02-24-2000 VC PH-MMINUTES OF THE PUBLIC HEARING • OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, FEBRUARY 24,2000 Present: Dr. Edward M. Eissey, Mayor Joseph A. Tringali, Councilman Gail H. Vastola, President Pro Tem David B. Norris, Councilman Charles R. O'Meilia, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly CMC, Village Clerk ROLL CALL Mayor Eissey called the meeting to order at 7:21 p.m. All members of Council were present. All members of staff were present. PURPOSE OF THE PUBLIC HEARING The Purpose of the Public Hearing was to hear comments from the public concerning Bill 982, a proposed ordinance amending Chapter 3, Alcoholic Beverages, of the Code of Ordinances by adding a Section 3-4 prohibiting nudity or partial nudity and sexual conduct within establishments that sell alcoholic beverages for consumption on the premises. COMMENTS FROM THE PUBLIC Manny Grinn, 536 Greenway Drive, addressed the Council with three concerns: 1) amortization; 2) opt-in -opt out; and 3) definition of nudity and sexual conduct. Village Attorney George Baldwin opined that the Village would not have to amortize their loss of profits resulting from the code amendment. Mr. Baldwin also explained that since we did not opt out of the county adult entertainment ordinance, we were in, but we have opted out of the provision that conflicts with the ordinance that is being presently being considered. Mr. Baldwin further stated that he did not consider the original drafting of the county ordinance wherein municipalities were automatically covered unless they opted out, to be unconstitutional. Regarding the definition of nudity and sexual conduct and how it relates to other establishments, Mr. Baldwin stated that this ordinance applies to any establishment that has nudity and has alcoholic beverages, as defined in the ordinance. It applies whether or not an establishment has an adult entertainment license, and whether or not it is required under the county code to get one.
