Lukasik, Village Manager FROM: Denise Malone, AICP, CDD Director DATE: October 12, 2017 SUBJECT: PUBLIC HEARING AND COUNCIL DISCUSSION — Advisability of issuing the fill permit requested by Chris Harris for the property located at 764 Waterway Drive. Chris Harris, the property owner, filed an application to fill in an area within the bulkhead line and property line of the property located at 764 Waterway Drive. According to Village property file records, the subject area, approximately 18' by 18', was dredged prior to 1966 for boat mooring. The current property owner, Mr. Harris, wishes to fill in the property to allow for additional green space and mitigate safety concerns on the property. The Village Code of Ordinances advertising and review criteria require that a fill permit be reviewed by Village Council at two public meetings. The first meeting is required to be an advertised public hearing (October 12, 2017), where Village Council will consider the advisability of issuing a fill permit at this location. Should Village Council make the determination that it is advisable to issue said permit, Council could then approve the issuance of the fill permit at the second public meeting, which is currently scheduled for the October 26, 2017 Village Council meeting. Public Notice The legal advertisement was published in the newsletter on October 1, 2017. The property was posted on October 2, 2017. On October 2, 2017, legal advertisements for this item were also posted on the Village webpage and on bulletin boards at Village Hall and the Village Library. Analysis The proposed fill permit meets the Florida Building Code and Section 7-18 of the Village Code of Ordinances regarding issuance requirements for fill permits. The applicant has secured a permit from the Army Corps of Engineers for the proposed area to be filled as required. As the applicant is proposing to fill within the property's bulkhead line and property line, the Village is able process the subject request. Filling outside of a property's bulkhead line is prohibited per Section 7-2 of Village Code of Ordinances. The full analysis of the proposed fill permit is included in the attached staff report. There is no fiscal impact. Recommendation: Village Administration seeks Council discussion on the advisability of issuing a fill permit at 764 Waterway Drive within the property's bulkhead and property lines in accordance with Village policies and procedures. Staff is recommending approval of the subject fill permit within the site's bulkhead and property lines.
