A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH,
FLORIDA, APPROVING AN AMENDMENT TO THE PLAT OF PROSPERITY HARBOR
NORTH PLANNED UNIT DEVELOPMENT, ATTACHED AS EXHIBIT "A", WHICH
AMENDMENT REMOVES A PORTION OF LOT 40, BLOCK 16, AND ADDS THAT PORTION
TO THE REAR BOUNDARIES OF LOTS 31 THROUGH 34, INCLUSIVE, OF BLOCK 15 TO
BRING LOTS 31 THROUGH 34, INCLUSNE, INTO COMPLIANCE. WITH THE REAR YARD
SETBACK REQUIRED IN THE PLANNED UNIT DEVELOPMENT; AUTHORIZING AND
DIRECTING THE MAYOR AND VILLAGE CLERK TO EXECUTE THE AMENDMENT TO
THE PLAN; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby
approve an amendment to the plat of Prosperity Harbor North Planned Unit Development attached
as Exhibit "A", which amendment removes a portion of Lot 40, Block 16, and adds that portion to
the rear boundaries of Lots 31 through 34, inclusive, of Block 15 to bring Lots 31 through 34,
inclusive, into compliance with the rear yard setback required by the planned unit development.
Section 2. The Mayor and Village Clerk are hereby authorized and directed to execute
the amendment to the plat of Prosperity Harbor North Planned Unit Development set forth in Exhibit
"A" for and on behalf of the Village of North Palm Beach.
Section 3. This Resolution shall take effect immediately upon its adoption.

RECITALS:
A. Developer is the owner of that certain real property described in Exhibit
"A" attached hereto and incorporated herein by this reference (less various non•
relevant lot sales) (hereinafter the "Property"). Developer intends to build a
community known as Prosperity Harbor North upon the Property.
B. Developer has caused the Prosperity Harbor North community to be
platted into lots and blocks, and various other tracts of land, by that certain Plat of
Prosperity Harbor North P.U.D. recorded July 19, 1999 in Plat Book 85, Page 103 of
the Public Records of Palm Beach County, Florida (hereinafter the "Plat").
C. The Village ie requiring that the homes to be constructed upon various
lots contained within Block 15 of the Plat, be set back t least fifteen (15) feet from
the rear lot lines of the lot upon which the home is to be~constructed.
D. In order to comply with the Village's requirements, the Developer desires
to amend portions of the Plat by changing the northerly boundary line of Lot 40 of
Block 16 and the southerly boundary lines of Lota 31, 32, 33 and 34 of Block 16, as
more fully depicted on the Revised Site Plan attached hereto as Exhibit "B" and
incorporated herein by this reference. In effect, this amendment would thereby
remove a portion of the property from Lot 40 of Block 16 and add portions thereof
to the rear boundaries of Lots 31, 32, 33 and 34 of Block 15. (Lot 40 of Block 16, and
Lots 31 to 34 of Block 15 are hereinafter collectively referred to as the "Affected
Lots', and the portion of property being removed from Lot 40 of Block 16 is
• hereinafter referred to as the "Additional Set Back Property").

E. Developer is the current fee simple owner of all of the Affected Lots.
• There are no mortgages currently encumbering the Affected Lots.
F. The Additional Set Back Property, prior to this Amendment, was
contained entirety within Lot 40 of Block 16. Said property is not deemed to be a
common area dedicated to the Prosperity Harbor North Master Association, Inc. for
the common use and enjoyment of any other owners of lots in the Property and said
lot owners no not have any rights of easement and/or enjoyment over the Additional
Set Back Property.
NOW, THEREFORE, the Developer and the Village, in consideration of the
premises, covenants and provisions herein contained, hereby agree that the Plat
shall be amended in the following manner stated below:
1• The above recitals are true and correct and are incorporated herein by
this reference.
2• The legal description of Lot 40, Block 16, as contained within the Plat,
is hereby amended and replaced in its entirety with that certain legal description
set forth on Exhibit "C" attached hereto and incorporated herein by this reference.
3• The legal description of Lot 31, Block lb, as contained within the Plat,
is hereby amended and replaced in its entirety with that certain legal description
set forth on Exhibit "D" attached hereto and incorporated herein by this reference.
Upon the recording of this Amendment in the Public Records of Palm Beach County
Florida, Lot 31 of Block 15, together with that portion of the Additional Set Back
Property described in Exhibit "D", shall be deemed to be unified and shall be
henceforth considered as one lot or parcel of land and shall not be sold, assigned,
transferred, conveyed or devised separately, except in its entirety as one lot or
parcel of land.
4• The legal description of Lot 32, Block 15, as contained within the Plat,
is hereby amended and replaced• in its entirety with tat certain legal description
set forth on Exhibit "E" attached hereto and inwrporated herein by this reference.
Upon the recording of this Amendment in the Public Records of Palm Beach County
Florida, Lot 32 of Block 15, together with that portion of the Additional Set Back
Property described in Exhibit "E", shall be deemed to be unified and shall be
henceforth considered as one lot or parcel of land and shall not be sold, assigned,
transferred, conveyed or devised separately, except in its entirety as one lot or
parcel of land.
5• The legal description of Lot 33, Block 15, as contained within the Plat,
is hereby amended and replaced in its entirety with that certain legal description
set forth on Exhibit "F" attached hereto and incorporated herein by this reference.
Upon the recording of this Amendment in the Public Records of Palm Beach County
Florida, Lot 33 of Block lb, together with that portion of the Additional Set Back

• Property described in Exhibit "F", shall be deemed to be unified and shall be
henceforth considered as one lot or parcel of land and shall• not be sold, assigned,
transferred, conveyed or devised separately, except in its entirety as one lot or
parcel of land.
6. The legal description of Lot 34, Block 15, as contained within the Plat,
is hereby amended and replaced in its entirety with that certain legal description
set forth on Exhibit "G" attached hereto and incorporated herein by this reference.
Upon the recording of this Amendment in the Public Records of Palm Beach County
Florida, Lot 34 of Block 15, together with that portion of the Additional Set Back
Property described in Exhibit "F", shall be deemed to be unified and shall be
henceforth considered as one lot or parcel of land and shall not be sold, assigned,
transferred, conveyed or devised separately, except in its entirety as one lot or
parcel of land.
7. Developer and Village, by executing this Amendment, hereby signify
their consent to all matters set forth herein, including the relocation of the
boundary lines and revisions to the legal descriptions of the Affected Lots.
8. The Village acknowledges that the relocation of the boundary lines and
the removal of the Additional Set Back Property from Lot 40 of Block 16 does not
violate any municipal ordinances, rules or other requirements. The Village further
acknowledges that it is not requiring that Developer replat the Affected Lots in
order to accomplish the matters set forth herein, that any such requirement for
replatting is deemed waived, and that this Amendment, upon the recording of same
in the Public Records of Palm Beach County, Florida, shall be effective in amending
the Plat.
