2004-027 Perpetual Easement to FL DOTRESOLUTION 27-2004
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE
AND DELIVER A PERPETUAL EASEMENT TO STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION (DOT), WHICH EASEMENT IS ATTACHED AS EXHIBIT "A" AND
IS FOR THE PURPOSE OF GRANTING TO DOT THE RIGHT TO CONSTRUCT AND
MAINTAIN A MAST ARM AND CONTROL BOX ON THE LAND DESCRIBED IN SAID
EASEMENT; AND, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the State of Florida Department of Transportation proposes to construct or improve
State Road No. 5 (U.S. Highway No. 1), Item/Segment No. 2297471, Section No. 93040-2510,
in Palm Beach County, Florida; and
WHEREAS, it is necessary that an easement across certain lands now owned by the Village of
North Palm Beach, Florida, be acquired by the State of Florida Department of Transportation; and
WHEREAS, said use is in the best interest of the Village; and
WHEREAS, the State of Florida Department of Transportation has made application to the
Village to execute and deliver to the State of Florida Department of Transportation a perpetual
Easement in favor of the State of Florida Department of Transportation for the purpose of
constructing and maintaining a mast arm and control box.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby
approve the perpetual easement to State of Florida Department of Transportation (DOT) attached
as Exhibit "A," which easement is for the purpose of granting to DOT the right to construct and
maintain a mast arm and control box on the land described in said easement.
Section 2. The Mayor and Village Clerk are hereby authorized and directed to execute the
perpetual easement to State of Florida Department of Transportation set forth in Exhibit "A" for
• and on behalf of the Village of North Palm Beach.
Section 3. The Village Clerk is hereby directed to furnish a certified copy of this resolution
• to the State of Florida Department of Transportation at 3400 W. Commercial Boulevard, Fort
Lauderdale, Florida 33309.
Section 4. This resolution shall take effect immediately upon its adoption.
