09-26-2006 VC SP1-MMINUTES OF THE SPECIAL SESSION • VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA SEPTEMBER 26, 2006 Present: David B. Norris, Mayor Dr. Edward M. Eissey, Vice Mayor William Manuel, President Pro Tem Charles R. O'Meilia, Councilman Darryl Aubrey, Councilman Mark Bates, Village Manager Leonard G. Rubin, Village Attorney Melissa Teal, CMC, Village Clerk ROLL CALL Mayor Norris called the meeting to order at 7:30 p.m. All members of Council were present. All members of staff were present. PUBLIC HEARING ON AD VALOREM TAX ORDINANCE AND BUDGET ORDINANCE Mayor Norris opened the Public Hearing on the Ad Valorem Tax ordinance and Budget ordinance. Village Attorney Len Rubin stated the rolled-back rate is 5.6722, and the proposed millage rate is 6.4, which represents an increase of 12.83% increase over the rolled-back rate. Finance Director Samia Janjua stated that the 6.4 millage rate may be approved or further reduced by the Council. Ms. Janjua asked Council to consider three final budget matters: possible reduction of the millage rate to 6.3 mills, which would reflect an increase of 11.07% over the rolled-back rate, increasing solid waste revenues and disposal fees to reflect Palm Beach County's recent solid waste disposal fee adjustment, and an adjustment to the Comprehensive Pay Plan to eliminate one course supervisor position and add one greens maintenance position. COMMENTS FROM THE PUBLIC There were no comments from the public. DISCUSSION OF BUDGET AMENDMENTS Discussion took place on including the proposed 5% increase in building permit fees in the budget. Council consensus was to leave the budgeted revenue at $927,000 as proposed. Brief discussion was held on the Village's property, liability, and worker's compensation insurance. • Discussion took place concerning the net income and Council Contingency budgeted for the Country Club. MINUTES OF SPECIAL SESSION HELD SEPTEMBER 26, 2006 • BILL 1213 -MILEAGE ORDINANCE -AMENDED AND ADOPTED AS ORDINANCE 2006-18 Councilman O'Meilia moved to approve second reading and adoption of ordinance adopting the ad valorem tax millage rate for fiscal year 2006-2007. Vice Mayor Eissey seconded the motion. Councilman O'Meilia moved to reduce the millage rate to 6.3. President Pro Tem Manuel seconded the motion, which passed unanimously. Thereafter, the motion to adopt Ordinance 2006-18 entitled AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ESTABLISHING AND ADOPTING THE VILLAGE OF NORTH PALM BEACH AD VALOREM TAX OPERATING MILEAGE LEVY RATE AT 6.3000 MILLS FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2006 AND ENDING SEPTEMBER 30, 2007 ("2006/2007 FISCAL YEAR") REPRESENTING AN INCREASE OF 11.07% FROM THE PRIOR YEAR'S ROLLED BACK RATE, AND ESTABLISHING AND ADOPTING THE VILLAGE OF NORTH PALM BEACH AD VALOREM TAX DEBT SERVICE MILEAGE LEVY RATE AT 0.0000 MILLS FOR THE 2006/2007 FISCAL YEAR; FOR A TOTAL AD VALOREM TAX MILEAGE LEVY RATE OF 6.3000 MILLS FOR ALL PURPOSES OR $6.3000 PER THOUSAND DOLLARS OF TAXABLE ASSESSED PROPERTY VALUE; PROVIDING FOR CONFLICTS; AND, PROVIDING AN EFFECTIVE DATE as amended, passed unanimously. BILL i 214 -BUDGET ORDINANCE -AMENDED AND ADOPTED AS ORDINANCE 2006-19 Vice Mayor Eissey moved to approve second reading and adoption of an ordinance adopting the Budget for fiscal year 2006-2007. Councilman O'Meilia seconded the motion. Councilman O'Meilia moved to include the solid waste fee adjustment and amend the Comprehensive Pay Plan by deleting the golf course supervisor position and creating an additional greens maintenance position. Vice Mayor Eissey seconded the motion and all present voted aye. President Pro Tem Manuel moved to provide for the reduction in the millage rate by using $150,000 from Council Contingency and $40,000 from Village Manager Contingency. Councilman O'Meilia seconded the motion, which passed unanimously. Councilman O'Meilia moved to revise the General Fund Budget and Country Club Budget to provide that the Country Club pay the Village $70,000 in administrative expenses. President Pro Tem Manuel seconded the motion. Discussion ensued on bringing this back for consideration in February or March, after the golf course opens. Thereafter, the motion failed 1 - 4, with Councilman O'Meilia voting aye, and President Pro Tem Manuel, Councilman Aubrey, Vice Mayor Eissey and Mayor Norris voting nay. • 2 MINUTES OF SPECIAL SESSION HELD SEPTEMBER 26, 2006 Thereafter, the motion to adopt Ordinance 2006-19 entitled • AN ORDINANCE OF THE VIL A L GE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING THE ANNUAL BUDGET OF THE VILLAGE OF NORTH PALM BEACH FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2006 AND ENDING SEPTEMBER 30, 2007 AND AUTHORIZING ALLOCATIONS, APPROPRIATIONS AND EXPENDITURES IN ACCORDANCE WITH THE BUDGET AND AS AUTHORIZED BY LAW; APPROVING A COMPREHENSIVE PAY PLAN AND AUTHORIZING THE VILLAGE MANAGER TO MAKE TEMPORARY APPOINTMENTS TO BUDGETED POSITIONS; PROVIDING THE CREATION OF GOVERNMENTAL FUNDS WHEN NECESSARY; PROVIDING FOR THE SUSPENSION OF EXPENDITURES BY RESOLUTION OF THE VILLAGE COUNCIL; PROVIDING PROCEDURES FOR AMENDMENT OF THE BUDGET; PROVIDING FOR THE LAPSE OF OUTSTANDING ENCUMBRANCES AND THE RE-APPROPRIATION OF UNEXPENDED CAPITAL APPROPRIATIONS FOR THE PRIOR FISCAL YEAR; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE as amended, passed unanimously.
