11-09-2021 Order Zoning Variance 113 Gulfstream Road_Allison & Stuart HaftPage 1 of 2 VILLAGE OF NORTH PALM BEACH ZONING BOARD OF ADJUSTMENT ORDER ON VARIANCE APPLICATION Applicants: Allison and Stuart Haft (Property Owners) Property Location: 113 Gulfstream Road, North Palm Beach, FL 33408 Legal Description: Lot 7, Block 67, Yacht Club Addition to the Village of North Palm Beach, according to the plat thereof recorded in Plat Book 26, Page 249 of the public records of Palm Beach County, Florida (PCN: 68- 43-42-09-01-067-0070) Request: Variance from Section 5-84(6) of the Village Code of Ordinances which requires that piers not be closer to the side property line extended than half its extension waterside from the rear property line to allow for the construction of pier extending approximately 8.5 feet from the rear property line with a side setback of two feet when the Code requires 4.25 feet. THIS MATTER came before the Planning Commission sitting as the Zoning Board of Adjustment on November 9, 2021. After considering the testimony and evidence presented at the hearing and being otherwise duly advised, the Board of Adjustment hereby makes the following findings of fact: 1. The public hearing was properly noticed in accordance with Section 21-3 of the Village Code of Ordinances. 2. Applicant’s request meets the requirements for the grant of a variance set forth in Section 21-21(c)(2) of the Village Code of Ordinances. Based on the foregoing findings of fact, it is ORDERED and ADJUDGED by the Board of Adjustment that Applicant’s request for a variance from Section 5-84(6) of the Village Code of Ordinances to construct a pier adjacent to the Property with a side setback of two feet is hereby APPROVED subject to the following conditions: 1. The pier shall only be used for the loading and unloading of non-motorized vessels. In no instance shall any vessels be stored on or adjacent to the pier.
