ROLL CALL
Mayor Aubrey called the meeting to order at 7:00 p.m. All members of Council were present. All
members of staff were present.
INVOCATION AND PLEDGE OF ALLEGIANCE
Mayor Aubrey gave the invocation and Vice Mayor Searcy led the public in the Pledge.
AWARDS AND RECOGNITION
Mayor Aubrey read the Proclamation for Constitution Week.
Susan Earle from Daughters of the American Revolution accepted the Proclamation, thanked
Council and expressed her appreciation.
APPROVAL OF MINUTES
The Minutes of the Regular Session held August 12, 2021 were approved as written.
STATEMENTS FROM THE PUBLIC
Tim Hullihan, 840 Country Club Drive, expressed his thoughts regarding having a nature preserve
in the Village and stated that he would support and donate towards it.
Shawn Woods, 532 Kingfish Road, expressed her thoughts regarding having a nature preserve in
the Village and stated that she and other residents she had spoken to would support and donate
towards it.
Mary Phillips, 525 Ebbtide Road, expressed her thoughts regarding having a nature preserve in the
Village and stated that she would support and donate towards it.
John Samadi, 512 Marlin Road, expressed his concerns regarding the Village's current Public
Works Director.
Dan Higgins, 106 Atlantic Road, expressed his thoughts and concerns regarding the proposed
Lakeside Park berm. Mr. Higgins gave ideas on potential alternatives and improvements.

STATEMENTS FROM THE PUBLIC continued
Deborah Cross, 2560 Pepperwood Circle, expressed her concerns with the tabling of a Zoning in
Progress. Ms. Cross stated that she would also support and donate to having a nature preserve in
the Village.
Scott Goodby, 717 Teal Way, distributed a handout to Council that listed the square footages of
houses located on Teal Way. Mr. Goodby stated that the average square footage of the homes on
Teal Way was 2062 square feet and expressed his concerns regarding a permit that was recently
approved by the Village to build a 7085 square foot home on Teal Way.
Lisa Gallagher, 704 Teal Way, expressed her support to the Village for trying to implement new
residential codes and a Zoning in Progress. Ms. Gallagher expressed her concerns about more
permits being approved for larger big box homes before the Zoning in Progress is implemented.
Ms. Gallagher also expressed her concerns regarding a permit that was recently approved by the
Village to build a 7085 square foot home on Teal Way.
PUBLIC HEARINGS AND QUASI-JUDICIAL MATTERS
There was no ex -parte communication by Council for the following item:
MOTION - DIMENSIONAL EXCEPTION APPLICATION FOR 904 EVERGREEN DRIVE
Principal Planner Alex Ahrenholz explained and described the applicant's recreational vehicle
location, its dimensions and the dimensions of the property. Mr. Ahrenholz showed pictures of
the recreational vehicle, its screening and its location. Mr. Ahrenholz stated that staff was
recommending approval of the dimensional exception request with the condition that the applicant
install additional shrubs or trees along the west, south and east property lines within 90 days at a
minimum of four (4) feet and the vegetation shall grow to screen the RV at ninety (90) percent
opacity within two (2) years and if any trees or shrubs on adjacent properties that are currently
providing screening are removed, they shall be replaced on the applicant's property or neighboring
property within six months of their removal; the west ten (10) feet of the sidewalk shall be replaced
at six (6) inches thick; and a solid, opaque, six (6) foot high gate shall be installed along the front of
the RV within sixty (60) days.
Mayor Aubrey opened the public hearing on the Dimensional Exception Application for 904
Evergreen Drive.
There being no comments from the public, Mayor Aubrey closed the public hearing.
Discussion ensued between Council and Mr. Rubin regarding the requirements and conditions to
approve or deny the Dimensional Exception Application for 904 Evergreen Drive.
Jeffrey Tiffany, 904 Evergreen Drive, gave an explanation as to why his RV had not been fully
screened over the years. Mr. Tiffany stated that he had a fence there for 18 years and removed it three
(3) years ago and had not yet replaced it due to the starts and stops regarding the boat and
recreational vehicle ordinance.
Discussion ensued among Council regarding a conditional timeframe for the applicant to apply for
a permit for the sidewalk.

MOTION - DIMENSIONAL EXCEPTION APPLICATION FOR 904 EVERGREEN DRIVE continued
Council came to consensus to add a condition for the applicant to apply for a permit for a sidewalk
within sixty (60) days.
A motion was made by President Pro Tem Mullinix and seconded by Vice Mayor Searcy to
approve the Dimensional Exception Application for 904 Evergreen Drive subject to the conditions
recommended by staff and the additional condition required by Council to apply for a permit for
the sidewalk within sixty (60) days.
Thereafter, the motion was approved unanimously.
ORDINANCE 2021-11 OLD PORT COVE SOUTH MARINA PUD AMENDMENT — 2ND
REQUEST FOR CONTINUANCE
A motion was made by Vice Mayor Searcy and seconded by Councilmember Norris to continue
the first reading of Ordinance 2021-11 to September 8, 2021.
Thereafter, the motion to continue the first reading of Ordinance 2021-11 to September 8, 2021
passed unanimously.
ORDINANCE 2021-12 PROSPERITY VILLAGE PUD — 2ND REQUEST FOR CONTINUANCE
A motion was made by Councilmember Bickel and seconded by Vice Mayor Searcy to continue
the first reading of Ordinance 2021-12 to September 8, 2021.
Thereafter, the motion to continue the first reading of Ordinance 2021-12 to September 8, 2021
passed unanimously.
ORDINANCE 2021-13 CODE AMENDMENT — ELECTION QUALIFYING PERIOD
A motion was made by President Pro Tem Mullinix and seconded by Vice Mayor Searcy to adopt
on first reading Ordinance 2021-13 entitled:
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING CHAPTER 10, "ELECTIONS," ARTICLE I, "IN
GENERAL," OF THE VILLAGE CODE OF ORDINANCES BY AMENDING SECTION 10-5,
"CANDIDATES FOR OFFICE; QUALIFYING," TO AMEND THE QUALIFYING DATES
FOR THE VILLAGE'S GENERAL ELECTION; PROVIDING FOR CODIFICATION;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING
FOR AN EFFECTIVE DATE.
Village Clerk Green explained that the proposed ordinance on first reading was brought back for
consideration based on the discussion at the previous meeting. The Supervisor of Elections was
now requiring to have ballot language for the municipal election submitted 95 days before the
election. The Village's current qualifying period falls outside of that requirement. Council came
to consensus at the previous meeting to change the current qualifying period of the first seven
business days in December to beginning on the third Tuesday in November and ending on the
fourth Tuesday in November.

Mayor Aubrey opened the public hearing on the election qualifying period ordinance.
There being no comments from the public, Mayor Aubrey closed the public hearing.
Thereafter, the motion to adopt on first reading Ordinance 2021-13 passed unanimously.
ORDINANCE 2021-14 CODE AMENDMENT — VACATION RENTAL REGISTRATION AND
REGULATION
A motion was made by Councilmember Norris and seconded by Vice Mayor Searcy to adopt on
first reading Ordinance 2021-14 entitled:
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING APPENDIX C (CHAPTER 45), "ZONING," OF THE
VILLAGE CODE OF ORDINANCES BY ADOPTING A NEW SECTION 45-40, "VACATION
RENTALS," PROVIDING FOR APPLICABILITY; PROVIDING FOR REGISTRATION AND
INSPECTION; PROVIDING FOR VACATION RENTAL STANDARDS; PROVIDING FOR
VIOLATIONS, ENFORCEMENT AND REMEDIES; PROVIDING FOR CODIFICATION;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING
FOR AN EFFECTIVE DATE.
Attorney Rubin began a presentation regarding vacation rentals. Mr. Rubin gave a history of
vacation rental legislation. Mr. Rubin stated that Village Council and staff have received numerous
complaints regarding the operation of vacation rentals within the Village. The proposed ordinance
would have several provisions that would attempt to mitigate negative impacts to the Village's
residential neighborhoods. Through the proposed ordinance, vacation rental owners would need
to register with the Village by October 1, 2021 with a proposed initial registration fee of $450 and
yearly renewal of the same amount. Mr. Rubin reviewed and explained what the vacation rental
owner would need to provide as part of the initial registration process. Mr. Rubin discussed and
explained the life and safety standards the proposed ordinance would require compliance with, the
maximum occupancy that would be allowed, parking and other miscellaneous requirements. Mr. Rubin
concluded the presentation by stating that enforcement of any violations would be carried out
through the normal code enforcement process and that the Planning Commission considered the draft of
the proposed ordinance at its August 3, 2021 meeting and unanimously recommended its approval.
Mayor Aubrey opened the public hearing on the vacation rental and registration ordinance.
There being no comments from the public, Mayor Aubrey closed the public hearing.
Discussion ensued between Council, Mr. Rubin and staff regarding the amount of the vacation
rental registration fee.
Mr. Rubin and Community Development Director Jeremy Hubsch concurred that the vacation
rental registration fee could be increased in the future and would be accomplished by adopting a resolution.

ORDINANCE 2021-14 CODE AMENDMENT — VACATION RENTAL REGISTRATION AND
REGULATION continued
President Pro Tem Mullinix had questions regarding providing a sample lease and the requirement
for a contact person to be available 24 hours, 7 days a week.
Mr. Rubin clarified that the sample lease would be a one-time requirement at registration.
Chief Jenkins clarified that he requested that a contact person be available 24 hours, seven days a
week because of the issues that have arisen during the past in the evening hours with regards to
vacation rentals. The police would need a contact person in those cases. Chief Jenkins stated that
the contact person did not have to be the owner of the property but could be another designated person.
Discussion ensued between Council, Mr. Rubin and staff regarding the proposed vacation rental
requirements.
Thereafter, the motion to adopt on first reading Ordinance 2021-14 passed unanimously.
ORDINANCE 2021-15 CODE AMENDMENT — ELECTRICAL SERVICE TO FORMERLY
DEVELOPED VACANT LOTS
A motion was made by Councilmember Bickel and seconded by Vice Mayor Searcy to adopt on
first reading Ordinance 2021-15 entitled:
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING ARTICLE III, "DISTRICT REGULATIONS," OF
APPENDIX C (CHAPTER 45) OF THE VILLAGE CODE OF ORDINANCES BY AMENDING
SECTION 45-36(R) TO ALLOW ELECTRICAL SERVICE TO FORMERLY DEVELOPED
LOTS FOR THE SOLE PURPOSE OF OPERATING AN IRRIGATION SYSTEM;
PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
Mr. Rubin explained the purpose of the proposed ordinance. Mr. Rubin stated the ordinance would
regulate vacant lots after the demolition of an existing home. Mr. Rubin stated that ordinance
would allow electrical service to such vacant lots for the sole purpose of operating an irrigation system.
Mayor Aubrey opened the public hearing on the electrical service to formerly developed vacant
lots ordinance.
There being no comments from the public, Mayor Aubrey closed the public hearing.
Thereafter, the motion to adopt on first reading Ordinance 2021-15 passed unanimously.
CONSENT AGENDA APPROVED
President Pro Tem Mullinix moved to approve the Consent Agenda. Councilmember Norris
seconded the motion, which passed unanimously. The following items were approved:
Resolution accepting a proposal from Toshiba America Business Solutions for the lease of
multi -function copiers for various Village departments for a total annual lease payment of
$28,366.20.

Resolution authorizing the Village Manager to execute all required Agreements and take
all actions necessary for the receipt of American Rescue Plan Act Coronavirus Local Fiscal
Recovery Funds.
Resolution approving an Amendment to the Contract with Randy Gillman Enterprises,
LLC d/b/a Randy's Holiday Lighting for holiday lighting and decor for the 2020 through
2022 holiday seasons to include the North Palm Beach Country Club; and authorizing
execution of the Amendment.
Receive for file Minutes of the Police and Fire Pension Board meeting held 5/11/21.
Receive for file Minutes of the Environmental Committee meeting held 7/12/21.
Receive for file Minutes of the Golf Advisory Board meeting held 7/19/21.

MOTION — Establishment of Ad Hoc Committee to evaluate the Zoning in Progress and review

appointed members to the Ad Hoc Committee to evaluate the Zoning in Progress and review and
recommend revisions to the R-1 Zoning District regulations, as follows:

A motion was made by Councilmember Bickel and seconded by Vice Mayor Searcy to accept the

Lisa Jensen and Robert Silvani as regular members and Stephen St. John, Matthew Schmitt and
Amanda McNally as alternate members to the Ad Hoc Committee to evaluate the Zoning in
Progress and review and recommend revisions to the R-1 Zoning District regulations.

MAYOR AND COUNCIL MATTERS/REPORTS
Public Works Director Chuck Huff introduced Chad Girard as the new Assistant Public Works
Director and Marc Holloway was the new Sanitation Supervisor.
Vice Mayor Searcy recommended having lighted ship wheels as part of the holiday light decor.
Councilmember Bickel stated that she was pleased to see that the North Palm Beach Symphony Orchestra's
logo is a ship wheel with a violin and announced that their concert would be held in ten (10) weeks.
Vice Mayor Searcy asked if the orchestra would be willing to play at the Christmas Tree Lighting Ceremony.
Councilmember Bickel stated that she assumed that the orchestra would be thrilled to play at the
Village's Christmas Tree Lighting Ceremony.
Councilmember Bickel expressed her concerns regarding the proposed Prosperity Village Planned
Unit Development. Councilmember Bickel recommended collaborating with the City of Palm
Beach Gardens to make the property into a natural preserve area. Councilmember Bickel stated
that the property would have to be purchased by the Village and recommended inquiring of the
property owner if they were willing to sell it to the Village.
Councilmember Bickel expressed her concerns and concerns she heard from residents regarding
the process and timeframe for implementing the Zoning in Progress.
Discussion ensued between Council and Mr. Rubin regarding the process and timeframe for
implementing the Zoning in Progress.
President Pro Tem Mullinix recommended looking into obtaining Little Munyon Island as a natural
preserve area for the Village.
VILLAGE MANAGER MATTERS/REPORTS
FY 2022 Strategic Planning Prioritization
Mr. Lukasik explained that there were items listed on the handout provided to Council that were
prioritized as a result of the Master Plan and Strategic Planning that needed to be reviewed and
have a final prioritization score determined or if any of the items needed to be removed from the
list. Mr. Lukasik reviewed and discussed the items on the list with Council.
Council discussed the items and confirmed and/or revised prioritization scores.
