Declaration of State of Local Emergency pursuant to FL Statutes Sections 870.041-870.048 and Article II, Chap. 8 of VNPB Code of OrdinancesVILLAGE OF NORTH PALM BEACH
DECLARATION OF STATE OF LOCAL EMERGENCY
WHEREAS, pursuant to Section 870.041, Florida Statutes, in the event of overt acts of
violence or the imminent threat of such violence within the Village, local officers are
empowered to declare a local state of emergency to preserve the public peace; and
WHEREAS, Section 8-21 of the Village Code designates the Mayor as the local
authority for preservation of the public peace pursuant to Section 870.041, Florida
Statutes; and
WHEREAS, the Police Chief has determined that there has been an act of violence or a
flagrant and substantial defiance of, or resistance to, a lawful exercise of public authority
and that, on account thereof, there is reason to believe that there exists a clear and
present danger of a riot or other general public disorder, widespread disobedience of
the law, and substantial injury to persons or property, all of which constitute an imminent
threat to the public peace or order and to the general welfare of the Village or a part or
parts thereof; and
WHEREAS, in accordance with Section 8-22 of the Village Code, the Police Chief has
certified to the Village Manager that an imminent threat to the public peace or order
exists, who in turn has made such certification to the Mayor; and
WHEREAS, the Village of North Palm Beach issues this Declaration of State of Local
Emergency in accordance with Sections 870.041-870.048, Florida Statutes and Article
II, Chapter 8 of the Village Code of Ordinances.
NOW, THEREFORE, THE VILLAGE OF NORTH PALM BEACH HEREBY
DECLARES as follows:
Section 1. The foregoing recitals are ratified and incorporated herein.
Section 2. A State of Local Emergency is declared and shall remain in effect for a
period of seventy-two (72) hours unless terminated earlier at the recommendation of the
Police Chief.
Section 3. Pursuant to Section 870.045, Florida Statutes, the following additional
emergency measure shall be in place during for the duration of the state of emergency:
A curfew shall be in effect between the hours of 10:00 p.m. and 6:00 a.m. the
following morning, including the prohibition of pedestrian and vehicular
movement, standing and parking, except for the provision of designated essential

services, including, but not limited to, fire, police and hospital services, including
the transportation of patients thereto, emergency utility repairs and emergency
calls by physicians.
Section 5. A copy of the Declaration of State of Emergency shall be filed with the
Village Clerk and delivered to appropriate news media for publication and radio and
television broadcasts thereof.
