AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, ADOPTING AMENDMENT NO. 02-1.3 TO THE ADOPTED
COMPREHENSIVE PLAN FOR THE VILLAGE OF NORTH PALM BEACH, FLORIDA, IN
ACCORDANCE WITH THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND
LAND DEVELOPMENT REGULATION ACT, AS AMENDED, BEING SECTIONS 163.3161,
ET SEQ., FLORIDA STATUTES, WHICH AMENDMENT IS ATTACHED AS EXHIBIT "A"
AND INCORPORATED HEREIN BY REFERENCE; ADDING A POLICY DESIGNATING
PROSPERITY FARMS ROAD FROM NORTHLAKE BOULEVARD TO BURNS ROAD
WITHIN THE VILLAGE OF NORTH PALM BEACH AS A CONSTRAINED ROAD AT A
LOWER LEVEL OF SERVICE (GRACES) FACILITY; PROVIDING FOR SEVERABILITY;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to 163.3161 et seq., Florida Statutes, being the Local Government
Comprehensive Planning and Land Development Regulation Act, the Village ofNorth Palm Beach is
required to adopt, periodically evaluate and revise a Comprehensive Plan; and
WHEREAS, on December 4, 2001, the Village Planning Commission, sitting as the Local Planning
Agency, held a Public Hearing to review Amendment No. 02-1.3 and made a recommendation to the
Village Council to approve the amendments to the Comprehensive Plan; and
WHEREAS, The Village Council of the Village of North Palm Beach, after public hearing and due
consideration, is desirous of adopting Amendment No. 02-1.3 to the Comprehensive Plan for the
Village of North Palm Beach.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Pursuant to the provisions of the Local Government Comprehensive Planning and
Land Development Regulation Act, Section 163.3161 et seq., Florida Statutes, the Village ofNorth
Palm Beach, Florida, hereby adopts Amendment No. 02-1.3 to the Comprehensive Plan ofthe Village
of North Palm Beach, Florida. A copy of Amendment No. 02-1.3 is attached hereto and made a part
hereof as Exhibit "A".
Section 2. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any
reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the
remainder of this Ordinance.
Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 4. This Ordinance shall take effect upon a final order being issued by the Department of
Community Affairs finding the amendment to be in-compliance in accordance with Chapter 163.3184,
F. S.; or the date a final order is issued by the Administration Commission finding the amendment to
be in compliance in accordance with Section 163.3184, F. S.

A. INTRODUCTION
The segment of Prosperity Farms Road from Northlake Boulevard north to Burns Road
(as highlighted on Map 1) currently exists principally as a 3-lane section. Traffic volumes on
this segment currently exceed the level-of-service (LOS) threshold adopted by Palm Beach
County, and are rapidly approaching the threshold adopted by the Village of North Palm Beach.
A committee, consisting of Village residents and Village officials, has been working on
plans to install horizontal alignment features and landscaping elements to the roadway in order to
slow vehicle speeds and improve the visual character of the area. The Palm Beach County
District 1 Commissioner has agreed to provide financial assistance from District improvement
funds for these roadway enhancements. The Village is currently in the process of selecting a
consultant to design these improvements.
Prosperity Farms Road was widened from 2-lanes, in the early 1990's, to a 5-lane section
from PGA Boulevard to Burns Road and to a 3-lane section from Burns Road to Northlake
Boulevard. The 5-lane section was not extended south of Bums Road at the request of North
Palm Beach, which sought to maintain and enhance the character of Prosperity Farms Road
through established residential neighborhoods within the Village, while allowing for remaining
development and redevelopment activities. In order to achieve this objective, the Village has
requested that Pahn Beach County assign a Constrained Road At A Lower Level Of Service
(GRACES) designation to the segment of Prosperity Farms Road between Northlake Boulevard
and Burns Road under the provisions of Chapter 163.3180(10), Florida Statutes, and Section
15.(I) K of the Palm Beach County Unified Land Development Code (ULDC).
A proposed amendment to the Palm Beach County Comprehensive Plan, implementing
the proposed GRACES designation, is currently being processed by the Florida Department of
Community Affairs (FDCA). FDCA staff has, as well, recommended that the Village of North
Palm Beach amend its comprehensive plan to include the GRACES designation.
In addition to the GRACES designation of the subject segment of Prosperity Farms Road,
the proposed amendment includes a policy to establish criteria for the timing of the widening of
this roadway segment. The proposed policy will further protect the residential character of
Prosperity Farms Road by precluding further widening until the designated GRACES volumes
have been reached, and other designated parallel roadways in the vicinity are operating at
unacceptable levels of service.
B. INTENT AND SUMMARY OF NPBCP AMENDMENT 02-1.3
The intent of proposed NPBCP Amendment 02-1.3 is to: (1) Designate Prosperity Farms
Road from Northlake Boulevard to Burns Road as a GRACES facility; and (2) add a policy to
establish criteria for timing of the widening of the designated segment. The policy identifies
levels of service which must be reached on other roadway segments in the vicinity prior to any
expansion of the designated segment of Prosperity Farms Road.

Complete data and analysis to support proposed NPBCP Amendment 02-1.3 is provided
in Section C. The existing (2000) average daily traffic volume on Prosperity Farms Road
is 17,655 vehicles per day which exceeds the Level of Service D threshold volumes established
by Palm Beach County, and is rapidly approaching the threshold volume established in the
Village of North Palm Beach Comprehensive Plan.
The following is a summary of the issues associated with proposed NPBCP Amendment 02-1.3:
• By Yeaz 2015, the average daily traffic volume on Prosperity Farms Road is projected
to reach 20,950 vehicles per day
• The proposed GRACES will help preserve the residential character of the neighborhood.
• Prosperity Farms Road, between Northlake Boulevard and Burns Road, is shown on
the 2020 Map as a 4-lane roadway and on the Thoroughfare Right-Of--Way Identification
Map (TIM) as an 80 ft. right-of--way. Currently, it exists as a 3-lane facility. At this
time, widening of this segment is not funded.
• There are two existing roadways that provide north/south circulation in the vicinity of
Prosperity Farms Road; U.S. Highway No. 1 and Alternate A-1-A. Alternate A-1-A is
expected to be widened by year 2020.
C. DETAILED SUPPORT DATA AND ANALYSIS
1. GRACES Designation
Article 15 of the Palm Beach County ULDC specifies the following eleven determination
criteria that must be addressed when considering a change to the adopted level of service
standards on any roadway.
a. Cause of the constraint; e.g., Whether the laneage or
geometries are insufficient to accommodate projected traffic as a result of
concerns relating to physical limitations, fiscal limitations, environmental
areas, aesthetics, historically significant development, or the character-of-
area, or neighborhood concerns, and the impact of adding lanes or changing
the geometries on such concerns.
Response: It is the desire of theVillage of North Palm Beach to maintain and
enhance the current character of the Prosperity Farms Road corridor through the
established residential neighborhoods within North Palm Beach. When Prosperity
Farms Road was widened from 2-lanes in the early 1990's, the segment from PGA
Boulevard to Burns Road was widened to a 5-lane section and the segment from
Northlake Boulevard to Burns Road was widened to a 3-lane section. The 5-lane
section was not constructed south of Burns Road at the request of the Village of
North Palm Beach.

Prosperity Farms Road from Northlake Boulevazd to Burns Road is
currently a 3-lane section On the east side of Prosperity Farms Road,
there are eight intersecting roadways. Of these, Lighthouse Drive is a
collector roadway. The remaining 7 are local streets. These streets
principally provide access to single family homes on medium size lots.
There are 47 homes on the east side of Prosperity Farms Road that have
access only to Prosperity Farms Road. Homes on corner lots have access
to cross streets as well.
On the west side of Prosperity Farms Road, there are 14
intersecting roadways. Again, Lighthouse Drive is the only collector
roadway. The remaining 13 are local streets. These streets provide access
principally to single family homes on medium size lots. There are no
homes on the west side of Prosperity Farms Road that have access only to
Prosperity Farms Road. Homes on corner lots have access to both
Prosperity Farms Road and the cross streets.
There are a few small businesses along Prosperity Farms Road,
generally consisting of retail and office uses. Civic uses along the road
include churches, a park, and a day care center.
With primarily homes in close proximity to the roadway, the
character of the neighborhood becomes a constraint to widening the
Prosperity Farms Road.
b. When more than one cause is identified, the extent to which
each contributes to the constraint shall be considered.
Response: The character of the neighborhood is the primary cause of the
constraint to Prosperity Farms Road.
c. Existence of, or proposed, "reliever" facilities and the
proximity and continuity of such, and the extent to which they
presently, or are projected to, relieve the Constrained Link.
Response: Alternate A-1-A (SR 811) and U. S. Highway No. 1 are the
two potential reliever roadways that run parallel to Prosperity Farms Road.
Alternate A-1-A is presently a 4-lane roadway. The traffic
volumes range between 21,989 north of Northlake Boulevard to 20,955

south of Burns Road. Alternate AlA is proposed to be widened to a 6-
lane section in the 2020 Plan. However, based upon existing travel
patterns and the fact that the present traffic volumes on Alternate AlA are
less than 70% of capacity, widening Alternate AlA is not anticipated to
divert significant traffic from Prosperity Farms Road.
U.S. Highway No. 1 is presently a 6-lane roadway north of
Northlake Boulevard and a 4-lane roadway south of PGA Boulevard. The
traffic volumes range between 30,570 north of Northlake Boulevard to
23,956 south of PGA Boulevard. U. S. Highway No. 1 is not proposed to
be widened in the 2020 Plan. However, based upon existing travel
patterns and the fact that the present traffic volumes are less than 75% of
capacity, U. S. Highway No. l is not anticipated to divert significant traffic
from Prosperity Farms Road.
d. The existing and projected volume-to-capacity ratios
given the adopted Future Land Use Elements of Local Governments'
Comprehensive Plans.
Response: The table below shows the existing traffic volumes on
Prosperity Farms Road, and the build-out situation, including traffic
volumes from all proposed developments.

Volume to capacity ratios calculated in the above table are derived
using the traffic volumes associated with Palm Beach County's level-of-
service standards.
e. The extent of vested Development Orders, and non-vested land
use, zoning designations, or Development Orders.
Response: Most of the land adjacent to Prosperity Farms Road is
developed. The two exceptions are parcels of land on the east side of
Prosperity Farms Road. The parcels, which also front the Intracoastal in
the vicinity of Burns Road, are currently being developed as gated
residential communities (i.e. known as Prosperity Harbor and Harbor
Isles). The predominant development pattern is low density residential.
Other projects that may have a measurable impact on Prosperity
Farms Road include the following:
- The former Twin City Mall: This project is located on the
southwest corner of Northlake Boulevard and U. S. Highway No. 1. The
previous mall use has been razed and is being redeveloped with retail uses,
including a Publix grocery store. It is a vested project.
- WCI Properties, Inc. (WCI) parcels in Lake Park and Palm
Beach Gardens: WCI owns a large tract of land on both sides of Congress
Avenue, south of Northlake Boulevard. The property in Palm Beach
Gardens is being developed with several retail projects. Some of these
projects have received Traffic Performance Standards approvals. The
balance of the property is located In Lake Park. The Town wants this

property to be developed in Traditional Neighborhood Development
(TND) fashion. Any residential component would be exempt from Traffic
Performance Standards due to the Coastal Residential Exception.
_ f. The impact on the ability of local governments to allow
development consistent with their comprehensive plans, and the inter-
jurisdictional compatibility of the various local government
comprehensive plans as related to the constrained facility.
Response: If Prosperity Farms Road is not widened, and a GRACES is not
adopted, any project with a significant impact on Prosperity Farms Road
will not be able to receive a development order. However, it is unlikely
that any of the vacant land in the area will have a significant impact on
Prosperity Farms Road.
g. The practicality of adjusting land uses, zoning districts, and
uses therein.
Response: There are a few vacant parcels in the immediate vicinity of
Prosperity Farms Road that do not have development approvals. No
properties have been identified where it would be practical to adjust land
uses.
h. The impact of the ability of the overall major thoroughfare
system in the area affected to function at the generally adopted level
of service.
Response: Based on the latest 2020 Plan prepared by the Metropolitan
Planning Organization (MPO), both Florida Intrastate Highway System
(FIRS) facilities, I-95 and the Turnpike are projected to operate at adopted
level of service by year 2020. However, any project impacting I-95 will
be required to address its impacts consistent with the Palm Beach County
Traffic Performance Standards.
Based on the analysis provided in Tables 1 - 3, several non-FIRS
roadways including Alternate A-1-A and U.S. Highway No. 1 are also
projected to operate below adopted level of service in year 2020. These
roadways are major thoroughfares for which Palm Beach County shall
establish an adequate level of service standard that need not be consistent
with any level of service standard established by the Department of
Transportation, pursuant to Chapter 163.3180 (10), Florida Statutes. Any
proposed development must meet the adopted level of service or mitigate
its impacts pursuant to Palm Beach County Traffic Performance
Standards.
Regarding other mitigation measures, pursuant to Palm Beach
County Transportation Element Policies 1.3-b and 1.3-c, the County will

continue to implement Transportation System Management (TSM)
strategies.
i. The length of the Constrained Link(s).
Response: Prosperity Farms Road from Northlake Boulevard to Burns
Road is 1.5 miles long.
j. The option of modifying the Plan, including the Thoroughfare
Right-of--way Identification Map, or other regulations to add lanes,
improve geometrics or reliever facilities.
Response: There are no known options of modifying the Plan, including
the Thoroughfare Right-of--Way Identification Map.
k. Whether modifications can be made that would add capacity,
and how much capacity would be added.
Response: Other than allowing Prosperity Farms Road to be widened,
there are no modifications that can be made that would add capacity.
2. Timing Criteria
Consistent with expressed community desires, this amendment will delay the widening of
Prosperity Farms Road beyond a 3-lane section until parallel segments of Alternate A-1-A are
widened and until Alternate A-1-A or U.S. Highway No.l fail to operate at adopted level of
service. In this manner, any needed widening beyond 3-lanes could be programmed and the road
network could be monitored to ensure that the additional capacity which could alter the character
of the area is not provided prematurely. Delaying widening of the Prosperity Farms road,
however, will result in higher volume over capacity (v/c) ratios (greater than 1.0) on some
roadway segments in the area by year 2020, as reflected in the Tables 1 - 3 This will have a
negative impact in future, on the area residents in terms of more congested roadways.
D. ASSESSMENT AND CONCLUSIONS
Based on the Data and Analysis, the following assessments and conclusions can be made:
1. The existing traffic volume on the subject section of Prosperity Farms Road
has already exceeded the adopted level of service threshold used by Palm Beach County,
and is approaching the threshold used by North Palm Beach. The traffic volume on this
section is projected to exceed the Level of Service D thresholds used by both Palm Beach
County and North Palm Beach. A GRACES designation would allow Prosperity Farms
Road to remain at three lanes, protecting the residential character of area, while allowing
development and redevelopment activities in the area.

2. Ideally, there will be a balance between the roadway system and land uses that
it is planned to service. However, there are some roadways, where countervailing local
government goals may suggest not expanding certain roadways. GRACES is a tool
available to permit development in affected areas consistent with Plan goals and
objectives.
3.The proposed Transportation Element Policy 1.4 will establish specific levels
of service or other thresholds which must be reached on segments of other roadways in
the area before Prosperity Farms Road could be expanded to 4 or 5 lanes. In this manner,
any needed widening beyond three lanes could be programmed and the road network
monitored to ensure that the additional capacity which may alter the character of the area
is not provided prematurely.

E. CONSISTENCY WITH REGIONAL AND STATE PLANS
According to Chapter 9J-5.021, Florida Administrative Code (FAC), the comprehensive
~" plan must be consistent with the State Comprehensive Plan and Treasure Coast Regional
Planning Council Policy Plan. Chapter 9J-5.021(2), FAC states ".....for the purposes of
determining consistency of the local plan with the State Comprehensive Plan or appropriate
regional policy plan the state or regional plan shall be construed as a whole and no specific goal
and policy shall be construed or applied in isolation from the other goals and policies."
1. Regional Policy Plan
NPBCP Amendment 02-1.3 was reviewed in terms of the Treasure Coast Regional
Planning Council Regional Policy Plan in order to determine consistency. Based on this review,
it is determined that no significant regional issues are related to, or impacted by NPBCP
Amendment 02-1.3, and it is found consistent with regional goals and policies.
2. State Comprehensive Plan
NPBCP Amendment 02-1.3 was reviewed in terms of the goals, objectives and policies
of the State Comprehensive Plan, as presented in Chapter 187, k'lorida Statutes. Based upon this
review, it is concluded that NPBCP Amendment 02-1.3 is found consistent with state goals,
objectives and policies.

F. CONCLUSION
The following recommendations are presented:
1. Finding
NPBCP Amendment 02-1.3 is consistent with the provisions of the Village of North
Palm Beach Comprehensive Plan. More specifically, NPBCP Amendment 02-1.3 is consistent
with the Village of North Palm Beach desire to maintain the existing 3-lane section of Prosperity
Farms, and Policy 5.3 of the Capital Improvements Element in that it does not contribute to a
condition of public hazard, as defined therein, does not exacerbate any existing condition of
public facility capacity deficits, as described therein, and is compatible with land uses, as shown
on the Future Land Use Map Series.
2. Recommendation
Staff recommends that the Village Council approve NPBCP Amendment 02-1.3 .
3. LPA Public Hearing
An advertised public hearing on NPBCP Amendment 02-1.3 was held at 7:00 P.M. on
December 4, 2001 in the Village Hall. Manny Grinn, a resident of the Village spoke at the
public hearing.
4. LPA Meeting
The LPA (Planning Commission) considered NPBCP Amendment 02-1.3 at its regular
meeting on December 4, 2001. A motion was made, and unanimously supported, to recommend
approval ofNPBCP Amendment 02-1.3 by the Village Council.

NPBCP Amendment 02-1.3 consists of TRANSPORTATION ELEMEN'T' text and map
amendments to assign a Constrained Road At A Lower Level Of Service (GRACES) designation
to the segment of Prosperity Farms Road, located between Northlake Boulevard and Burns Road.
NPBCP Amendment 02-1.3 is accomplished by the following revisions to the
TRANSPORTATION ELEMENT:
1. Amendment to Policy 1.2;
2. Addition of new Policies 1.3 and 1,4;
3. Renumbering of the current Policy 1.4 to 1.5;
4. Revisions to Tables 4-1 and 4.2; and

All of the above improvements are scheduled for implementation by Palm Beach County
in the FY 2000 - 2004 Five-Year Transportation Improvement Program.
Policy 1.1: Village roadways shall be functionally grouped based upon the
number of traffic signals per mile as follows:
a. Group A- County Road A-1-A;
b. Group B -Prosperity Farms Road;
c. Group C - U.S. Highway No. 1, Old Dixie Highway (State Road Alternate A-1-
A), and Northlake Boulevard; and
d. Village Collector -Lighthouse Drive.
The building official may require traffic impact analysis prepared pursuant to the Village
concurrency management ordinance to account for adjustments to the functional group
classification of a particular roadway necessitated by the placement of additional traffic signals
along classified roadways. If said adjustments result in a functional group other than A, B, or C,
then the level of service analysis shall be based upon the 1988 Florida Highway System Plan
Level-of-Service Standards and Guidelines Manual.
Polic,~l 2: The Village hereby adopts and maintains Average Annual Daily/Peak
Hour LOS Standards, consistent with the Florida Department of Transportation minimum
acceptable operating levels of service standards, for each of the following listed roadways:
a. County Road A-1-A - D/D;
b. Prosperity Farms Road. north of Burns Road - D/D;
c. Highway No. 1 and Northlake Boulevard - D/D;
d. Lighthouse Drive - D/D; and
e. Old Dixie Highway (State Road Alternate A-1-A) - D/D.
The evaluation of current and proposed levels of service on functionally grouped
roadways shall be based upon Level-of-Service D traffic volumes in Tables 4-1 and 4-2. Further,
should the level of service on County Road A-1-A fall below D1D, the Village shall pursue
"Constrained Facility" designation thereon.
Policy 1.3: The Village of North Palm Beach finds the following is a constrained
and 4-2:

a. Prospgrity Farms Road. between Northlake Boulevard and Burns Road is
hereby designated as a Constrained Roadway at a Lower Level of Service
(CRALLSI facility. Its level of service shall be' 20,950 trips on a daily basis' and
1,948 trips on a peak hour basis
. Further, in order to maintain the residential
character of the Village, all roadways not identified in Policy 1. l shall be maintained as two-lane
local roadways.
Policy 1.4: Before Prosperity Farms Road between Northlake Boulevard and
Burns Road may be constructed as a 4 or 5 lane facility
a. The GRACES volumes on this segment shall be reached• and
b. The parallel segment of Alternate AlA shall be a 6-lane facility and shall
operate below its adopted level-of-service: or
c. The parallel segment of U.S. Highway No. 1 shall operate below its adopted
level-of-service.
Polio: The Village shall annually evaluate the need for roadway
improvements to: (1) maintain level-of-service standards; and (2) to implement measures to
reduce accident frequency.
OBJECTIVE 2: Projected transportation system needs through the year 2010 will be
met by implementing the following projects (Reserved for future transportation system
improvements, as needed):
1. Reserved.
Further, the Village shall maintain its annual program of resurfacing local streets.
Policy 2.1: The Village shall enforce traffic performance standards by
incorporating level-of-service (LOS) standards within the North Palm Beach Land Development
Regulations consistent with Policy 5.2 of the CAPITAL IlvIPROVEMENTS element.
Policy 2.2: The Village shall review all proposed development for consistency
with Policy 2.1 and coordinate with the agencies responsible for implementing road
improvements to assure that roadways are in compliance with the LOS standards.
Policy 2.3: The Village shall request that Palm Beach County evaluate the
effects of the improvements to SR AlA (Alt.) on traffic volumes on Prosperity Farms Road by
the year 2000.
OBJECTIVE 3: The provision of motorized and non-motorized vehicle parking and the
provision of bicycle and pedestrian ways will be regulated.
