2019-09-26 Order Zoning Variance 740 Alamanda Drive FenceVILLAGE OF NORTH PALM BEACH ZONING BOARD OF ADJUSTMENT ORDER ON VARIANCE APPLICATION Applicant: Jordan A. McInnes Property Location: 740 Alamanda Drive, North Palm Beach, FL 33408 Legal Description: Lot 9, Block I, Village of North Palm Beach Plat No. 4, according to the plat thereof recorded in Plat Book 25, Page 229 of the public records of Palm Beach County, Florida (PCN: 68-43-42-17-09-009- 0090) Request: Variance from Section 45-36(D) of the Village Code of Ordinances, which requires that on corner lots, walls or fences shall not exceed four (4) feet in height for a distance of twenty feet (20) from the side property line, to allow for a fence six (6) feet in height a distance of five (5) to fourteen (14) feet from the side property line. THIS MATTER came before the Planning Commission sitting as the Zoning Board of Adjustment on September 10, 2019. After considering the testimony and evidence presented at the hearing and being otherwise duly advised, the Board of Adjustment hereby makes the following findings of fact: 1. The public hearing was properly noticed in accordance with Section 21-3 of the Village Code of Ordinances. 2. Applicant's request, in part, meets the requirements for the grant of a variance set forth in Section 21-21(c)(2) of the Village Code of Ordinances. Based on the foregoing findings of fact, it is ORDERED and ADJUDGED by the Board of Adjustment that Applicant's request for a variance from Section 45-36(D) of the Village Code of Ordinances to allow for a fence six (6) feet in height within twenty (20) feet of the side property line is hereby APPROVED subject to the following conditions: Applicant's request for a variance is approved only for the side property line along Buttonwood Road in conformance with the Fence Location Plan submitted by Applicant (no closer than five (5) feet from the side property line on the west side of the home and no closer than fourteen (14) feet from the side property line on the southwest end of the Property). The Page 1 of 2 proposed fence must meet all Village Code requirements for the side property line along Alamanda Drive. 2. Applicant shall provide a continuous hedge between the fence and the existing sidewalk along Buttonwood Road. 3.
