04-11-2002 VC REG-M• MINUTES OF THE REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, APRIL 11, 2002 Present: Dr. Edward M. Eissey, Mayor Don Noel, Vice Mayor Joseph A. Tringali, President Pro Tem Charles R. O'Meilia, Councilman David B. Norris, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, CMC, Village Clerk ROLL CALL Mayor Eissey called the meeting to order at 7:30 p.m. All members of the Council were present. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Councilman Norris gave the invocation, and Councilman O'Meilia led the public in the Pledge of Allegiance to the Flag. 7'I~e following Minutes were approved as written: Minutes of Regular Session held 3/28/02 REPORT OF THE MAYOR Mayor Eissey proclaimed the month of May as Civility Month in the Village of North Palm Beach S"1'ATEMENTS FROM THE PUBLIC hr response to Chester Brewer's statement to the Council regarding recent burglaries in the Village, Public Safety Director Duke Johnson announced that a neighborhood meeting would be held on Tuesday, April 16, 2002 at 7:00 p.m. in the Public Safety Building to discuss the matter. • CONSENT AGENDA APPROVED Minutes of Regular Session Held April 11, 2002 • Item 4.d. was removed from the Consent Agenda and placed under Item 9 of the Regular Agenda. Items 4.g. and 4.h. were removed from the Consent Agenda and postponed until the next Regular Session of April 25, 2002. Thereafter, Vice Mayor Noel moved to accept the Consent Agenda, as amended. Councilman Norris seconded the motion, and all present voted aye. The following items were approved: a. Accepted for file the Minutes of the Country Club Advisory Board meeting held 3/4/02 b. Accepted for file the Minutes of the Planning Commission meeting held 3/5/02 c. Accepted for file the Minutes of the Zoning Board of Adjustment meeting held 3/19/02 d. Adopted Resolution 21-2002, in appreciation to Dr. Anthony Catanese for his service and leadership as President of Florida Atlantic University e. Adopted Resolution 22-2002, supporting the decision of the Board of County Commissioners of Palm Beach County to restore the historic 1916 Palm Beach County Courthouse f Adopted Resolution 23-2002 authorizing a Consent to Assignment to Employers Mutual, Inc. (EMI) for administration contract for services dated May 22, 1997 between the Village of North Palm Beach and McCreary Corporation, as Administrator. g. Adopted Resolution 24-2002 authorizing an agreement with Land Research Management, Inc. for the purpose of conducting an analysis of the proposed annexation areas of Lost Tree Village, Portage Landing and Hidden Key; and to determine ownership percentage of land in annexation areas owned by registered electors h. Approved a longevity pay increase of $7,500 for Captain George Warren of the Public Safety Department; funds to be expended from A5711-11210 (Regular I'ay) REPORTS OF SPECIAL COMMITTEES AND RECOMMENDATIONS OF ADVISORY BOARDS President Pro Tem Tringali moved to accept for file the recommendation of the Country Club Advisory Board that the "Village Council" keep the name of North Palm Beach Country Club and not change to North Palm Beach Yacht and Country Club as petitioned by the North Palm 13each Yacht Club". Councilman Norris seconded the motion, and all present voted aye. • Mort Levin reported on the status of the Beaches and Shores Council, and provided copies of 2 Minutes of Regular Session I leld April l 1, 2002 • "Guidelines for Proper Beach and Dune Management" put out by Palm Beach County Department of Environmental Resources Management. Councilman O'Meilia reported that the Palm Beach County League of Cities protested to the Palm Beach County Commission regarding the Exotic Plant ordinances, and the Commissioners have now put a hold on the Exotic Plant ordinances. Councilman O'Meilia also updated the Council regarding the Traffic Performance Standards Committee, stating that the County Commissioners have taken the Committee recommendations under advisement, and directed County staff to incorporate the recommendations of the north County Traffic Summit meeting held last year into their proposed comprehensive plan changes VILLAGE MANAGER'S REPORT Village Manager Dennis Kelly gave a status report on the April 13th Heritage Day parade, and the planned closing of the Village Hall for renovation. Further, Mr. Kelly reported that Steve Yohe will be starting on Monday, April 15, 2002 as Interim Public Services Director for a period of 60 days, while the application and screening process is being conducted. Discussion was also held regarding the north substation trailer. Coumcilman Norris reported that discussions are ongoing with the attorney representing the monastery for the purpose of reaching agreement on the configuration of the parcel that is being carsidered for the north substation permanent property. BILL 1059 - AMEND]NG PERMITTED TEMPORARY SIGNS -PLACED ON FIRST' RF,ADING Councilman Norris moved that Bill 1059, Option 2, entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEAC}I, FLORIDA, AMENDING SUBSECTION (D), RESTRICTIONS ON CONTEN"1' OF TEMPORARY SIGNS, OF SECTION 6-114, PERMITTED TEMPORARY SIGNS, OF ARTICLE V, SIGNS AND OUTDOOR DISPLAYS, OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE VILLAGE, TO PROVIDE THAT TEMPORARY SIGNS ADVERTISING TEMPORARY USES AS CARNIVALS, REVIVALS, SPORTING EVENTS, GARAGE' SALES, OR ANY PUBLIC, CHARITABLE, EDUCATIONAL OR RE[,IGIOUS EVENT OR FUNCTION MUST BE DISPLAYED NO MORE THAN THIRTY (30) DAYS YRIOK TO THE EVENT; PROVIDING FOR DISPLAY AND REMOVAL OF POL]TICAL S1GNS ADVERTISING EVENTS OR FUNCTIONS AND CAMPAIGN SIGNS; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PART'S OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE I3e placed on first reading and read by title alone. Councilman O'Meilia seconded the motion • During discussion the following changes were made: In the caption, 5th line from the bottom, the word "political" was deleted; 4th line from the bottom, the word "political" was inserted 3 Minutes of Regular Session Held April 1 ], 2002 • between "advertising" and "events". On page 2, Section d., second sentence: t}te word "political" was deleted. In line 5, the words "or function" was inserted after the "event". In the last sentence of Section d., the phrase "or issue being voted upon" was inserted after the word "off ice". Village Attorney George Baldwin was directed to research the Code of Ordinances regarding signs for garage sales. Thereafter, the motion passed 5-0. BILL 1060 -BUDGET AMENDMENT -LOCAL LAW ENFORCEMENT BLOCK GRANT - I'LACED ON FIRST READING Vice Mayor Noel moved that Bill 1060 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING 7'HE NORTfI PALM BEACH GENERAL FUND BUDGET FOR THE FISCAL YEAR 2001- 2002 TO APPROPRIATE FUNDS IN THE AMOUNT OF $11,163.00 FOR LAW ENFORCEMENT OVERTIME PAY OF WHICH $10,000 WILL BE RECEIVED FROM THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT LOCAL LAW ENFORCEMENT BLOCK GRANT FOR DRUG INTERDICTION Be placed on first reading and read by title alone.
