A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, APPROVING THE CREATION OF A
LEAVE BANK FOR ALL EMPLOYEES AS A RESULT OF A DECLARED
STATE OF EMERGENCY WITHIN THE VILLAGE; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Village has declared a State of Emergency in response to the Coronavirus
(COVID-19) pandemic; and
WHEREAS, Village Staff is recommending adoption of a compensation policy which establishes
an "administrative leave bank" for all Village employees to encourage those employees who are
sick, displaying symptoms associated with COVID-19 or have immediate family members who
are sick, displaying symptoms associated with COVID-19 or are highly susceptible to the virus
to remain at home to prevent the spread of the virus; and
WHEREAS, the Village Council determines that that adoption of this Resolution is in the
interest of the public health, safety and welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA, as follows:
Section 1. The foregoing recitals are ratified and incorporated herein.
Section 2. The Village Council hereby approves the creation of an administrative leave bank
for all Village employees. Each full-time exempt and non-exempt employee shall receive eighty
(80) hours. Each part-time employee shall receive the average number of hours he or she works
over a two-week period. The leave bank hours will not accrue and will be lost if not utilized
prior to the end of the next full fiscal year after the conclusion of the state of emergency. By
way of example, administrative leave bank hours accrued during Fiscal Year 2020 must be
utilized prior to the end of Fiscal Year 2021.
Section 3. Non-exempt employees working during the declared state of emergency due to
the COVID-19 pandemic shall be paid at their normal rate of pay and shall not be entitled to
overtime compensation as set forth in Resolution 2019-84. Exempt employees working during
the declared state of emergency due to the COVID-19 pandemic shall not be entitled to
additional administrative leave for hours worked as set forth in Resolution No. 2019-84.
Section 4. All resolutions or parts of resolutions in conflict with this Resolution are hereby
repealed to the extent of such conflict.
Section 5. This Resolution shall take effect immediately upon adoption
