A RESOLUTION OF THE VILLAGE: COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
AUTHORIZING THE VILLAGE ATTORNEY TO SETTLE THAT CERTAIN LAWSUIT BY PATRICIA KILPATRZCK, ET AL
US, THE VILLAGE OF NORTH PALM BEACH, FLORIDA.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Village Attorney be and he is hereby authorized to stipulate with counsel
for Patricia Kilpatrick and Roger L. Myers on behalf of themselves and all the taxpayers of the
Village of North Palm Beach, State of Florida, as plaintiffs versus the Village of North Palm
Beach, a municipal corporation under the laws of the State of Florida; Thomas F. Lewis, Thomas
R, Bell, Gordon G. Duncan, Allan V, Everard, and Herbert A. Watt, as in constituting the duly
elected qualified and acting Village Council of the Village of North Palm Beach; and Frank R,
Spence as Village Manager and Clerk of the Village of North Palm Beach, State of Florida,
defendants, in that certain suit in the Circuit Court of the Fifteenth Judicial Circuit of
Florida, in and for Palm Beach County, in Chancery No. 65 C 1477-F by having said lawsuit
dismissed with prejudice, in that the issues in said lawsuit have become moot and the plaintiffs
have agreed that said lawsuit may be dismissed as set forth herein.
Section 2. Each of the parties shall bear his own costs incurred in the prosecution
and defense o£ said lawsuit.
