CARPER FOR WATER SERVICE LINE FROM LIGHT}{OUSE DRIVE TO NF,W ' OSBORNF, PARK BUILDING. BE IT RESOLVED BY THE VILLAGF. COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village of North Palm Beach hereby ac- cepts that certain Grant of Easement from Robert W. Carter sub- ject to the conditions set forth therein, a copy of which is attached hereto and by reference made a part of this Resolution. Section 2. CARTER of the County of Palm Beach, State of Florida, GRANTOR, and THE VILLAGE OF NORTH PALM BEACH, a municipal corporation, organized and existing under the laws of the State of Florida, GRANTEE: WHEREAS, the Grantor is seized in fee simple and in possession of lands described below; and WHEREAS, Grantor has agreed in consideration of the sum of of Ten ($10.00) Dollars and other good and valuable consideration received from Grantee to grant to Grantee and all other parties claiming through, by or under Grantor for any of them, his predecessors in title, or his heirs, assigns or legal representatives an easement or right-of-tvay over the land described below for the purpose and manner expressed below: NOW, THIS INDENTURE WITNESSETH: In pursuance of this Agreement and the consideration of Ten ($10.00) Dollars and other good and valuable consideration, receipt of which is hereby acknowledged, Grantor grants unto Grantee, its successors and assigns an easement for the construction, installation and maintenance of water main, sewer main, and other public utilities over the following described property of the Grantor, to wit: The easterly five (5) feet of the following described parcel; Lot 27, less the West 22.75 feet there of and the West 36.20 feet of Lot 28, Block D, Village of North Palm Beach, Plat No. 4, Palm Beach County, Fla., according to the plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach ' County, Fla., recorded in Plat Book 25, page 229 and 230, otherwise described as 816 West Lighthouse Drive. /~ , , To have and to hold the easement or right-of-way hereby granted to Grantee, its successors and assigns for use as public utilities easement for the installation, construction and maintenance of water, sewer and drainage facilities by the Grantee. IT IS FURTHER UNDERSTOOD that Grantor, his heirs, successors and assigns, do not assume any liability or responsibility to Grantee or any person using easement by invitation, expressed or implied by Grantee, or by reason of any business conducted thereon by Grantee, its successors or assigns or othercvise.
