03-19-2001 VC SP-M• MINUTES OF THE SPECIAL SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD MONDAY, MARCH 19, 2001 Present: Joseph A. Tringali, Mayor Dr. Edward M. Eissey, Vice Mayor David B. Norris, President Pro Tem Donald G. Noel, Councilman Charles R. O'Meilia, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, CMC, Village Clerk ROLL CALL: The Special Session was called to order at 7:00 p.m. All members of Council were present. All members of staff were present. ADDITIONAL FEES -STRUCTURAL ANALXSIS O_ F LIGHTHOUSE DRIVE BRIDGE - DENIED A staff report was given regarding the invoicing for this project, which stated a billing discrepancy of $586.93, caused by some changes made in job titles, as well as a 10%_ markup for a subcontractor's invoice. Councilman O'Meilia moved to authorize hiring of a subcontractor to conduct a structural analysis of Lighthouse Bridge, and to approve payment in the amount of $4,500. The motion died for lack of a second. Councilman Noel moved to approve the payment ($4,500) less the amount over-billed on that project in the amount of $586.93. Councilman O'Meilia seconded the motion. The motion died 2 3, with Councilnan Noel and Councilman O'Meilia voting aye, and President Pro Tem Norris, Vice Mayor Eissey and Mayor Tringali voting nay. ADDITIONAL FEES -LIGHTHOUSE DRIVE TRAFFIC CALMING -DENIED Councilman O'Meilia moved to approve additional funding in the amount of $6,636.95 for services rendered in preparation of the Lighthouse Drive Traffic Calming Project, as submitted by Village Engineer per letter dated 11/27/00. The motion died for lack of a second. C~ Minutes of Special Session Held Monday, March 19, 2001 • President Pro Tem Norris moved to deny the request for payment. Councilman Noel seconded the motion. The motion passed 3-2, with President Pro Tem Norris, Councilman Noel and Vice Mayor Eissey voting aye, and Councilman O'Meilia and Mayor Tringali voting nay. DREDGING PROJECT -PHASE II Councilman Noel moved to advertise Request for Proposals from firms for Phase II of the Village's dredging project. President Pro Tem Norris seconded the motion. During discussion, Mr. Hogarth reported that the permit for Phase I has not been issued yet, and pennitting for Phase II would probably take 6 to 8 months, and estimated that it would probably take eight weeks to find a new engineer and bring him up to speed on Phase I. Mr. Dan Clark of Lindahl, Browning, Ferrari and Hellstrom, Inc. (LBFH) addressed the Council regarding the billing discrepancies and offered full cooperation and assistance in any audit process to clear the air with the Village, as well as the fum. Mr. Clark also stated that, in their work, they conduct much of it with consultation with staff. Additionally, Mr. Clark apologized for any inconvenience caused by the errors, assuring the Council that it had been unintentional. Mr. Clark stated that LBFH does not wish to be considered for Phase II and that another consulting firm be sought. Thereafter, the motion passed 5-0. - Councilman Noel requested that a review of all the Village Engineer's billing from 1996 to the present be conducted by Haas, Diaz & Company, the Village's auditing team. This will be placed on the April 12, 2001 agenda. REQUEST FOR QUALIFICATIONS -CONSULTING ENGINEER Vice Mayor Eissey moved to reopen the Request for Qualifications and extend the period for two weeks past the date of publication. President Pro Tem Norris seconded the motion, and all present voted aye. ADJOURNMENT With no further business to come before the Council, the meeting adjourned at 8:50 p.m. Kathleen F. Kelly, CMC.
