Tem Charles R. O'Meilia, Councilman Donald G. Noel, Councilman Mark Bates, Village Manager Melissa Teal, CMC, Village Clerk George W. Baldwin Village Attorney Absent: Dr. Edward M. Eissey, Mayor ROLL CALL Vice Mayor Norris called the meeting to order at 7:00 p.m. All members of Council were present, except Mayor Eissey, who was out of town. All members of staffwere present. ORDINANCE 27-2005 ENACTED - GENERAL EMPLOYEES PENSION PLAN AMENDMENT FOR BARGAINING UNIT EMPLOYEES President Pro Tem Rennebaum moved that Bill 1189 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING VARIOUS SECTIONS OF DIVISION 3. PENSION AND CERTAIN OTHER BENEFITS FOR BARGAINING UNIT EMPLOYEE GROUP PARTICIPANTS OF THE VILLAGE GENERAL EMPLOYEE PENSION PLAN, OF ARTICLE V, PENSIONS AND RETIREMENT SYSTEMS, OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE VILLAGE; AMENDING SECTION 2-146, DEFINITIONS, BY CHANGING THE ACTUARIAL PRESENT VALUE OF LUMP SUM DISTRIBUTIONS; AMENDING SECTION 2-158.1, OPTIONAL BENEFIT PLAN NO. 2, TO PROVIDE THAT THE COST OF LIVING ADJUSTMENT (COLA) SHALL NOT APPLY TO LUMP SUM CALCULATIONS FOR BARGAINING UNIT EMPLOYEES HIRED BY THE VILLAGE SUBSEQUENT TO THE EFFECTIVE DATE OF THIS ORDINANCE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE be placed on second reading and read by title alone. Councilman Noel seconded the motion, and all present voted aye. Councilman Noel moved to enact Bill 1189 as Ordinance 27-2005. President Pro Tem Rennebaum seconded the motion, and all present voted aye. l~ MINUTES OF SPECIAL SESSION HELD SEPTEMBER 29, 2005 . ORDINANCE 28-2005 ENACTED -GENERAL FUND BUDGET AND COUNTRY CLUB BUDGET AMENDMENT FOR FISCAL YEAR 2004-2005 President Pro Tem Rennebaum moved that Bill 1190 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND AND COUNTRY CLUB BUDGETS FOR THE FISCAL YEAR 2004-2005 TO TRANSFER FUNDS IN THE AMOUNT OF $115,000 and $ 42,500 RESPECTIVELY FOR THE REMAINDER OF THE FISCAL YEAR be placed on second reading and read by title alone. Councilman Noel seconded the motion. Discussion ensued on transferring funds from performance raise and contingency accounts. Councilman O'Meilia moved to amend the ordinance by transferring funds in the General Fund Budget from Council Contingency in the amount of $5,000 to Facilities Maintenance -Gas, Oil & Lub., and in the amount of $30,000 to Village Attorney -Labor Services, and to transfer funds in the Country Club Budget from Contingency to Golf Course Maintenance, Pool -Electricity and Gas, Food & Beverage - R&M Machinery & Equipment, Administration -Advertising, and to make up the balance needed out of Performance Raises from the Contingency account. The motion was seconded by President Pro Tem Rennebaum and all present voted aye. Thereafter, the original motion, as amended, passed unanimously. President Pro Tem Rennebaum moved to enact Bi111190 as Ordinance 28-2005. Councilman Noel seconded the motion, and all present vote aye. RESOLUTION 90-2005 ADOPTED -PBA AGREEMENT ADDENDUM Councilman O'Meilia moved that Resolution 90-2005 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO ENTER INTO AN ADDENDUM TO AMEND COLLECTIVE BARGAINING AGREEMENT BETWEEN THE VILLAGE OF NORTH PALM BEACH AND THE PALM BEACH COUNTY POLICE BENEVOLENT ASSOCIATION ATTACHED AS EXHIBIT "A" AND MADE PART OF THIS RESOLUTION; AND, PROVIDING FOR AN EFFECTIVE DATE be adopted. President Pro Tem Rennebaum seconded the motion. Village Manager Mark Bates reported a delay in the ratification vote by the PBA membership due to mail balloting, and recommended that Council ratify the agreement subject to ratification by the PBA. Councilman O'Meilia moved to amend the resolution in accordance with the Manager's recommendation, with a time limit of 30 days. Councilman Noel seconded the motion, and all present voted aye. Village Attorney George Baldwin read the change to Section 3 of the Resolution: "this resolution shall take effect upon approval by the Police Benevolent Association within thirty days, which approval must be given within such time period or the resolution shall not take effect." Thereafter, the motion to adopt Resolution 90-2005, as amended, passed unanimously. • 2 MINUTES OF SPECIAL SESSION HELD SEPTEMBER 29, 2005 • RESOLUTION 91-2005 ADOPTED -PROFESSIONAL FIREFIGHTERS/PARAMEDICS AGREEMENT ADDENDUM President Pro Tem Rennebaum moved that Resolution 91-2005 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO ENTER INTO AN ADDENDUM TO AMEND COLLECTIVE BARGAINING AGREEMENT BETWEEN THE VILLAGE OF NORTH PALM BEACH AND PROFESSIONAL FIREFIGHTERS/PARAMEDICS OF PALM BEACH COUNTY, LOCAL 2928, IAFF, INC., ATTACHED AS EXHIBIT "A", AND MADE PART OF THIS RESOLUTION; AND, PROVIDING FOR AN EFFECTIVE DATE be adopted. Councilman Noel seconded the motion. Firefighter Anthony Giarusso, District Vice President 12, addressed the Council to express his appreciation. Thereafter, the motion passed with all present voting aye.
