2019-09-26 Order Zoning Variance 11353 Twelve Oaks Way FenceVILLAGE OF NORTH PALM BEACH ZONING BOARD OF ADJUSTMENT ORDER ON VARIANCE APPLICATION Applicant: Twelve Oaks Condominium Association, Inc. Property Location: 11353 Twelve Oaks Way, North Palm Beach, FL 33408 Legal Description: Twelve Oaks, according to the plat thereof recorded in Plat Book 31, Page 48 of the public records of Palm Beach County, Florida (PCN: 68-43-42-04-20-001-0000) Request: Variance from Section 45-36(D) of the Village Code of Ordinances, which limits the height of walls and fences to six (6) feet, in order to construct a fence eight (8) feet in height. THIS MATTER came before the Planning Commission sitting as the Zoning Board of Adjustment on September 10, 2019. After considering the testimony and evidence presented at the hearing and being otherwise duly advised, the Board of Adjustment hereby makes the following findings of fact: 1. The public hearing was properly noticed in accordance with Section 21-3 of the Village Code of Ordinances. 2. Applicant's request, in part, meets the requirements for the grant of a variance set forth in Section 21-21(c)(2) of the Village Code of Ordinances. Based on the foregoing findings of fact, it is ORDERED and ADJUDGED by the Board of Adjustment that Applicant's request for a variance from Section 45-36(D) of the Village Code of Ordinances to allow for a fence eight (8) feet in height is hereby APPROVED subject to the following conditions: Applicant shall construct the fence in substantial conformance with the plan submitted up to a maximum of 342 linear feet along the west property line between the north property line of the adjacent Pelican Car Wash and the south property line of the adjacent Chase Bank. The fence shall not exceed eight (8) feet in height as measured from the grade of the Applicant's Property and shall be constructed within twelve (12) inches of the existing fence or wall. Page 1 of 2 2. The fence shall be constructed of pressure treated wood consistent with existing fences located on the Property. 3. Applicant shall obtain all necessary permits and government approvals for the fence, including easement release forms from the applicable utility companies. DONE AND ORDERED this Z day of 2019.
