A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEAC}{~
FLORIDA, GKANTING A CONSTRUCTION PERMIT FOR A NAVIGATION CANAL IN THE
RIG}[T-OF-WAY OF THF, INTRACOASTAL WATERWAY EAST OF PARKER BRIDGE.
' WHEREAS, The Village Council of North Palm Beach, Florida,
after public hearing has determined that the proposed dredging by Gen-
oral Portland Land Development Company of a navigation canal eighty feet
wide and eight feet deep located 900 feet East of Parker Bridge at
Station 25+15, all of which is more clearly defined on the application
for permit, copy of which is attached to this Resolution and by reference
made a part hereof, is not violative of any statute, zoning law or other
restriction; and
WHEREAS, the Village Council has determined that the construction
of such navigation canal will present no harmful obstruction to or
alteration of the natural flow of the navigable water adjacent thereto,
that no harmful or increased erosion, shoaling of channels or stagnant
areas of water will be created thereby, and that no material injury or
monetary damage to adjoining land will accrue therefrom; and
WI[EREAS, the Village Council has determined that the granting
of such permit and the construction to be done pursuant thereto would
not interfere with the conservation of fish, marine and wildlife or other
natural resources to such an extent as to be contrary to the public in-
terest; and
W}{EREAS, the Village Council has considered other factors
affecting the public interest;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
NORT}[ PAIM BEACH, FLORIDA:
' Section 1. The Mayor and the Village Clerk are hereby aut}iori-
zed and directed to sign and issue a construction permit to General
Portland Land Development Company to dredge and construct a navigable
canal eighty feet wide and eight feet deep located 900 feet East of
Parker Bridge, in accordance with the application attached hereto,
marked Exhibit 1 and by reference made a part of this Resolution.
Section 2. It is a condition of this construction permit
t}iat no bulkheading will be constructed along that portion of the canal
' referred to above which is adjacent to the cross-hatched area on the
application permit attached to this Resolution as Exhibit 1.
Section 3. The construction permit shall be subject to approval
by the Board of Trustees of the Internal Improvement Trust end of the
State of Florida and the permit shall expire two years from date.
