BI? li' RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby approve
the Amendment to Plat of Harbour Isles recorded in Plat Book 86, Pages 111 through 121, inclusive,
Public Records of Palm Beach County Florida, attached as Exhibit "A", which Amendment to Plat
subdivides all of Lot 104 into Lots 103 and 105 of Harbour Isles.
Section 2. 7'he Mayor and Village Clerk are hereby authorized and directed to execute the
Amendment to Plat with WCI Communities, Inc., and Fleet National Bank attached as Exhibit "A"
for and on behalf of the V illage of Norih Palm Beach.
Section 3. This resolution shall take effect upon the Amendment to Plat of Harbour Isles being
recorded in the Public Records of Palm Beach County, Florida.

THIS AMENDIv1~NT TO PLAT OF HARBOUR ISLES ("Amendment") is made
this //~' day of , 2002 by WCI COMMUNITIES, INC., a Delaware
corporation ("WCI"), who post office address is 24301 Wa]den Center Drive, Bonita
Springs, Florida 34134 and is joined in by THE VILLAGE OF NORTH PALM BEACH,
a Florida municipal corporation, ("Village"), whose post office address is 501 U.S.
Highway 1, North Palm Beach, Florida 33408 and FLEET NATIONAL BANK, formerly
knowm as BANKBOSTON, N.A., a national banking association, ("Fleet Bank"), as Agent,
whose post office address is 115 Perimeter Center Place, N.E., Suite 500, Atlanta, Georgia
30346.
RECITALS:
A. WCI is the owner of those certain lots described as Lot 103 Harbour Isles
("Lot 103"), Lot 104 Harbour Isles ("Lot 104) and Lot 105 Hazbour Isles ("Lot 105"),
pursuant to the Plat of Harbour Isles recorded in Plat Book 86, Pages 111 through 121, of
the Public Records of Palm Beach County, Florida (the `:Plat").
B. WCI desires to subdivide Lot 104.
C. WCI requests that portions of the Plat be amended by changing the
common boundary line between Lot 103 and Lot 104 and between Lot 104 and Lot 105,
as more fully depicted on the site plan attached hereto as Exhibit "A". In effect, this
amendment would remove a portion of Lot 104 and add that portion to the westerly
boundary of Lot 103 and would remove the balance of Lot 104 and add that portion to the
easterly boundary of Lot 105 as depicted on Exhibit "A". The portion of the property
being removed from Lot 104 and appended to Lot 103 is hereinafter referred to as the
("Additional Property Lot 103") and that portion of the property being removed from Lot
104 and appended to Lot 105 is hereinafter referred to as the ("Additional Property Lot
105").

D. Fleet National Bank is the holder of a mortgage on Lot 103, Lot 104 and
Lot ] OS.
NOW THEREFORE, WCI, the Village and Fleet Bank, in consideration of the
premises, covenants and provisions herein contained, hereby agree that the Plat shall be
amended in the following manner:

The above recitals are true and correct and are incorporated herein by this
2. The legal description of Lot ] 03 is hereby amended and replaced in its
entirety with that certain legal description set forth on Exhibit "B" attached hereto and
made a part hereof.
3. The legal description of Lot 105 is hereby amended and replaced in its
entirety with that certain legal description set forth on Exhibit "C" attached hereto and
made a part hereof.
4. Lot 103 and the Additional Property Lot 103 shall be deemed to be unified
and shall be henceforth considered as one lot or pazcel of land and shall not be sold,
assigned, transferred, conveyed or devised separately, except in its entirety as one lot or
parcel of land.
5. Lot l OS and the Additional Property Lot 105 shall be deemed to be unified
and shall be henceforth considered as one lot or parcel of land and shall not be sold,
assigned, transferred, conveyed or devised separately, except in its entirety as one lot or
parcel of land.
6. Lot 104 shall cease to exist.
7. WCI, the Village and Fleet Bank by executing this Amendment hereby
signify their consent to all matters setforth herein, including the relocation of the boundary
lines and revisions to the legal descriptions of Lot 103 and Lot IOS.
8. The Village acknowledges that the relocation of the boundary lines does
not violate any municipal ordinances, rules or other requirements. The Village further
acknowledges that it is not requiring that WCI replat the affected lots in order to
accomplish the matters set forth herein, that any such requirement for replatting is
deemed waived, and that this Amendment, upon the recording of same in the Public
Records of Palm Beach County, Florida shall be effective in amending the Plat.
