2001-090 PBS&J Agreement - Dredging Contract Admin.RESOLUTION 90-2001 • A RI;SOI,U'I'lON OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTfI PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO ENTER INTO AN AGREEMENT WITH POST, BUCKLEY, SCHUH & JERNIGAN, INC., llBA PBS&J, ATTACHED AS EXHIBIT "A", WHICH AGREEMENT PROVIDES FOR CONTRACT ADMINISTRATION FOR PHASE 1 OF THE VILLAGE DREDGING PROJF;CT; AND, PROVIDING FOR AN EFFECTIVE DATE. BI: ]T RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. 7'he Village Council of the Village of North Palm Beach, Florida, does hereby approve the Agreement with Post, Buckley, Schuh & Jernigan, Inc., dba PBS&J, attached as Exhibit "A", which agreement provides for contract administration for Phase 1 of the Village dredging project. Section 2. The Mayor and Village Clerk are hereby authorized and directed to execute the Agreement with Post, Buckley, Schuh & Jemigan, Inc., dba PBS&J, set forth in Exhibit "A" for and on behalf of the Village of North Palm Beach. (Village Seal) ATTE~ ~" VILLAGE CLERK MAYOR • October 29, 2001 WORK ORDER #5 • CONSTRUCTION ADMINISTRATION AND OBSERVATION SUPPORT PHASE I CANAL MAINTENANCE DREDGING This Work Order, when executed, shall be incorporated in and become an integral part of the Agreement for Professional Services between the Village of North Palm Beach, Florida (VILLAGE) and Post, Buckley, Schuh & Jernigan, Inc. (PBS&J) dated August 23, 2001, hereafter referred to as AGREEMENT PBS&J is available to assist the Village of North Palm Beach with the required construction administration services associated with the Phase I canal maintenance dredging work to be completed by Subaqueous Services, Inc. The contract documents prepared by LBFH, Inc. and dated October 25, 2000 and the recently issued DEP permit for the maintenance-dredging serve as the basis for the required work. PBS&J Scope of Services proposed to perform the following services: 1. Attend apre-construction meeting with the contractor and Village representatives to discuss the proposed plan of work schedule, monitoring requirements, measurement and payment procedures, etc. PBS&J will develop draft-meeting minutes for review and comment by the attendees. Upon receipt of comments, the draft minutes will be finalized and disseminated to the attendees. 2. PBS&J will perform periodic observation of the ongoing work evaluating general conformance with the construction documents permits and agreed upon work plan. A construction observation/progress report will be completed during each site visit to assist with ongoing construction documentation. t 3. PBS&J will review the contractors required submittals that may include, proposed schedule, plan of work, proposed alternative work directive changes or change orders progress surveys. Following review of this information, recommendations for acceptance or rejection will be provided to the Village and the Contractor. 4. Review of the contractors periodic pay requests and supporting documentation will be performed on a monthly basis. Recommendations for payment or revisions will be provided to the Village and the Contractor. An approval/certification of an acceptable pay request will • be provided. October 29, 2001 5. Because of the potential for unforeseen difficulties to arise with the project, a general • coordination task has been included to facilitate periodic progress meetings and telephone correspondence with the Village and the Contractor. 6. PBS&J will review the post dredge survey results (obtained by the Contractor) and perform spot checks to reaffirm that the required work has been satisfactorily completed. This will be accomplished as part of the substantial completion inspection in advance of final acceptance being granted and the contractor demobilizing. 7. PBS&J will perform additional services as desired and approved by both the Village of North Palm Beach and PBS&J. Any service not specifically included in the final Agreement will be considered as an Additional Service. The fees for Additional Services are at the standard hourly rates or at a mutually agreed upon Lump Sum. BUDGET PBS&J will perform the above tasks on an hourly basis. The estimated total fee (labor and expenses) of $25,000 for this assignment will not be exceeded without authorization from the Village. The total fee cannot be better quantified at this time due to the fact PBS&J has not had the opportunity to review the construction documents, to review the Department of Environmental (DEP) permit or meet with the Contractor. SCHEDULE Based on discussions with the Contractor, it is estimated that the proposed construction work will require five months to perform. It is believed that the actual dredging work will be completed in somewhat less time but the five-month timeframe allows for unanticipated delays. The actual time required to complete the assignment will be contingent on the contractor's effectiveness with the project. PBS&J is budgeting a weekly labor effort to the assignment. Completion of the above tasks will be driven by the contractor's ability to complete the work and make the required submittals.
