2006-105 FPL Easement at Country ClubRESOLUTION 2006-105
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE
A UTILITY EASEMENT IN FAVOR OF FLORIDA POWER AND LIGHT RELATING TO
COUNTRY CLUB GOLF COURSE IMPROVEMENTS; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in connection with the reconstruction of the Country Club Golf Course, the Village
requires electrical service to its maintenance facility; and
WHEREAS, Florida Power and Light requires the execution and recordation of a utility
easement as a condition to installing the necessary underground electric facilities to provide such
service; and
WHEREAS, the Village Council determines that the execution of this easement is in the interests
of the public health, safety and welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein.
Section 2. The Village Council hereby approves the Utility Easement in favor of Florida
Power and Light attached hereto as Exhibit "A" and incorporated herein by reference and
authorizes the Mayor and Village Clerk to execute the easement on behalf of the Village.
Section 3. This Resolution shall be effective immediately upon adoption.

UTILITY EASEMENT
The Village of North Palm Beach, 501 U.S. Highway One, North Palm Beach, FL 33408, in
consideration of the payment of $1.00 and other good and valuable consideration, the adequacy
and receipt of which is hereby acknowledged, grants and gives to Florida Power and Light
Company, its licensees, agents, successors and assigns, an easement for the construction,
operation and maintenance of underground electric facilities (including appurtenant equipment)
to be installed from time to time; with the right to reconstruct, improve, add to, enlarge, change
the voltage of and remove such facilities within an easement ten (10) feet in width described as
follows:
See Sketch and Legal Description attached as Exhibit "A"
Together with the right to permit any other person, firm or corporation to lay cable and conduit
within the easement and to operate same for communication purposes and the right of ingress
and egress to said premises to keep it cleared of all obstructions which might interfere with
construction, maintenance and operation activities. Florida Power and Light shall not perform
any construction, maintenance or clearing activities without first obtaining the consent of the
Village, such consent not to be unreasonably withheld, and shall in no instance disrupt use of
the burdened property for more than seventy-two (72) consecutive hours.
