SUBJECT: RESOLUTION — Approval of an Amendment to the Contract with Ranger
Construction Industries, Inc. to revise the scope to add milling and resurfacing
services along Buttonwood Drive and eliminate milling and resurfacing services
from Fairhaven Place and to increase the compensation by $37,280.00.
Through the adoption of Resolution No. 2023-44 on June 8, 2023, the Village Council approved a
Contract with Ranger Construction Industries, Inc. for the milling and resurfacing of various roadways
within the Village. The milling and resurfacing locations originally included in this project were:
Fairhaven Place, Fairhaven Drive, Robalo Court, Cinnamon Road, Alamanda Drive (from Dogwood
Road to Lighthouse Drive), Huckleberry Lane, Ironwood Road, Gumtree Road, Firetree Road,
Eucalyptus Road, Juniper Drive, Laurel Road, and Laurel Court. The Village budgets for milling and
resurfacing projects within the five-year Capital Improvement Plan utilizing Infrastructure Surtax dollars.
Village Staff is proposing a change in the Contract's scope of services as follows:
• Include milling and resurfacing on Buttonwood Drive
• Remove milling & resurfacing of cul-de-sac on Fairhaven Place
Recently, residents have inquired as to why Buttonwood Drive was excluded from 2023 milling &
resurfacing of Village roadways. Buttonwood Drive was not included in 2023 milling & resurfacing due
solely to fiscal limitations for Fiscal Year 22/23.
The milling & resurfacing of the existing cul-de-sac on Fairhaven Place is being removed due to timing
constraints of construction of a flush grassed median within the center of the cul-de-sac. The median
construction was requested by the Surtax Committee during approval funding for 2023 milling &
resurfacing.
By eliminating the Fairhaven Place cul-de-sac from 2023 milling and resurfacing, funds designated to
mill and resurface this area can be applied to Buttonwood Drive. However, the amount of Buttonwood
Drive milling and resurfacing exceeds that of the Fairhaven Place cul-de-sac, requiring additional funds.
The total cost of Ranger's proposal is $37,280.00; which includes an increase of $54,640.70 associated
with Buttonwood Drive milling and resurfacing, while removing $17,360.70 associated with Fairhaven
Place cul-de-sac milling and resurfacing. Village Staff is requesting that the compensation be increased
by $37,280.00, bringing the new Contract amount to $451,529.16 and the total project budget, including
contingency, to #457,280.00. There are sufficient funds available in the Infrastructure Surtax Fund for
this purchase (a summary for the Surtax Fund is included in your agenda backup material for review).
The attached Resolution and Amendment have been prepared and/or reviewed for legal sufficiency by
the Village Attorney.

Village Staff requests Council consideration and approval of the attached Resolution approving
an Amendment to the Contract with Ranger Construction Industries, Inc., to provide milling and
resurfacing services for specified Village roadways to revise the scope to remove Fairhaven
Place and add Buttonwood Drive and increase the total amount of compensation to $451,529.16
(and the total project budget including contingency to $457,280.00), with funds expended from
the Infrastructure Surtax Fund Account No. 17321-66210 (Public Works/Streets & Grounds -
Construction & Major Renovation) and authorizing the Mayor and Village Clerk to execute the
Amendment in accordance with Village policies and procedures.
RESOLUTION 2023-
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA APPROVING AN AMENDMENT TO THE CONTRACT WITH
RANGER CONSTRUCTION INDUSTRIES, INC. FOR MILLING AND RESURFACING
OF SPECIFIED VILLAGE ROADWAYS TO MODIFY THE SCOPE OF SERVICES
AND ADJUST THE TOTAL COST AND AUTHORIZING THE MAYOR AND
VILLAGE CLERK TO EXECUTE THE AMENDMENT; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, through the adoption of Resolution No. 2023-44 on June 8, 2023, the Village Council approved
a Contract with Ranger Construction Industries, Inc. for milling and resurfacing services on specified
Village roadways ("Contract') pursuant to pricing established in an existing Annual Resurfacing and
Milling Contract (Project No. 2021050) with Palm Beach County, subject to additional mobilization costs;
and
WHEREAS, the Village Council wishes to approve an Amendment to the Contract to remove Fairhaven
Place from the scope of services and add Buttonwood Drive and adjust the compensation accordingly; and
WHEREAS, the Village Council determines that the adoption of this Resolution, including the waiver of
any conflicting purchasing policies and procedures, is in the best interests of the citizens and residents of
the Village of North Palm Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and incorporated herein.
Section 2. The Village Council hereby approves an Amendment to the Contract with Ranger
Construction Industries, Inc. for the milling and resurfacing of specified Village roadways and authorizes
the Mayor and Village Clerk to execute the Amendment on behalf of the Village, a copy of which is attached
hereto and incorporated herein. The total cost of this Contract, as amended, shall not exceed $451,529.16,
with funds expended from Account No. I7321-66210 (Streets & Grounds - Construction & Major
Renovation). Including contingency, the total project budget shall be $457,280.00.
Section 3. All resolutions or parts of resolutions in conflict with this Resolution are hereby repealed to
the extent of such conflict.
Section 4. This Resolution shall take effect immediately upon adoption.

AMENDMENT TO CONTRACT
This Amendment is made as of this day of , 2023, by and between the
VILLAGE OF NORTH PALM BEACH, 501 U.S. Highway One, North Palm Beach, Florida 33408,
a Florida municipal corporation (hereinafter "VILLAGE"), and RANGER CONSTRUCTION
INDUSTRIES, INC., a Florida corporation (hereinafter "CONTRACTOR"), whose F.E.I. Number is
59-2098662.
RECITALS
WHEREAS, on June 8, 2023, the VILLAGE and CONTRACTOR executed a Contract for milling
and resurfacing services on specified Village roadways ("Contract") pursuant to pricing established
in Palm Beach County's Annual Milling and Resurfacing Contract; and
WHEREAS, the parties wish to revise the scope of services to be performed by CONTRACTOR
pursuant to the terms of the Contract and adjust the compensation accordingly.
NOW THEREFORE, in consideration of the mutual promises set forth in the Contract, as amended,
the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows:
The foregoing recitals are hereby ratified and incorporated herein.
2. Section 3.A of the Contract is hereby amended to modify the milling and resurfacing services
to be performed by CONTRACTOR to exclude Fairhaven Place and include Buttonwood Drive, as
set forth in Change Order #1 dated August 8, 2023, a copy of which is attached hereto and
incorporated herein.
3. Section 3.13 of the Contract is hereby amended to increase the total cost of such services from
$414,249.16 to $451,529.16, subject to adjustments based on the actual quantities in accordance with
the unit pricing set forth in CONTRACTOR'S Proposal.
4. All other provisions of the Contract, to the extent not expressly modified herein, shall remain
in full force and effect.
