FLORIDA, AUT}IORIZING AND DIRECTING THE VILLAGE MANAGER TO EMPLOY
THF, LAW FIRM OF NASON, GILDAN &YAEGER, PI+A. TO REPRESENT T}{E DF,FEN-
DANTS IN T}{E CAUSE ENTITLED "THE STATE OF FLORIDA UPON RELATION
OF ROYAL AMERICAN
INC., A FLORIDA CORPORATION, VS.
T}[OMAS F. LEWIS, MAYOR, ET AL." AND SETTING FORTH PROVISIONS FOR
PAYMENT OF FEES AND COSTS IN CONNECTION THEREWITH.
W}iEREAS, The State of Florida upon relation of Royal
American Industries, Inc., a Florida corporation, has sued the
Mayor, Vice Mayor, Members of the Village Council, the Village
Building Inspector, and the Village of North Palm Beach, all
jointly and severally, and
WHEREAS, said law suit seeks a mandatory injunction requir-
ing the Building Inspector to issue building permits to plaintiff
to construct a twelve-story bpartment house upon real property
described in the complaint, and
W1}EREAS, because of the above styled law suit and for
the protection of the public health, safety, welfare and property,
immediate legal action must be taken to properly safeguard the
rights of the citizens of the Village of North Palm Beach, to insure
t}iat any acts of the Village Council or Building Inspector are
proper and legal, to insure the proper defenses of the above styled
cause, to insure the legality of the Council's acts and the Building
Inspector's acts in performing their prescribed duties, it is
imperative that legal counsel be retained;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL

0}' NORTH PALM BEACH, FLORIDA:
Section 1. The Village Manager is hereby authorized and
directed to employ the law firm of NASON, GILDAN & YAEGER, P.A.
as legal counsel to represent the defendants in a cause entitled
"The State of Florida upon relation of Royal American Industries,
Inc., a Florida corporation, vs. Thomas F. Lewis, Mayor, et al.,
Case No. 70 C 1115-Smith, in the Circuit Court of the Fifteenth
' Judicial Circuit of Florida, in and for Palm Beach County, Civil
Action" or such additional counsel as may be needed to adequately
and fully defend the legal rights of the defendants. The Village
Manager is further directed to establish budgetary reserves for the
cost of defending said law suit and to pay all reasonable and
necessary costs incurred by the Village of North Palm Beach in
connection therewith.
