A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BF.AC}[,
FLORIDA, AUTHORIZING AND DIRECTING THE VILLAGE ATTORNEYS TO IN-
S7'ITUTF. LEGAL PROCEEDINGS CONCERNING LOTS 1, 2, 3 AND 4, BLOCK
54, PLAT N0. 6 OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA.
WHF.RF,AS, Lots 1, 2, 3 and 4, Block 54, Plat No. G of the
Village of North Palm Beach are shown on the Official Zoning Map
of the Village as being in zoning districts R-1 and R-2, and
W}[ERF,AS, Ordinance No. 44 of the Village of North Palm
Beach enacted in December, 1958 purports on its face to zone
t}ie R-1 sections of these lots into Zoning District C-lA, and
WI[EREAS, procedural and substantive questions have arisen
concerning the validity of the attempted rezoning set forth in said
ordinance, and
W}[F,REAS, the owners have applied for a permit to erect
' a twelve-story building on said lots, and
WHEREAS, numerous residents in the vicinity of these
lots purchased their lots in the belief that the nearby zoning
was single family, and
W}{EREAS, the Village Council desires to protect the
property rights of all interested parties prior to considering
granting a permit to construct a twelve-story building on the
above-described lots,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OP NORTH PALM BEACH, FLORIDA:
Section 1. The Village Attorneys, NASON, GILDAN &
' YAEGER, P. A., are hereby authorized and directed to take all
~iecessary and proper steps to have the question of law concerning
the zoning classification of Lots 1, 2, 3 and 4, Block 54, Plat No.
G of the Village of North Palm Beach, Florida decided by the appro-
priate Court.
Section 2. The Village Manager and other Village
employees are hereby directed to render whatever assistance is
necessary in having this question determined.
