2005-038 PFR Construction Monitoring Agrmnt with Miller LeggRESOLUTION 38-2005 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE. CLERK TO ENTER INTO AN AGREEMENT FOR CONSTRUCTION MONITORING SERVICES WITH MILLER LEGG ASSOCIATES, INC. ATTACHED AS EXHIBIT "A", WHICH AGREEMENT PROVIDES THE VILLAGE WITH CONSTRUCTION MONITORING SERVICES FOR THE PROSPERITY FARMS ROAD BEAUTIFICATION PROJECT FROM NORTHLAKE BOULEVARD TO BURNS ROAD; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby approve the attached Agreement for Construction Monitoring Services with Miller Legg Associates, Inc. Attached as Exhibit "A", which Agreement provides the Village with Construction Monitoring Services for the Prosperity Farms Road Beautification Project from Northlake Boulevard to Burns Road. Section 2. The Mayor and Village Clerk are hereby authorized and directed to execute the Agreement for Construction Monitoring Services as set forth in Exhibit "A" for and on behalf of the Village of North Palm Beach. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND ADOPTED THIS 28th DAY OF APRIL, 2005. ATTE,"~ x ~i~~~' VILLAGE CLERK THIS AGREEMENT FOR CONSTRUCTION MONITORING SERVICES is made and entered into this ~ day of ~~~ , 2005, by and between VILLAGE OF NORTH PALM BEACH, a municipal corporation, hereinafter referred to as "VILLAGE" and MILLER LEGG ASSOCIATES, INC., hereinafter referred to as "MILLER LEGG." WITNESSETH: WHEREAS, the VILLAGE has awarded a bid for construction of roadway improvements for the Prosperity Farms Road Beautification Project from Northlake Boulevard to Burns Road and is desirous of securing a firm to provide Village with construction monitoring services; and WHEREAS, the VILLAGE and MILLER LEGG have entered into a professional services agreement for preparation of design and bid documents for the Prosperity Farms Road Beautification Project, which services have been completed; and WHEREAS, MILLER LEGG is desirous of providing construction monitoring services for the Prosperity Farms Road Beautification Project in accordance with Exhibit "A" attached, as an additional service to the aforementioned professional services agreement, and made part of this Agreement in its entirety. NOW, THEREFORE, in consideration of the promises mutually exchanged in this Agreement, for other good and valuable considerations, the receipt and sufficiency of which is acknowledged, the parties agree as follows: 1. The parties agree that MILLER LEGG shall perform construction monitoring services on the project of road improvements for the Prosperity Farms Road Beautification Project from Northlake Boulevard to Burns Road upon the terms and provisions and compensation set forth in Exhibit "A" which is attached and consisting of four (4) pages including a scope of services. 2. The length of the proposed roadway improvements is approximately 9,000 feet. 1.2 Construction plans have been prepared and permitted by MINer Legg dated January 28, 2005. Bids have been received by the Village of North Palm Beach for the project and the Vllage intends to award one centract. ~.3 The Scope of work Is intended to provided construction field observations end certiflcatlon5 of completed work to the extent outlined herein. 2 BASIS OF SCOPE 2.1 The Village will designate a Project Manager on staff bo oversee the administrative ma#lers of the contract. This Project Manager will coordinate the processing of contractor pay appllcatlons, reports to the Village Manager and Council, the execution of documents on behalf of thq Village and securing of testing laboratories, surveyors and other required tasks to facilitate the ardCrly completion of the wait. The Consultant will report solely to the Project Manager any and all prpgress reports and information requested by the Village. 2.2 The work to be performed by the selected contractor shall consist solely of the scope included In the subject project Contract ©ocuments (Plans & Specif~aatkons) dated January 28, 2005. 2.3 The Contract time for substantial completion of the work shall be no more khan ?50 calendar days. Village shall pay all costs associated with securing said surveys and record drawings. 3.5 Processing and execution of a contract with a selected contractor. 4 SCOPE OF ADDITIONAL SERVICES Construction Phase Services A. Contract Execution -Consultant shall assist Client in the preparation, negotiation and execution of contracts for the work on the Project. B. Pre-construction -Consultant shall attend pre-construction conference, review material shop drawings, and assist contractor with clarifications of project scope and design intent prior to commencement of construction. C. Construction Observation -Shall include periodic observation of the work, review of contractor pay requests, preparing observation reports, and verification of material testing. Full time daily observations are not included. It is estimated that up to 3 field observations per week will be adequate to complete this service. Should the Village determine that additional observations are required, or the contractor exceed the time provision in the contract, additional costs will apply. Consultant will coordinate with inspectors from Palm Beach County and Seacoast Utility Authority as required under their permits. D. Substantial and Final Inspections. Upon official notification from contractor that the project is complete and ready for Substantial and Final Inspections, Consultant shall perform said inspections of all work including concrete, pavement, landscape materials, irrigation and related systems. Consultant will receive and compile applicable warranties, and manufacturer operating manuals as appropriate, and deliver to the Village Project Manager. Upon completion of said inspections, a punch list of corrective work shall be prepared and delivered to the contractor and the Village Project Manager. E. Statement of Work Completion -Shall include statement of work completion, review and submittal of "as-built" drawings prepared by a registered land surveyor (obtained by Village) and assistance in conveying utility systems to Seacoast Utility Authority and roadway and landscaping to Palm Beach County.
