2009-61 Opposing Proposed Changes to Intracoastal Waterway Boating Speed ZonesRESOLUTION 2009-61 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF • NORTH PALM BEACH, FLORIDA, OPPOSING THE RECOMMENDED CHANGES TO THE BOATING RESTRICTED AREAS WITHIN THE INTRACOASTAL WATERWAY BETWEEN THE PGA BOULEVARD BRIDGE AND THE PARKER BRIDGE; PROVIDING FOR TRANSMITTAL; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Fish and Wildlife Conservation Commission ("FWC") has the exclusive jurisdiction to establish boating restricted azeas to regulate vessel speed and wake within the Intracoastal Waterway ("ICW '); and WHEREAS, FWC conducted public hearings to consider changes to the boating restricted areas within the ICW in Palm Beach County, and FWC Staff has formulated recommendations for adoption by the Commission; and WHEREAS, a majority of the portion of the ICW between the PGA Boulevard Bridge and the Parker Bridge either lies within, or immediately adjacent to, the Village's municipal boundaries; and WHEREAS, FWC Staff is recommending: (1) reducing the existing no-wake/idle speed zone south of the PGA Boulevard Bridge from 2,450 feet to only 500 feet; (2) extending the no-wake/idle speed zone approximately 500 feet west of the Parker Bridge; and (3) imposing aslow-speed/minimum wake zone from 10:00 a.m. to 6:00 p.m. on holidays and weekends in the area between the no-wake zones adjacent to the PGA Boulevard Bridge and Pazker Bridge; and WHEREAS, having considered all available information, in addition to the recommendation of the Village Waterways Board, the Village Council wishes to express its opposition to FWC's recommended changes to the boating restricted azeas. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are hereby ratified and incorporated herein. ~J Section 2. The Village Council for the Village of North Palm Beach expresses its opposition to the proposed changes to the boating restricted azeas between the PGA Boulevazd Bridge and the Parker Bridge. The Village Council does, however, support the extension of the existing idle-speed/no wake zone west of the Pazker Bridge. Section 3. The Village Council directs that a copy of this resolution shall be transmitted to the Florida Fish and Wildlife Conservation Commission. Section 4.
