MINUTES OF A REGULAR MEETING OF
THE VILLAGE COUNCIL OF NORTH PALM BEACH
HELD IN ITS OFFICES AT NORTH PALM BEACH COUNTRY CLUB

The minutes of a regular meeting held on December 10, 1957, at 3:00
p.m. in the North Palm Beach Country Club were read by the Village Clerk and
approved upon motion of Councilman Schwencke, seconded by Councilman White,
all members voting aye.
The following recapitulation of building activity conducted within
the Village during the year 1956 was submitted to the Council by the Building
Official:

Village of North Palm Beach, Florida
Gentlemen:
Below is the building report at North Palm Beach for the year ending
December 31, 1956.
Ground was broken for the first unit of the Parade of Homes on July
18. The builder was Kendall Construction Company. Seventeen homes
were completed by the opening date on October 27,
These seventeen homes together with the several swimming pools and
fences represent a total construction cost estimated at $339,564.
This does not include the land value or the landscaping.
During November, twelve homes were started. They represented an
estimated construction cost of $228,868. Three of these homes are
presently completed and ready for occupancy. _
During December, ten homes representing an estimated $169,976 construc-
tion cost were started.
The total estimated construction cost of all homes started and completed
by the end of the year is $750,000.
Your Building Official did not begin collecting permit fees until
December 10. No permits were issued or fees collected in the case of
the 29 homes started and/or completed prior to this date. Between
December 10--December 31, however, $523,95 was collected for building
permits only. We expect the plumbing, electrical, and gas permit fees
on ten units to be paid in the near future,
Presently, there are seven families living in the Village - five in the
Parade of Homes, two in recently completed homes. All families seem to
be pleased with having a part of the development.
We expect the Village Hall to be ready for occupancy within a short time.
This should bring a closer administrative relationship and better control
of all field activities.

Mayor Cunningham reported further conversations with representatives
of several property owners residing in an area east of Lake Worth. This group
has under consideration making a request their properties be annexed to the
Village of North Palm Beach. The Mayor stated discussions had not been concluded
and that further meetings would be scheduled with the representatives.
' The Village Treasurer made the following financial report to the Council:

The following offer received from North Paim Beach, Inc., to dedicate
certain canals to the Village of North Palm Beach was read to the Council by the
Village Clerk:
To: Village of North Palm Beach, a municipal corporation organized and
existing under and by virtue of the laws of the State of Florida
The undersigned, North Palm Beach, Inc., a corporation organized and
existing under the laws of the State of Florida, hereinafter referred to as
the grantor, makes the hereinafter stated offer to dedicate to the above
named Village of North Palm Beach, a municipal corporation hereinafter
referred to as the grantee, certain canals, as described herein, subject to
the terms and conditions stated below:
WHEREAS, the grantor is the owner of the "North Palm Beach Waterway",
"Azure Lagoon", `Blue Lagoon" and "Coral Lagoon", as delineated upon and
' described in Plat of the Village of North Palm Beach, Plat #l, according to
the Plat thereof recorded in Plat Book 24 at pages 202 through 206 inclusive,
Public Records of Palm Beach County, Florida, and
WHEREAS, the grantor is desirous of dedicating the said waterway and
lagoons to the Village of North Palm Beach, subject to such regulatory
ordinances as may be enacted by the grantee and subject to the terms and
conditions stated below.
NCW THEREFORE, the grantor does hereby offer to dedicate said waterway
and lagoons to the grantee subject to the following terms and conditions:
1. The waters of said waterway and lagoons shall be subject to the
joint and several uses of the present and future owners of lots shown on
said Plat #1 of .the Village of North Palm Beach and said present and future
owners shall have the right in favor of themselves, their families, their
tenants and their guests to full access, use and enjoyment of said waterway
• and lagoons for purposes of swimming, boating, fishing and other lawful
purposes and uses which may be exercised without committing a trespass upon
the lot or property of other owners within the said Plat and which does not
result in the creation of a nuisance to other lot or property owners within
said Plat; PROVIDED, however, that said access, use and enjoyment shall not
be exercised for any commercial purpose or for any purpose of obtaining
profit .
' 2. The said waterway and lagoons shall be considered as an integral
part of the drainage system of the area and shall therefore be subject to
use for drainage purposes to the extent necessary and desirable for the
proper drainage of adjacent areas and the grantee ishereby granted full
and complete right and authority to enter upon said waterway and lagoons
for the purpose of cleaning of, and proper maintenance of said waterway
and lagoons.
' 3. The owners of lots abutting on the said waterway and the owners
of lots abutting on said lagoons shall have the right to erect, build,
install or construct tie poles, dolphins, mooring piles, docks and piers

in'the waters of said waterway and lagoons abutting their respective lots;
PROVIDED, that no dolphin, mooring pile or tie pole shall be placed more
than 20 feet beyond the bulkhead and no dock or pier shall extend more than
15 feet beyond the bulkhead. And PROVIDED FURTHER, that no boat canal or
other waterway shall be dug or excavated into any of the water-front-lots
and no lot or parcel shall be increased in size by filling in the water on
which it abuts. The grantee is hereby granted the full right to enforce,
by ordinance or otherwise, the provisos contained in this paragraph.
4. This offer is also subject to the condition that the Village of
North Palm Beach accept this offer by written resolution and thereby agree
to maintain the said waterway and lagoons as an integral part of the
drainage system of the Village and for the use and benefit of its residents
and cftizens.as herein set forth.
5, The waters of said waterway and lagoons may also be used by all
of the residents and citizens of said Village of North Palm Beach subject,
however, to all of the terms and conditions herein stated.
IN WITNESS WHEREOF the undersigned, North Palm Beach, Inc. has
executed this offer to dedicate subject to all the provisions hereof this

Upon motion of Councilman Schwencke, seconded by Vice Mayor Ross, all
members voting aye, a resolution (See Resolution #10, Resolution Book #1, page 10)
accepting the offer of North Palm Beach, Inc., to dedicate certain canals ,to the
Village of North Palm Beach was approved.
Upon motion of Councilman Schwencke, seconded by Vice Mayor Ross, all
members voting aye, a resolution (See Resolution #11, Resolution Book #1, page 11)
accepting the dedication by North Palm Beach, Inc., of all drives, lanes, places,
roads and other rights of way as shown on recorded subdivision plat entitled
"Village of North Palm Beach, Plat #1" to perpetual use of the public for public
road and street purposes was approved.
Upon motion of Councilman Schwencke, seconded by Vice Mayor Ross, all
members voting aye, proposed Ordinance #7 entitled
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, REGULATING THE BUSINESS OF MANUFACTURING, SELLING OR
. IN ANYWISE DEALING IN LIQUORS, WINES, BEERS OR OTHER BEVERAGES CONTAIN-
ING MORE THAN ONE PER CENTUM OF ALCOHOL BY WEIGHT: REQUIRING LICENSES AND
PROVIDING LICENSING PROCEDURE AND FEES; LIMITING THE NUMBER OF LICENSES
TO BE ISSUED AND WHERE SAME CAN BE ISSUED; CLASSIFYING LICENSES; REGULATING
TO WHOM ALCOHOLIC BEVERAGES MAY BE SOLD, THE HOURS OF SALE; PROVIDING
PENALTIES; AND FOR OTHER PURPOSES.

The Council discussed the need for a Village ordinance requiring parkway
areas fronting dwelling units to be sodded. The Village Attorney was requested to
prepare such an ordinace for the Council's further consideration.
' The matter of appointment of a Village Judge was discussed by the Council.
It was determined to hold the matter in abeyance until the next regular meeting at
which time candidates for the position would~be considered.

The Village Building Official requested the Council consider the
need For an ordinance regulating the construction and maintenance of swimming
pools within the Village. Upon motion of Councilman Schwencke, seconded by
Councilman White, all members voting aye, the matter was referred to a commit-
tee for further study. Mayor Cunningham appointed Vice Mayor Ross and Council-
, man White committee members.
The Village Manager was instructed to make inquiry as to the lowest
fire insurance rate grade a community of the size and circumstances of North
Palm Beach could expect to achieve and to advise the Council of the specific
defense and protective requirements necessary for the Village to be assigned the
low rate grade. The Council indicated its desire to effect those requirements
' necessary for the Village to secure the lowest possible rating consistent with
practical economics.
The Village Manager was instructed to complete and forward an appli-
cation to the Florida League of Municipalities requesting the Village of North
Palm Beach be considered for membership. The annual membership dues were stated
• to be $25.
The Village Manager was instructed to meet with Dr. J. Edwin Obert,
SOS Anchorage Drive, to discuss his of ter to serve as Village Physician and to
advise the Council at its next regular meeting.
Upon motion of Councilman Schwencke, seconded by Councilman White,
all members voting aye, the attached Iist of accounts payable were approved
for payment:

Upon motion of Councilman White, seconded by Vice Mayor Ross, all
members voting aye, Resolutions #12, 13, 14, I5, and 16 (See Resolution Book #1,
pages 12-16) appointing Messrs. George W. English, Tr., Edward F. Stumpf,
Milton N. Weir, Norman D. Rowland, and John D. MacArthur, respectively, Honorary
Lieutenant of Police of the Village of North Palm Beach were approved. The
Village Clerk was instructed to forward copies of the resolutions to the
appointees.
There being no further business to come before the Council, on motion
