ROLL CALL
Mayor Norris called the meeting to order at 9:45 p.m. All members of Council were present.
All members of staff were present.
BUTTONWOOD ROAD DRAINAGE PROJECT
Public Works Director Wiley Livingston reviewed the status of the FEMA grant. Mr. Livingston
advised that although FEMA has been provided all information necessary for Phase 1 (design,
• survey, and permitting) the Village is still waiting for FEMA to appropriate the funds in order to
begin Phase 2, construction of the project. Discussion ensued on piggybacking on a Palm Beach
County contract. Mr. Livingston reported the receipt of an updated quote in the amount of
$146,700 from contractor D.S. Eakins, and noted an additional $24,000 is needed for Village
staff to clear vegetation, remove fencing and irrigation in the easement area, and re-sod.
Ray Olavarria, 832 Buttonwood Road, distributed photos ofthe flooding problem.
Council consensus was to place this on the next Regular Session agenda, and to send letters to
our congressmen to find out why this grant has been delayed.
PUBLIC SAFETY NORTH SUBSTATION ENGINEERING DESIGN PLANS
Architect Stephen Boruff and Francis Lussier reviewed engineering design plans for the Public
Safety North Substation.
Discussion ensued on the pros and cons of concrete the roofing versus standing seam metal
roofing. Council consensus was in favor of a metal roof.
Brief discussion took place concerning the traffic signal. Community Development Director
Charles Cangianelli advised that SFRN, the Village Engineer, will start the permitting process
when funding is approved. Mr. Cangianelli reported that costs for this are estimated at $200,000,
• including permitting, the traffic signal, and the turning lanes. Mr. Cangianelli advised that the
traffic signal is optional.

• REZONING REQUEST - 872 U.S. HIGHWAY 1
Attorney Gary Brandenburg was present on behalf of the owners to request that a parcel of land
located at 872 U.S. Highway 1 (formerly Tokyo Gardens Restaurant) be rezoned from C-A
Commercial District to C-lA Limited Commercial District.
Discussion ensued on the zoning designations of adjacent parcels. Community Development
Director Charlie Cangianelli reported that the properties immediately to the north and south are
zoned C-A Commercial District, and the next parcel south, formerly Roadhouse Grill is zoned
C-lA Limited Commercial District. It was noted that the C-lA Limited Commercial District
zoning designation allows mixed-use residential under certain conditions.
Village Planning Consultant Jim Fleischmann reported that there is only one commercial future
land use designation in the Comprehensive Plan, and all zoning districts are deemed to be
consistent with that future land use designation. Mr. Fleischmann advised that neither the zoning
code nor the Comprehensive Plan have any zoning criteria to identify what constitutes a proper
or improper commercial zoning district under the commercial land use designation.
Mr. Fleischmann reminded the Council that the Evaluation and Appraisal Report contained a
recommendation that a U.S. Highway 1 corridor study be conducted in order to provide guidance
in identifying where mixed use is appropriate.
Discussion was held concerning authorizing a study of U.S. Highway 1 with regard to mixed-
use, and adopting azoning-in-progress resolution until the study is completed.
Council consensus was to forward both items to the next Regular Session agenda to consider
authorization of a U.S. Highway 1 planning study, aswell as azoning-in-progress resolution if
necessary.
VOLUNTARY ANNEXATION REQUEST - 9458 ALTERNATE AlA AND 2895 RICHARD ROAD
Discussion ensued on annexation of the Alternate AlA road right-of--way wherever the Village
controls both sides of the road. Mr. Fleischmann advised that annexation of the road right-of-
way is only possible in front of the former U-Haul and Ed Morse Honda properties, an area of
about 400 - 500 feet.
This item will be placed on the next Regular Session agenda.
