07-26-2001 VC REG-M MINUTES OF THE REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JULY 26, 2001 Present: David B. Norris, Mayor Dr. Edward M. Eissey, Vice Mayor Donald G. Noel, President Pro Tem Charles R. O'Meilia, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, CMC, Village Clerk Absent: ROLL CALL: Joseph A. Tringali, Councilman Mayor Norris called the meeting to order at 7:30 p.m. All members of the Council were present except Councilman Tringali, who was absent due to illness. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Norris gave the invocation, and President Pro Tem Noel led the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES The following Minutes were approved as written: Minutes of Regular Session held 7/12/01 Minutes of Public Hearing held 7/12/01 REPORT OF THE MAYOR Mayor Norris announced that Item 4.c. of the Workshop Agenda had been withdrawn from the agenda. Staff was directed to lower the flags to half mast on Friday, July 27, 2001 in remembrance of the Korean War Armistice. Minutes of Regular Session Held July 26, 2001 CONSENT AGENDA APPROVED Councilman O'Meilia moved to approve the Consent Agenda. Vice Mayor Eissey seconded the motion, and all present voted aye. The following items were approved: a. Accepted for file the Minutes of the Planning Commission Public Hearing held 6/12/01 b. Accepted for file the Minutes of the Planning Commission meeting held 6/12/01 c. Accepted for file the Minutes of the Recreation Advisory Board meeting held 7/10/01 d. Adopted Resolution 62-01 authorizing and directing the Mayor and Village Clerk to enter into a first amendment to the Agreement between the Village and Richard E: Cavanah, Inc., dated Apri13, 2001 which provides that Richard E. Cavanah, Inc. shall be responsible for and pay all taxes, including ad valorem taxes, levied by governmental authorities. e. Adopted Resolution 63-01 authorizing and directing the Mayor and Village Clerk to enter into a first amendment to the Agreement between the Village and Marcel Agnolin, dated Apri13, 2001, which provides that Marcel Agnolin shall be responsible for and pay all taxes, including ad valorem taxes, levied by governmental authorities. BILL 1036 - AMENDING COUNTRY CLUB BUDGET FOR FY 2001-2002 TO APPROPRIATE FUNDS FOR VARIOUS LINE ITEMS AT NPBCC -ENACTED AS ORD. 19-2001 Vice Mayor Eissey moved that Bill 1036 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH COUNTRY CLUB FUND BUDGET FOR THE FISCAL YEAR 2000-2001 IN THE AMOUNT OF $47,000.00, TO INCREASE APPROPRIATION IN THE LINE ITEM ACCOUNTS FOR THE NEW POOL AND TENNIS CONTRACTS, CERTAIN UTILITIES ACCOUNTS AND EMERGENCY PLUMBING REPAIR FOR THE CLUBHOUSE Be placed on second reading and read by title alone. President Pro Tem Noel seconded the motion, and all present voted aye. 2 Minutes of Regular Session Held July 26, 2001 BILL 1037 -BUDGET AMENDMENT FOR CONROY DRIVE WATER MA_ IN -ENACTED AS ORD. 20-2001 Councilman O'Meilia moved that Bill 1037 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH CAPITAL PROJECT FUND BUDGET TO APPROPRIATE FUNDS IN THE AMOUNT OF $76,000.00 FOR CONROY DRIVE WATER MAIN Be placed on second reading and read by title alone. President Pro Tem Noel seconded the motion, and all present voted aye. Councilman O'Meilia moved that Bill 1037 be enacted as Ordinance 20-2001. BILL 1038 - COMPREHENSIVE_ PLAN SMALL SCALE AMENDMENT 01-01 -ENACTED AS ORD. 21-2001 Vice Mayor Eissey moved that Bill 1038 entitled: AN ORDINANCE OF THE VILLAGE OOUNCIL OF_ THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING SMALL SCALE AMENDMENTS DESIGNATED AS 01- 1.1 AND O1-1.2 TO_THE ADOPTED COMPREHENSIVE PLAN FOR THE VILLAGE OF NORTH PALM BEACH, FLORIDA, PURSUANT TO ~'HE .LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND LAND DEVELOPMENT REGULATION ACT, AS AMENDED, BE1NG SECTIONS 163.3161, ET SEQ., FLORIDA STATUTES, WHICH AMENDMENTS ARE ATTACHED AS EXHIBIT "A" AND INCORPORATED HEREIN BY REFERENCE; PROVIDING FORA REVISION TO THE FUTURE LAND USE MAP SERIES ELEMENT; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL. SOCIAL SECURTI'Y OF THE CODE -PLACED ON FIRST READING Councilman O'Meilia moved that Bill 1039 entitled: • Minutes of Regular Session Held July 26, 2001 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2-136 OF DIVISION 2, SOCIAL SECURITY, OF ARTICLE V., PENSIONS AND RETIREMENT SYSTEMS, OF CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE VILLAGE, FOR THE PURPOSE OF DELETING THE PROVISION THAT PUBLIC OFFICIALS AND PART-TIME EMPLOYEES ARE EXCEPTED FROM THE BENEFITS OF THE SYSTEM OF OLD-AGE AND SURVIVORS INSURANCE AS .AUTHORIZED BY THE FEDERAL SOCIAL SECURITY ACT AND AMENDMENTS THERETO; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINA_ NCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on first reading and read by title alone. BILL 1040 -AMENDING SECTION 2-2(al BUDGET PROCEDURES -PLACED ON FIRST READING Vice Mayor Eissey moved that Bill 1040 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2-2(a), BUDGET PROCEDURES, OF ARTICLE I OF CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE VILLAGE, TO PROVIDE THAT THE VILLAGE MANAGER SHALL PREPARE AND SUBMIT TO THE MEMBERS OF THE VILLAGE COUNCIL A BALANCED BUDGET FOR THE OPERATION OF THE VILLAGE GOVERNMENT DURING THE NEXT FISCAL YEAR; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS. OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on first reading and read by title alone. Councilman O'Meilia seconded the motion, and all present voted aye. BILL 1041 -REPEALING SUBSECTION (31 DIVISION OF SIGNAL SERVICE . Councilman O'Meilia moved that Bill 1041 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REPEALING SUBSECTION (3), DIVISION OF SIGNAL SERVICE, OF SECTION 2-85, DIVISIONS, OF DIVISION 6, DEPARTMENT OF PUBLIC SERVICE, OF ARTICLE III OF CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE VILLAGE, AND ADDING A NEW SUBSECTION (3) TO SECTION 2-85 ENTITLED "DIVISION OF FACILITY MAINTENANCE"; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN . CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. 4 Minutes of Regular Session Held July 26, 2001 • Be placed on first reading and read by title alone. President Pro Tem Noel seconded the motion. During discussion, the Council agreed by consensus to change the wording in Paragraph (3) from "village owned property" to "village owned buildings". Thereafter, the motion passed 4-0. VILLAGE HALL RENOVATION -SCHEMATIC DESIGN APPROVED Councilman O'Meilia moved to take the Village Hall renovation schematic design from the table. President Pro Tem Noel seconded the motion, and all present voted aye. Vice Mayor Eissey moved to approve the revised schematic design for the Village Hall renovation. President Pro Tem Noel seconded the motion. Tim Hullihan, azchitect for the renovation project, was present to answer questions. During the discussion, Mr. Hullihan was asked to provide some options for access ramps for the handicapped, including the Council Chamber. An emergency generator for the building is also to be considered, as is the use of solar energy, where possible, for lighting. Thereafter, the motion passed 4-0. BUDGET TRANSFER -PARK MAINTENANCE AND ADMINISTRATIVE PART-TIME PAY FOR PUBLIC SERVICES DEPT. Councilman O'Meilia moved to approve a budget transfer in the amount of $60,000 from various Regular Pay accounts to various part-time pay accounts per RCA dated 7/18/01, to cover temporary part-time labor costs due to employees out as a result of workers compensation injuries.
