Marino Property Location: 598 Anchorage Drive, North Palm Beach, FL 33408 ("Property") Legal Description: Lot 35, Block 3, Village of North Palm Beach Plat No. 1, according to the plat thereof recorded in Plat Book 24, Page 202 of the public records of Palm Beach County, Florida (PCN: 68-43-42-16-02-003-0350) Request: Application for a Fill Permit pursuant to Section 7-16 of the Village Code to add approximately 130 cubic feet of fell to extend the bank of the Earman River approximately 9.3 feet waterward for the construction of a new vinyl seawall THIS MATTER came before the Village Council for hearing on April 22, 2021. After considering the testimony and other evidence presented by the Applicant and Village Staff, the Village Council hereby makes the following findings of fact: 1. The hearing was properly noticed in accordance with Section 7-17 of the Village Code of Ordinances. 2. Applicant's request does not meet the requirements of Section 7-18 of the Village Code of Ordinances in that the project will potentially create a harmful alteration of the natural flow of the adjacent navigable waters as well as lead to increased erosion of nearby properties. Based on the foregoing findings of fact and the criteria set forth in Section 7-18 of the Village Code of Ordinances, it is ORDERED by the Village Council that the Applicant's request for a Fill Permit is hereby DENIED.
