08-09-2001 VC REG-MMINUTES OF THE REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, AUGUST 9, 2001 Present: David B. Norris, Mayor Dr. Edward M. Eissey, Vice Mayor Donald G. Noel, President Pro Tem Charles R. O'Meilia, Councilman Joseph A. Tringali, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, CMC, Village Clerk ROLL CALL Mayor Norris called the meeting to order at 7:30 p.m. All members of the Council were present. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Eissey gave the invocation, and Councilman O'Meilia led the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES The following Minutes were approved as written: Minutes of Regular Session held 7/26/01 REPORT OF THE MAYOR Mayor Norris announced that Items 13.b, 13.c and 13.d on the Regular Session agenda were removed from the agenda. Item 4.b of the Workshop Session agenda also was dropped. CONSENT AGENDA APPROVED . President Pro Tem Noel moved to approve the Consent Agenda. Vice Mayor Eissey seconded the motion, and all present voted aye. The following items weie approved: Minutes of Regular Session Held August 9, 2001 Accepted for file the Minutes of the Code Enforcement Board meeting held 7/2/01 Lifted hiring freeze on Sanitation Collector position (job code #7020-0117) in the Public Services Department, per position audit and needs assessment Lifted hiring freeze on Building Inspector position (job code #6018-0108) in the Public Services Department, per position audit and needs assessment REPORTS OF SPECIAL COMMITTEES Councilman O'Meilia reported that the Palm Beach County Leap e of Cities will have two representatives on the committee for school boundaries. BILL 1039 -AMENDING DIV 2 SOCIAL SECURITY OF THE CODE -ENACTED AS ORD. 22-2001 Councilman O'Meilia moved that Bill 1039 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2-136 OF DIVISION 2, SOCIAL SECURITY, OF ARTICLE V., PENSIONS AND RETIREMENT SYSTEMS, OF CHAPTER 2, ADMII~IISTRATION, OF THE CODE OF ORDINANCES OF THE VILLAGE, FOR THE PURPOSE OF DELETING THE PROVISION THAT PUBLIC OFFICIALS AND PART-TIME EMPLOYEES ARE EXCEPTED FROM THE BENEFITS OF THE SYSTEM OF OLD-AGE AND SURVIVORS INSURANCE AS AUTHORIZED BY THE FEDERAL SOCIAL SECURITY ACT AND AMENDMENTS THERETO; PROVIDING FOR SEVERABII.,ITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on second reading and read by title alone. BILL 1040 -AMENDING SECTION 2-2~a) BUDGET PROCEDURES -ENACTED AS ORD. 23-2001 Councilman O'Meilia moved that Bill 1040 entitled AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2-2(a), BUDGET PROCEDURES, OF ARTICLE Minutes of Regular Session - Held August 9, 2001 I OF CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE VILLAGE, TO PROVIDE THAT THE VII,LAGE MANAGER SHALL PREPARE AND SUBMIT TO THE MEMBERS OF THE VILLAGE COUNCIL A BALANCED BUDGET FOR THE OPERATION OF THE VILLAGE GOVERNMENT DURING THE NEXT FISCAL YEAR; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on second reading and read by title alone. BILL 1041 -REPEALING SUBSECTION (3) DIVISION OF SIGNAL SERVICE - - ENACTED AS ORD. 24-01 Councilman O'Meilia moved that Bill 1041 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REPEALING SUBSECTION (3), DIVISION OF SIGNAL SERVICE, OF SECTION 2-85, DIVISIONS, OF DIVISION 6, DEPARTMENT OF PUBLIC SERVICE, OF ARTICLE III OF CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE VILLAGE, AND ADDING A NEW SUBSECTION (3) TO SECTION 2-85 ENTTTLED "DIVISION OF FACILITY MAINTENANCE"; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BILL 1042 -HOLIDAY LIGHTS AND DECORATIONS -PLACED ON FIRST READING Councilman Tringali moved that Bill 1042 entitled: AN ORDINANCE OF THE VII,LAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SUBSECTION (F) OF SECTION 6-112, EXEMPT SIGNS, OF ARTICLE V., SIGNS AND OUTDOOR DISPLAYS, OF CHAPTER 6, BUILDINGS AND BUII.DING REGULATIONS, OF THE CODE OF ORDINANCES OF THE VILLAGE, FOR • THE PURPOSE OF PROVIDING THE TIMES FOR ERECTION AND_ REMOVAL OF HOLIDAY LIGHTS AND DECORATIONS; PROVIDING .FOR SEVERABILITY; Minutes of Regular Session Held August 9, 2001 . PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. Be placed on first reading and read by title alone. President Pro Tem Noel seconded the motion. Councilman O'Meilia moved to amend language in Section 1.(F) the proposed ordinance by deleting all references to Christmas/Hanukkah holidays and October 15th and changing the second sentence to read: "Holiday lights and decorations may be erected no earlier than four (4) weeks prior to the subject holiday." Councilman Tringali seconded the motion. The motion failed 2-3, with Councilman O'Meilia and Councilman Tringali voting aye, and President Pro Tem Noel, Vice Mayor Eissey and Mayor Norris voting nay. Thereafter, the original motion passed 4-1, with Councilman Tringali, President Pro Tem Noel, Vice Mayor Eissey and Mayor Norris voting aye, and Councilman O'Meilia voting nay. BILL 1043 -ADOPTING STANDARD HOUSING CODE 1997 EDITION -TABLED Vice Mayor Eissey moved that Bill 1043. entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, RESCINDING AND REPEALING SECTION 15-1 OF CHAPTER 15, HOUSING, OF THE CODE OF ORDINANCES OF THE VILLAGE, WHICH ADOPTED THE STANDARD HOUSING CODE, 1991 EDITION, AS THE HOUSING CODE OF THE VILLAGE; CREATING A NEW SECTION 15-1 OF CHAPTER 15, HOUSING, OF THE CODE OF ORDINANCES OF THE VLL LAGE, FOR THE PURPOSE OF ADOPTING THE STANDARD HOUSING CODE, 1997 EDITION, OF THE SOUTHERN BUILDING CODE CONGRESS INTERNATIONAL, INC., AS THE HOUSING CODE FOR THE VILLAGE; AMENDING SECTION 15-2 OF CHAPTER 15, HOUSING, TO MAKE AMENDMENTS TO THE STANDARD HOUSING CODE, 1997 EDITION, BEING ADOPTED BY THE VILLAGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on first reading and read by title alone. President Pro Tem Noel seconded the motion. During discussion, it was noted that language should be added for compliance exceptions (rooming houses). Councilman O'Meilia moved to table this item to the next Regular Session. Vice Mayor Eissey seconded the motion, and all present voted aye. BILL 1044 -AMENDING SECTION 45-2 DEFINITIONS. OF THE ZONING CODE • Councilman O'Meilia moved that Bill 1044 entitled: 4 Minutes of Regular Session - _ _ _ - __- ' _ Held August 9, 2001 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 45-2, DEFINITIONS, OF ARTICLE I OF APPENDIX C, ZONING, OF THE CODE OF ORDINANCES OF THE VILLAGE TO PROVIDE A DEFINITION FOR "FAMILY"; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. Be placed on first reading and read by title alone. President Pro Tem Noel seconded the motion, and all present voted aye. RESOLUTION APPOINTING CCAB MEMBER By written ballot, copies of which are attached to the Minutes of record, the Village Council appointed David Talley to the Country Club Advisory Board, and that name was entered into Resolution 64-2001. Councilman O'Meilia moved that Resolution 64-2001 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING A MEMBER TO THE COUNTRY CLUB ADVISORY BOARD Be adopted. Vice Mayor Eissey seconded the motion, and all present voted aye. FLORIDA LEAGUE OF CITIES VOTING DELEGATE Councilman Tringali moved to designate Village Manager Dennis Kelly as voting delegate for the Village at the Florida League of Cities Annual Conference to be held August 23-25, 2001 in Lake Buena Vista.
