2019-08-06 Order Zoning Variance 631 Northlake Blvd. Lott BrothersVILLAGE OF NORTH PALM BEACH ZONING BOARD OF ADJUSTMENT ORDER ON VARIANCE APPLICATION Applicant: Gary Brandenburg, Esquire (agent) on behalf of George H. Lott, Jr. and John R. Lott (property owners). Property Location: 631 Northlake Boulevard, North Palm Beach, FL 33408 Legal Description: Lot 16 and a portion of Lot 15, Block 37, Village of North Palm Beach Plat No. 3, according to the plat thereof recorded in Plat Book 25, Page 175 of the public records of Palm Beach County, Florida (PCN: 68-43-42-16-04-037-0152) Request: Variance from Section 5-84(6) of the Village Code of Ordinances, which requires that a pier be no wider than six feet and no closer to the side property line than half its extension waterside, and Section 5-84(11) of the Village Code of Ordinances, which requires that dolphins and mooring posts be located inside the side property line extended, to allow for: an existing pier ten feet in width; the reconstruction of a pier beyond the side property line extended; and the installation of mooring piles 17.5 feet beyond the side property line extended. THIS MATTER came before the Planning Commission sitting as the Zoning Board of Adjustment on August 6, 2019. After considering the testimony and evidence presented at the hearing and being otherwise duly advised, the Board of Adjustment hereby makes the following findings of fact: 1. The public hearing was properly noticed in accordance with Section 21-3 of the Village Code of Ordinances. 2. Applicant's request meets the requirements for the grant of a variance set forth in Section 21-21(c)(2) of the Village Code of Ordinances. Based on the foregoing findings of fact, it is ORDERED and ADJUDGED by the Board of Adjustment that Applicant's request for a variance from Section 5-84(6) and Section 5-84(11) of the Village Code of Ordinances to: allow for an existing pier ten feet in width; the reconstruction of a pier beyond the side property line extended; and the installation of mooring piles 17.5 feet beyond the side property line extended is hereby APPROVED subject to the following conditions: Page 1 of 2 1. Applicant shall provide a survey for building permit approval to ensure that the dimensions provided on the dock plan are accurate. 2. Applicant shall substantially comply with the submitted dock plan with Village Staff dimensions. 3. Applicant shall obtain all necessary permits and government approvals for the demolition of the existing dock and the construction/installation of the proposed dock, piers and mooring piles. 4. Applicant shall ensure that the Property is in compliance with all previous site plan and landscape plan approvals. DONE AND ORDERED this _ day of 2019.
