• A RI;SOLU'fION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, Fl.OR1DA, COMMITTING ITS PORTION OF FUNDS ALLOCATED PURSUANT TO
RI?SOLUTION R-2002-0192 ADOPTED BY THE PALM BEACH COUNTY BOARD OF
COUNTY COMMISS]ONERS ON FEBRUARY 5, 2002, IN ACCORDANCE WITH SEC770N
318.21(]0), FLORIDA STATUTES, TO THE MUNICIPAL PUBLIC SAFETY
COMMUNICATIONS CONSORTIUM COMMUNICATIONS PROJECT; AND, PROVIDING
FOR AN EFFECTIVE DATE.
WI II;RI;AS, Section 163.01 of the Florida Statutes, known as the Florida Interlocal Cooperation Act
of 1969, authorizes local governmental units to make the most efficient use of their powers by
enabling them to cooperate with other localities on a basis of mutual advantage and thereby to
provide services and facilities in a manner and pursuant to forms of governmental organization that
will accord best with geographic, economic, population and other factors influencing the needs and
development of local communities; and
WHEREAS, it has been determined that the implementation of an interoperable Countywide
mm~icipal public safety communications system will allow municipal public safety agencies to
improve their provision of public safety services by virtue of enhanced inter-agency communications
and cooperation; and
WIIF.REAS, the Municipal Public Safety Communications Consortium (MPSCC) was formed
through the cooperative efforts of the various municipalities to plan and implement an interoperable
Countywide municipal public safety radio communications system; and
W}IIiREAS, the Village of North Palm Beach has joined 21 other municipalities located within Palm
Beach County to form the MPSCC, and the Village of North Palm Beach has long been involved
with efforts to improve public safety communications; and
WI IEREAS, the MPSCC, through the diligent efforts of its member municipalities, has developed
a plan for a municipal countywide interoperable communications system; and
• WHI;RI;AS, the MPSCC communications plan has been approved by the State of Florida office of
Technology as required by Florida Statute 282.111(5); and
Wlll?RIsAS, Section 318.21(10), Florida Statutes, permits any county which participates in an
• intergovernmental radio communications program approved by the State of Florida Department of
Management Services to use $12.50 from each moving traffic violation to fund that county's
participation in the program; and
WI II:KF,AS, a portion of the revenues collected are from violations which are written by municipal
law enforcement officers within the municipal limits; and
W I I I:RI;AS, the Board of County Commissioners allocated a portion of the revenues generated by
municipalities for their benefit under Resolution R99-2343D as amended on February 5, 2002, by
Resolution K-2002-0192 to encourage the interoperability of municipal communications systems
and therefore enhancing the County's Intergovernmental Communications Plan; and
R'lllsREAS, the member municipalities of the MPSCC desire to move forward with the
construction of a supplement and enhancement to the County's interoperable countywide
radio network subject to the final approval of the capital budget provided in Section 12 of the
MPSCC hiterlocal Agreement.
BF. 1T RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1:
1. The Village of North Palm Beach (`Village") is a member of the Municipal Public Safety
Communications Consortium (MPSCC) and supports its public safety communications plan.
2. The Village supports the inclusion of the MPSCC communications plan as an enhancement and part
of the State approved Palm Beach County Intergovernmental Radio Communications Program plan.
3. 7'he Village commits its full share of the $12.50 traffic fine revenues as allocated by the County
through Resolution R-2002-0192 to the MPSCC for construction and implementation of its radio
network for a period often years from the date of contract with the radio vendor.
4. This resolution shall become void if the Village should exercise its right to withdraw from the
• MPSCC as provided in Section ] 2 of the MPSCC Interlocal Agreement within the prescribed time
frame following the receipt of the capital budget.

5. The Village requests that the County provide its portion of the $12.50 traffic fine monies to the
• MI'SCC for construction of the radio system following the procedures set forth in BCC Resolution
R-2002-0192.
Section 2. This resolution shall take effect immediately upon its adoption.
