Mayor Eissey called the Public Hearing to order at 6:40 p.m. All members of the Council were
present. All members of staff were present.
I'URF'OSE OF THE PUBLIC HEARING
The purpose of the Public Hearing was to hear comments from the public on Bill 1076, a
proposed ordinance creating a Commercial Planned Unit Development (CPUD) for a mixed use
redevelopment project upon those certain lands consisting of 3.10 acres, more or less, located at
401 Northlake Boulevard within the Village and more particularly described in Exhibits "A" and
"13" attached; providing for a landscape plan with automatic irrigation; providing that all
infrastructure improvements shall be private and maintained by the fee simple owner; providing
for review and approval of deed restrictions by the Village Attorney prior to recordation in the
public records; setting fort requirements to be met by the Petitioner prior to issuance of the initial
building permit; providing for time of commencement and time of completion for the CPUD;
providing for approval of temporary signage by the Village Planning Commission; and providing
procedure for modifications to the CPUD.
COMMENTS PROM 1'HE PUBLIC
"1'he following persons addressed the Council with their concerns and/or opposition to the
establishing of a Commercial Planned Unit Development (CPUD) at 401 Northlake Blvd.:
I3ob Rowe, 837 Fathom Road, addressed his concerns to the Council and asked questions of
Collene Walter of Kilday and Associates regarding the type of drains that will be used, how
many units will be limited access, how many will be air-conditioned, and whether or not there
• will be restrictions on retail businesses that might rent out space. Further, he asked about the

• member of restrooms provided, the donation of the easement to the South Florida Water
Management District, retention of water on the property, and illumination of the property.
Ms. Walter responded that the drains that will be used are similar to French99 drains, and that all
units will have limited access and air-conditioning. She further stated that restrictions on retail
have not been determined at this time, and that the required number of restrooms will be
provided, per the building code. When asked about a retention pond, Ms. Walters stated that she
did not know whether 100% of the water will be retained on the property, but she would get the
answer from the Project Engineer and relay it to Mr. Rowe.
Manny Grittn, 536 Greenway Drive, told the Council that a Commercial Planned Unit
Development (CPUD) is not needed, and that it can be built just as presented under the regular
zoning code. Mr. Grimt stated that the PUD ordinance allows "minor modifications", which he
said have been interpreted in the past as "minor" but were actually "major.
llonna Kramer, 716 Lighthouse Drive, asked the Council if this project could eventually turn
into a boat storage yard, and could it also have retail in the front such as parts and marine
mechanics working on boats with forklifts running and putting boats in and out of the water. Ms.
Walter replied that boat storage is currently allowed in the C-lA zoning district, and boat storage
could be put in that spot tomorrow if they wanted, but that is not shown in the plans for this
project.
