For the purpose of providing for any contingency not covered by this chapter, the provisions of the general laws of the state relating to electors and elections so far as the same may be applicable and not inconsistent with this chapter are adopted as a part hereof. (Code 1970, § 12-1) Sec. 10-2. Special elections; when held. Special elections shall be held for such purposes as may be required and as provided for by law. (Code 1970, § 12-11) Sec. 10-3. Notice of general elections. The village clerk shall cause to be published at least fifteen (15) days next preceding any general election, once, in a newspaper of general circulation in the village, a notice stating the date of such election, the offices to be filled, and the time and place where such election shall be held; and if there be one (1) or more propositions to be voted upon, state in substance the character of the propositions to be voted upon. In addition, such notice shall be given by posting a copy thereof in at least three (3) public and conspicu- ous places in the village, one (1) of which shall be the bulletin board in the village hall. (Code 1970, § 12-13) Sec. 10-4. Notice of special election. Whenever any special election for any purpose is required to be held, the village council shall, by resolution, declare on what day the same shall be held, whereupon notice thereof shall be published in one (1) or more newspapers of general circulation in the village and not less than thirty (30) days or more than sixty (60) days prior to such election. Notice shall also be given by posting within such time copies thereof in three (3) public and conspicuous places in the village, one (1) of which shall be the bulletin board of the village hall. Such notice shall state the date upon which the election is to be held, the vacancies to be filled or the purpose for which such election is to be held, as the case may be. (Code 1970, § 12-14) Sec. 10-5. Candidates for office; qualify- ing. (a) Any qualified elector within the village may become a candidate for any office to be filled at any general election by paying to the village clerk a qualifying fee in the sum of ten dollars ($10.00) and by filing with the village clerk during regular hours on the first seven (7) business days in December immediately preced- ing the general election a written notice that he or she intends to be a candidate at such general election. All paperwork must be complete and submitted to the village clerk by 5:00 p.m. on the last day of the qualifying period. Any qualified elector may become a candidate for any office to be filled at any special election by paying to the village clerk a qualifying fee in the sum of ten dollars ($10.00) and by filing with the village clerk, during the ten (10) days ending three (3) weeks before the special election, a written notice that he or she intends to be a candidate at such election. Such written notice shall state the number of the group in which the candidate seeks to be elected, his place of residence, his age and a description of his residence in the village. Such notice shall also request that the name of the candidate be placed upon the ballot to be prepared for such election, and, in addition, shall be signed by such candidate. The village clerk shall supply the names of all candidates and offices to be filled to the Palm Beach County Supervisor of Elections by delivery to that office prior to 5:00 p.m. on the Friday after the close of qualifying. (b) If at any time within seventy-two (72) hours prior to the deadline for the qualifying of candidates as set forth in subsection (a) above, all persons who have qualified for any one (1) office in an election have had their names withdrawn from candidacy for any reason, then the deadline for qualification of candidates for that particular office shall be automatically extended by one (1) week. The village clerk shall cause to be published at the earliest possible § 10-5ELECTIONS 617Supp. No. 77 date, in a newspaper of general circulation in the village, a notice of such extension of time for qualifying for such office. In addition, such notice shall be given by posting a copy thereof in at least three (3) public and conspicuous places in the village, one (1) of which shall be the bulletin board in the village hall. Conduct of elections. (1) Village elections shall be conducted in a proper and legal manner under the supervision of the village clerk and in conjunction with the Palm Beach County Supervisor of Elections. (2) All elections within the village shall be nonpartisan and no ballot shall contain any reference to or insignia of any political party. (Code 1970, § 12-34; Ord. State law reference—Powers of local authorities, F.S. § 316.008. 1171Supp. No. 77 shall be planted a minimum of four (4) feet at grade and shall reach a sufficient height to screen such equipment within two (2) years. Existing hedges or other living vegetation on an adjacent property may be used to provide the required screening, provided, however, that in the event the hedges or other living vegeta- tion on an adjacent property is removed and not replaced so as to provide the required screening, screening shall be provided on the property on which the equipment is located in accordance with the requirements of this section or the equipment shall be removed from the property. Vegetation shall be maintained at all times so as not to encroach onto neighboring properties (if provided on the property on which the equipment is located) or rights-of-way. (9) All such equipment and the associated parking areas shall be kept in a clean, neat and presentable condition. Such equipment shall not be inoperable, wrecked, junked, partially dismantled or abandoned. Major repairs or overhauling shall not be conducted on the site. (10) The village council finds that, as a matter of fact, recreational equipment and camp- ing equipment are customary accessory uses of the land in R-1 and R-2 zoning districts in the village. (11) Such parked equipment shall not be used in the course of any commercial activity. For this purpose, commercial activity shall include any type of business or activity which is conducted on or off the subject premises. (12) Any resident who, on or before November 12, 2020, both (i) owns equipment that does not meet the dimensional require- ments of subsection (6) above or the setback from the rear property line required by subsection (3) above and (ii) has stored such equipment on his or her property, may file an application for a dimensional exception on a form sup- plied by the community development department. No fee shall be charged for such application. (a) An applicant seeking an exception to the dimensional requirements or rear setback requirement shall be required to demonstrate that the applicant meets all other require- ments of this section including, but not limited to, required screening, and that the equipment will not significantly affect the natural light or increase the shadows or shade on an adjacent property to the extent that the storage of the equipment on the applicant's property has a negative impact on the neighbor's enjoyment of his or her property. (b) The application shall be accompanied by the following information: 1. Documentation demonstrating equipment ownership and date of acquisition; 2. Identification of the location of the equipment as evidenced by photographs and/or a sketch; and 3. Identification of the wall, fence or vegetation utilized for screen- ing in relation to adjacent properties as evidenced by photographs and/or a sketch. Upon receipt of a completed applica- tion, village staff will conduct a site visit to verify compliance with the criteria set forth above and may require the applicant to provide additional information to complete the application process. (c) The community development depart- ment shall review the application to ensure it is complete and prepare the necessary documentation for review by the village council. The village council shall approve, approve with conditions or deny the applica- § 18-35.1MOTOR VEHICLES AND TRAFFIC 1181Supp. No. 77 tion. The village council's final determination shall be set forth in a written order. (d) The applicant shall be required to notify all adjacent property owners, including the owners of properties separated from the applicant's property by a public or private right- of-way, of the council's consideration of the dimensional exception applica- tion. Such notice shall be on a form supplied by the community develop- ment department. Ownership shall be determined utilizing the county property appraiser's database. At least seven (7) days prior to the village scheduling the dimensional application for consideration by the village council, the applicant shall provide a notarized certification that such notice has been provided to all adjacent property owners either via first class mail or hand-delivery. No additional notice shall be required. (e) A dimensional exception shall not run with the property and the sale of the property, a change in the occupant of the property, or a change in the ownership of the equipment shall terminate the approval. Once a dimensional exception has been granted by the village council, any increase in the size of the equip- ment or significant alteration of the required screening, including, but not limited to, the removal of a hedge or living vegetation on adjacent property, shall require a new application. Notwithstanding the foregoing, if a resident who has been granted a dimensional excep- tion acquires new equipment of the same or smaller dimension that still exceeds the dimensional require- ments set forth in subsection (6) above, he or she shall be required to apply for administrative approval on a form supplied by the com- munity development department. It shall be unlawful, when signs have been erected giving notice thereof, to stop, stand or park a vehicle in violation of signs regulating or prohibiting the stopping, standing or parking of vehicles. Sec. 18-37. Violations; fines—Handicap spaces. The fine for stopping, standing or parking in handicap parking spaces in violation of F.S. sections 316.1955, 316.1956 shall be in the amount of one hundred dollars ($100.00). (Ord. The fine for stopping, standing and parking a vehicle in violation of provisions, other than handicap parking provisions, of this article shall be in the amount of twenty-five dollars ($25.00). (Ord. Secs. 18-39—18-44. Reserved. ARTICLE IV. GOLF CARTS Sec. 18-45. Definitions. For the purposes of this article, whenever the following words or terms are used in this article, they shall have the meanings ascribed to them in this section, except where the context requires otherwise: Golf cart means a motor vehicle as defined in F.S. § 320.01(22), as amended, that is designed and manufactured for operation on a golf course for sporting or recreational purposes and that is not capable of exceeding speeds of twenty (20) miles per hour. § 18-35.1 NORTH PALM BEACH CODE 1182Supp. No. 77 Private community means a single or multi- family community that is regulated by F.S. ch. 718 (condominiums); F.S. ch. 719 (cooperatives); or F.S. ch. 720 (homeowners' associations). Traffic control device means an approved sign or signs permitting or prohibiting the parking or operation of golf carts on a street, alley, driveway, parking lot or other area, or regulating speed, or regulating parking. (Ord. No. 2021-06, § 2, 4-22-21) Sec. 18-46. Operation of golf carts. (a)Authorization to operate golf carts.In accordance with F.S. § 316.212(1), golf carts meeting the definition set forth in section 18-45 above may be operated within the village on the streets, alleys and parking areas open to the public and designated in this article, and on private property, and within private communi- ties on such private driveways, parking lots, or private streets designated for golf cart use by the private community. Each private community which allows the use of golf carts shall provide adequate traffic control devices advising that it is a "golf cart community,"and regulating the use of golf carts and designating the areas where golf carts may be operated and parked. (b)Compliance with state statutes.All opera- tors of golf carts within the village shall comply with the provisions of the state statutes pertain- ing to the operation of golf carts and of motor vehicles. Any violation of such statute(s) shall also be a violation of this article. Golf cart operators shall comply with all applicable local and state traffic control devices, and operators of golf carts may be issued a citation or summons for traffic and moving violations in the same manner as other motor vehicles. (c)Equipment and minimum standards.All golf carts operated within the Village shall meet the minimum equipment standards established by F.S. § 316.212. Golf carts operated before sunrise and after sunset must be equipped with headlights, brake lights, turn signals, and a windshield. In addition, on the rear of the golf cart, all golf carts shall be equipped with two (2) round red reflectors, each at least three (3) inches in diameter, and affixed to the rear of the golf cart, within six (6) inches of each side edge. In the alternative, a triangular slow-moving vehicle emblem (SMV) approved for use on vehicles by the state department of highway safety and motor vehicles may be affixed to the rear of the golf cart. (d)Designation of certain village streets, county roads and state highways.Golf carts may only be operated within the village as permitted or prohibited below: (1) Operation of a golf cart shall be permit- ted on the roadway portion of all village streets and alleys, unless prohibited by a traffic control device, or as otherwise provided herein, and in general conformance to any lawful traffic control devices. (2) Operation of a golf cart in village parks is prohibited, except where permitted by a traffic control device. (3) Operation of a golf cart is prohibited on any county road or state highway, unless the village shall have first obtained the consent or permission of the county or state, as required by law, and where permitted by a traffic control device. Those road segments include, but are not limited to: U.S. Highway One Northlake Boulevard Prosperity Farms Road Alternate A1A Monet Road (e)Private community enforcement.Golf carts operated within private communities shall be subject to the enforcement of rules and regula- tions established by the private communities, which shall be the sole responsibility of each such community, except where jurisdiction has been granted to the village police department for traffic law enforcement by the community.
