A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH,
FLORIDA. AUTHORIZING THE MAYOR AND VILLAGE CLERK TO ENTER INTO AN
AGREEMENT WITH RANGER CONSTRUCTION INDUSTRIES, INC., ATTACHED AS EXHIBIT
"A", WHICH AGREEMENT PROVIDES MITIGATION TO THE VILLAGE IN THE FORM OF
COMPENSATION FOR THE VILLAGE ALLOWING A SIGNAL MAST ARM THAT
ENCROACHES ON VILLAGE PROPERTY TO REMAIN; AND, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Ranger Construction Industries, Inc., installed a signal mast arm for the Florida
Department of Transportation at the general location of 501 U.S. Highway One, North Palm Beach,
Florida, which mast arm was installed outside of the Department of Transportation right-of--way and
encroaches upon Village property; and
WHEREAS, Ranger Construction Industries, Inc., has requested that the Village allow the mast arm to
remain at its present location and is willing to provide mitigation to the Village in the form of
compensation in the amount of Five Thousand ($5,000.00) Dollars; and
WHEREAS, the Village Council of the Village of North Palm Beach is agreeable to the mast arm
remaining upon Village property for the compensation set forth herein and upon the terms and
provisions set forth in Exhibit "A"'.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby approve
the agreement with Ranger Construction Industries, Inc., attached as Exhibit "A", which agreement
provides for the allowance of a mast arm to encroach upon Village property in return for mitigation to
be paid to the Village in amount of Five Thousand ($5,000.00) Dollars.
Section 2. The Mayor and Village Clerk are hereby authorized and directed to execute the
agreement set forth in Exhibit "A" for and on behalf of the Village of North Palm Beach.
Section 3. This resolution shall take effect immediately upon its adoption.

Project Name: US-1 from Silver Beach Rd. North to Parker Bridge
In an effort to conform to our contract requirement and obligation with Florida Department of
Transportation, Ranger Construction Industries, Inc. is pursuing the option of mitigating
impacts to the Department, property owners and the local traffic along US-1.
This letter serves to memorialize our discussions and understanding of November 13, 2003. It
is hereby expressly agreed that Ranger Construction Industries, Inc. has encroached onto
your property known as Village of North Palm Beach ,located at S01 US Highway 1 North
Palm Beach Fl. 33408-4901 with the signal mast arm assembly to no apparent detriment or
burden on the use of the land as presently zoned. The encroachment in question is a result of
conflict with existing utilities. The encroachment is as indicated on attachment A:
The Village of North Palm Beach agrees to permit Ranger Construction Industries, Inc. to
leave the encroachment onto your property for the sum off $5,000.00. The Village of North
Palm Beach further agrees to eventually donate this right to leave the signal assembly to the
FDOT for a possible future easement at no additional cost to any of the parties described
herein.
Furthermore, as part of this agreement, Ranger Construction Industries, Inc. agrees to restore
any portion of the property damaged as a direct result of the aforementioned construction
project at no cost to the property owner.
The parties understand that this agreement finalizes disposition of the encroached structure
and serves as waiver to require future relocation of said structure.
