A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA, STRONGLY URGING THE PUBLIC SERVICE COMMISSION, THE DEPARTMENT
OF ENVIRONMENTAL REGULATION, THE PALM BEACH COUNTY ENVIRONMENTAL CONTROL
OFFICER, THE STATE OF FLORIDA DEPARTMENT OF HEALTH AND REHABILITATIVE
SERVICES, AND THE PALM BEACH COUNTY HEALTH DEPARTMENT TO INVESTIGATE AND
TAKE. ALL POSSIBLE STEPS TO ABATE THE VILE AND NAUSEOUS ODOR EMANATING
FROM THE PALM BEACH COUNTY UTILITY COMPANY SEWAGE PLANT LOCATED WITHIN
THE VILLAGE OF NORTH PALM BEACH.
WHEREAS, Palm Beach County Utility Company, Inc. owns and
maintains a sewage treatment facility within the corporate limits of the
Village of North Palm Beach, and
WHEREAS, said facility has been located by the private utility
in the middle of an entirely residential area, and
WHEREAS, periodically and frequently through malfunctions or
overloading or inattention to proper operation of the said sewage treat-
, ment plant, vile, nauseous and debilitating odors emanate from that facility
and spread across the residential area permeating a substantial number
of homes in the Village of North Palm Beach, and
Wt{EREAS, the aforesaid odors adversely affect the health,
welfare and enjoyment of life of hundreds of North Palm Beach residents,
who are unable to otherwise protect themselves, their families, their
guests and their homes from this lingering putrid odor, and
WHEREAS, control over the Palm Beach County Utility Company's
sewage plant located within the Village of North Palm Beach rests in
large measure with agencies outside the control of the municipal govern-
ment;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH
PALM BEACH, FLORIDA:
Section 1. That the Department of Environmental Regulation,
the Palm Beach County Environmental Control Officer, the State of Florida
Department of Health and Rehabilitative Services, the Palm Beach County
}tealth Department and the Florida Public Service Commission are hereby
earnestly and strongly requested to investigate and determine the cause
or causes of the periodic stenches emanating from the sewer plant and
entering the homes of Village residents located nearby, and upon deter-
mining the cause, to thereupon institute any and all measures to assure
' the residents and property owners in North Palm Beach that the air
t}iey breathe at their own homes in residential districts will not be
befouled by sewage odors.
Section 2. The Village Clerk is directed to forward copies
of this Resolution to the utility company and the governmental bodies
referred to above.
Section 3. This Resolution shall take effect immediately
upon passage.
