Plan Amdmnt Bill 1169 M E M O R A N D U M To: Honorable Mayor and Council From: Mark Bates; Village Manager By: Bill Denison; Acting Building Official Date: 5/12/05 Subject: Mariners Court - Comprehensive Plan Amendment st Ordinance Change 1 reading Attached you will find an Ordinance changing the Village’s comprehensive plan land use designation for the property parcel immediately south of our public safety building. This property currently has a commercial land use designation in the Village comprehensive plan. First reading of this Ordinance is the initial step in changing the property’s land use and zoning from commercial to residential. Approval of this Ordinance first reading will allow the Administration to transmit a comprehensive plan amendment to the state Dept. of Community Affairs for their review and consideration. The second and final reading of this Ordinance will brought back before Council consideration and final action after all zoning issues for this parcel of property have been completed. Recommendation: The Village Administration requests Council consideration and approval of the attached Ordinance and directing transmittal of the comprehensive plan amendment to the Florida Dept of Community Affairs. ORDINANCE NO. ______ AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING A LARGE SCALE COMPREHENSIVE PLAN AMENDMENT DESIGNATED AS AMENDMENT 05-1 TO THE ADOPTED COMPREHENSIVE PLAN FOR THE VILLAGE OF NORTH PALM BEACH, FLORIDA, PURSUANT TO THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND LAND DEVELOPMENT REGULATION ACT, AS AMENDED, BEING SECTIONS 163.3161, ET SEQ., FLORIDA STATUTES, WHICH AMENDMENT IS ATTACHED AS EXHIBIT “A” AND INCORPORATED HEREIN BY REFERENCE; PROVIDING FOR REVISIONS TO THE FUTURE LAND USE MAP SERIES; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to 163.3161, Et Seq., Florida Statutes, being the local Government Comprehensive Planning and Land Development Regulation Act, the Village of North Palm Beach may adopt large scale amendments to the Comprehensive Plan; and WHEREAS, the Village Planning Commission, sitting as the local Planning Agency, at its regular meeting held March 1,2005, found the proposed amendment consistent with the Village of North Palm Beach Comprehensive Plan and made a recommendation to the Village Council to approve the large scale amendment designated as Amendment 05-1 and attached hereto as Exhibit “A”; and WHEREAS, the Village Council of the Village of North Palm Beach, Florida, after public hearing and due consideration, is desirous of adopting Amendment 05-1 to the Comprehensive Plan for the Village of North Palm Beach. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Pursuant to the provisions of the local government Comprehensive Planning and Land Development Regulation Act, Section 163.3161 Et. Seq., Florida Statutes, the Village Council of the Village of North Palm Beach, Florida, does hereby adopt a large scale amendment designated as Amendment 05-1 to the Comprehensive Plan for the Village of North Palm Beach, which amendment is attached as Exhibit “A” and made a part hereof. Section 2. The future Land Use Map Series of the future land use element of the Comprehensive Plan of the Village of North Palm Beach, Florida, is hereby revised in accordance with the amendments set forth in Exhibit “A” attached. Section 3. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 4. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 5. This Ordinance shall take effect immediately upon adoption.
