RESOLUTION NO. 17-95
A RESOLUTION OF THS VILLAGfi COUNCIL OF THE
VILLAGE OF NORTH PALM BEACH, FLORIDA,
AUTHORIZING APPLICATION TO THE FLORIDA INLAND
NAVIGATION DISTRICT FOR FINANCIAL ASSISTANCE
OF ONS-HALF OF TOTAL ESTIMATED COST OF SEVEN
HUNDRED FORTY-ONE THOUSAND ($741,000.00)
DOLLARS FOR INSTALLATION OF APPROXIMATELY
1,750 LINEAL FEET OF RUBBLE RIP-RAP SHORELINE
PROTECTION FOR THE SOUTH SHORELINE OF THE
INTRACOASTAL WATERWAY ADJACENT TO THE VILLAGE
OF NORTH PALM BEACH GOLF COURSE; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Village Council of the Village of North Palm
Beach, Florida, is desirous of installing approximately 1,750
lineal feet of Rubble Rip-Rap Shoreline Protection for the south
shoreline of the Intracoastal, Waterway adjacent to the Village of
North Palm Beach Golf Course; and
WHEREAS, the Village Council is desirous of making
application to the Florida Inland Navigation District for fifty
percent of the actual cost of the Shoreline Protection Program.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. The Village Council of the Village of North
Palm Beach, Florida, does hereby approve and hereby make
application to the Florida Inland Navigation District in the amount
of fifty percent of the actual cost of the Shoreline Protection
Program for the south shoreline of the Intracoastal Waterway
adjacent to the Village of North Palm Beach Golf Course.
Section 2. The Village Council does hereby certify that
it will accept the terms and conditions set forth in FIND Rule 16T-
2 F.A.C. and which will be a part of the Project Agreement for any
assistance awarded under the attached proposal.
Section 3. The Village Council is in complete accord
with the attached proposal and that it will carry out the Program
in the manner described in the proposal and any plans and
specifications attached thereto unless prior approval for any
change has been received from the Florida Inland Navigation
District.
Section 4. The Village Council has the ability and
' intention to finance its share of the cost of the project and that
the project will be operated and maintained at the expense of said
Village of North Palm Beach, Florida for public use.
Section 5. The Village will not discriminate against any
person on the basis of race, color or national origin in the use of
any property or facility acquired or developed pursuant to this
proposal, and shall comply with the terms and intent of the Title
VI of the Civil Rights Act of 1964, P.L. 88-352(1964) and design
and construct all facilities to comply fully with statutes relating
to accessibility by handicapped persons as well as other federal,
state and local laws, rules and requirements.
Section 6. The Village will maintain adequate financial
records on the proposed project to substantiate claims for
reimbursement.
Section 7. The Village will make available to Florida
Inland Navigation District if requested, a post-audit of expenses
incurred on the project prior to, or in conjunction with, request
for the final lOg of the funding agreed to by Florida Inland
Navigation District.
Section 8. This Resolution shall take effect
immediately upon its adoption.
PASSED AND ADOPTED THIS 23rd DAY OF March 1995.
